VEIEREAS, certain house boats', rafts and other craft are being anchored; moored, and in some instances, placed on pilings above the water and on the bank adjacent to the water within the harbor limits of. the City of Beaumont, without the consent of -the City of Beaumont, or its 1-Iarbor li?aster, and the presence of such craft obstructs the navigation in said 'harbor, and the presence of said house boats and craft in the water and on. the banks within the harbor limitsreates a.menance to the use of said harbor for navigation and in several in— stances house boats and small craft have collided with ships coming into the harbor of -the City of Beaumont, causing damage to the ship and en— dangering the property and lives of persons on board said ships, as well as persons on.said house boats and other crafts, and there is no exist— ing ordinance prescribing rules and regulations with reference to the mooring _of vessels _-and crafts within- _the harbor limits -of the City of - BG.aumont and a necessity exists requiring the immediate enactment of an ordinance prescribing rules and regulations with reference thereto. NOt'd, THEREFORE, BE IT ORDAINED BY THE CITY C01:1[MISSION i OF THE CITY OF BEAULIONT : That the ordinance passed by the City Council of'the City of Beaumont on.the 15th day of June, 1915, entitled "An Ofdinance Fixing and Bs tabl fishing the Limits and Extent of the Harbor or Port of Beau— mont, Texas, Prescribing Rules and Regulations for/ the Government of the harbor, ilunicipal Wharves, Docks and Sheds; Prescribing Rates and Charges for ti,"Jharfage, Dockage and all Other Services and Facilities Furnished in said Port or -in said Municipal Docks, Vharves and Sheds; Prescribing a Penalty for the Violation of any of Said Rules and Regu— lations, and Declaring ani. emergency" be and the same is hereby amended so as to add thereto sections to be known as Sections 22a and 22b, read— ing as f ol;ows : SECTION 22a: It shall be unlawful for any person, firm or corporation to anchor, moor, place or in any .wi se leave within the harbor limits of the Fort of Beaumont any vessel, skiff, barge, house boat, raft or any other character of craft whatsoever without the written consent of the Harbor Master of . the City of Beaumont; SECTION 22b: Any person, in anywise violating the -above provision, shall be deemed guilty of a misdemeanor, and upon convic— tion thereof in the Corporation Court of the City of Beaumont, shall - be fined in any sum not less than Ten and no/100 ($10.00) Dollars, nor more than Two Hundred and no/100 ($200.00)- Dollars, and each day said section is violated, shall be considered a separate offense. hereas, the practice of anchoring and mooring, and in some instances, placing on piling within the harbor limits of the City of Beaumont, vessels, skiffs, house boats and other craft with— out the consebt of the City of Beaumont or its Harbor Diaster, con— stitutes a serious menance to.navigation in said harbor and endan- -� _ gers--tc- lives and property of persons Haul gating i n said harbor, and no orditance exists making; such practices unlawful, creates an emergency and an imperative public necessity necessitating the sus— pension of the rule requiring ordinances to be read on three (3) several days before their passage and said rule is therefore hereby suspended and this ordinance shall take effect and be in full force and effect from and after its passage and lawful publication.
