UVIIERS, the Eastern Texas Electric Company, a corpora— tion, operating the street railway system on the streets and highways of the City of Beaumont, under and in accordance with ordinances and franchises permitting it to do so, and is authorized by Chapter 44 of the General Laws of the 38th Legislature Second Called Session 1923, of the State of Tex— as, to operate motor busses for the carriage of passengers for hire, in connection with its street railway system, sub— ject to such reasonable regulations as the City Commission may prescribe; and, WHEREAS, the City Commission deems it advisable to prescribe regulations under which motor busses may be operat— ed by said company in connection with its street railway sys— tem; NOW, THEREFORE, BE IT ORDAiNED, by the City Commission of the City of Beaumont, Texas: SECTION 1. The right and privilege to operate motor busses or trackless vehicles for the carriage of passengers for hire, in connection with its railway system, is hereby recognized and granted to the Eastern Texas Electric Company, subject only, however, to such use of the streets, alleys and high— ways of the City of Beaumont as are prescribed herein and to such further regulations as tie City Comi...-Lissi on may from time to time prescribe. El in the interest of public safety; and the routes over which they are to operate shall be subject to such control as the City Commission may deem necessary for proper regulation of traffic. (b) The schedule of rates to be charged by the company for service rendered by the operation --of such trackless vehicles shall be compensatory for the various classes, character, and value of service rendered, and shall at all times be subject to the regulatory powers of the City Com— mission. This Ordinance shall not be deemed to affect any ex— isting Ordinances of the City of Beaumont regarding the general operation of motor vehicles on the streets of Beau— mont as jitneys within -the City .limits of said City or as- motor vehicles in the interuban jitney business for the carriage of passengers for hire, inhere such motor vehicles are not operated in connection with a street railway or interuban railway system in the City of Beaumont by a corporation having a franchise from the City of Beaumont for the use of the streets of said Oity fbr the operation of one or more such systems; but operation of busses either wholly within or partly within and partly without the City under this Ordinance @r' the aforesaid Act of the Legisla— ture shall in no way be controlled or affected by the pro— visions of such other Ordinances. SECT IOIN 11 When a. bus line is to be established by the Eastern Teras Electric Company, said Company shall file with the City Hanager the route over which said line is to operate and the f.a2�es=-.to:"zoe:;charged, which routes and rates must be submitted to the City Commission for their approval or disapproval; and 1.' the desi rynated fares without first obtaining the approval of the City Commission. Said Company is hereby granted the right to discontinue any or all bus lines which it may establish under this Ordinance or any amendment thereto; provided it first secures the approval of the City Commission. 4ECTION 111. - - - - -- Any officer- , agent., or employee:: of the Eastern Texas Electric Company or any others persons violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not less than ti�5.00 or more than '��200.00 and each day any provision— hereof is violated shall be considered a. separate offense.
