SAN ORDINANCE
AUTHORIZING THE VACATING AND CLOSING OF THAT PORTION
OF ERVAY AVENUE LYING IIT THE PEAR ORCHARD ADDITION
TO THE CITY OF BEAUMONT WHICH IS BOUNDED ON THE
NORTH BY A LINE JOINING THE NORTHEAST CORNER OF
BLOCK 2: AND THE NORTHWEST CORNER OF BLOCK 1, PEAR
ORCHARD ADDITION; ON THE EAST BY THE WEST LINE OF
SAID BLOCK 1; ON THE WEST BY THE EAST LINE OF THE
SAID BLOCK 2.; AND ON THE --SOUTH BY THE -NORTHEAST -
LINE PRODUCED SOUTHEASTWARD TO THE WEST LINE OF
BLOCK 1 OF A TRACT DEEDED BY MRS., IDA B. SHEPARD
TO THE CITY OF BEAUMONT AS A RIGHT—OF—WAY TO
CONNECT AVENUE A AND.ERVAY AVENUE; SAVE AND EX—
CEPT A STRIP OF LAND 2.0 FEET WIDE TO CONNECT THE
ALLEY IN THE SAID BLOCK 1 AND THE ALLEY IN THE
SAID BLOCK 2. AND DECLARING AN EMERGENCY.-
WHEREAS,..it is deemed necessary to open up and -extend,
Avenue A so as to connect with Ervay Avenue connecting the
Spindle Top lRoad and the West Port Arthur Road With Avenue A,
and Iters. Ida B. Shepard has agreed to deed to the City a
right—of—way 60 feet in width over a portion of Block 2.' -in the
Pear Orchard Addition to the City of Beaumont so as to straighten
said highway and the crowded conditions of traffic to Spindle. Top
and the West Port Arthur Road on the available highways leading
thereto makes it dangerous to life, limb and property to travel
over said highways and an imperative public necessity exists re=
quiring the immediate opening of an extension of,Avenue A and
creates an emergency-and_an imperative -public necessity -requiring_
that the rule that ordinances be -read an three several days before
their final passage be suspended and said rule is hereby suspended
and this ordinance shall be in force and effect from and after
its passage.
NOWT, THEREFORE, BE IT ORDAINED BY THE CITY COhMISSION
OF THE CITY OF BEAUMONT:
That that portion of Ervay Avenue lying in the Pear
Orchard Addition to the City of Beaumont which is bounded on the
north by a line -joining the northeast corner of Block 2 and the
northwest corner,of Block 1, Pear Orchard. Addition; on the east
by the west line of said Block 1; on the west by the east line of
the said Block 2,• and on the south by the northeast line produced
southeastward to the west line of Block 1 of a tract deeded by Mrs.
Ida. B. Shepard to the dity of Beaumont as a. right—of—way to connect
Avenue A. and Ervay Avenue;' save and except a strip of land 20 feet
wide to connect the alley in the said Block 1 and -the alley in the
said Block 2,.be and the same is hereby vacated and closed and that
the title to such street shall --revert t -o-- and become the property of -
Ears_. Ida B. Shepard, the owner --.of --the landl -bordering on s ai d str-ee.t.
The fact that the crowded conditions of traffic on the
available highway leading to Spindle Top is dangerous to life,
limb and property creates an imperative public necessity requiring
the immediate opening of an additional highway leading to Spindle
Top and the West Port Arthur Road and creates an imperative public
necessity requiring the rule that ordinances shall be read on
it it
three several days before their final passage be suspended and said rule
is hereby suspended and this ordinance shall be in force and effect from
and after its passage.
Passed by an affirmative vote of all the members of the
C=ity -Commission, this the 25th day of August, A.D._-19:2:6_._
