WHEREAS, Pursuant to the requirements of sub -division (h) of the Section 68, of the Charter of the Oity of Beaumont, the City Commission Of the City of Beaumont caused to be published for the time and in the manner required therefor by the City Charter, a notice of a resolution of stAd commission, passed heretofore on the 15th Day of June A. E. 1926 ordering a hearing to be gi'#ren to the persons, firms, corporations arra estates, theft agents or attorneys, owning property abutting on Avenue C from the North Side of Urookett Street to the South 4ide of Irma Avenue, Sixth Street from the North Site of Laurel Avenue to the South Side of Hazel Avenue, Center Street from the North Side of Laatrel Avemue to the South Side of Hazel Avenge, ging Street fram the North Side of Laurel Avemie to the Jouth Side of Liberty Avenue and Irma Aveme from the ,Bast Side of Avenue C to the Alley between Orange Street land Avenue A; and calling upon all persons interested in said matter to appear and show cause, in conformity with the provisions of the Charter above referred to, why the assessment in said notice should not be made against said property and against the owners thereof, which hearing was to be held in the Council Chamber of the City Hall of Beaumont, Texas at 3 O'Clock P. hi. on the 6th Day of July A. D. 1926. AND WHEi::AIAS, a full and fair hearing in conformity with the Charter and law in such cases hafting been had in conformity with said notice, and the Commission having inquired into and determined all facts necessary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; AND, it appearing that the assessment as proposed in the above mention- ed Resolution passed on the 15th Day of June A. That there Is hereby assessed against the several ownersof pneperty and against theft respective property abutting upon Avenue C from the North Side of Urockett Street to the South Side of jrma Avenue, Sixth Street from the North Side of Laurel Avenue to the outh Side of Hazel Avenue, Center Street from the North Side of Laurel-Avemte to the South Side of Hazel Avenue, Swing Street from the North Side of Laurel Avenue to the douth Side of liberty Avenue and Irma Avenue from the East Side of Avenue C to the Alley between Orange Otreet and 4venne A; as a tax two- thirds (2/3) of the cost of paving and gutter and incidental drainage, and all the cost of cnebing said Avenue C from the North Side of arockett Street to the South Side of Irma Avenue, Sixth Street from the North Side of Laurel Avenue to the Mouth Side of Hazel Avenue, Center Street from the North Side of Laurel Avenue to the South Side of Hazel Avenue, ung +Street from the North Side of Laurel Avenue to the South Side of Liberty Avenue and Irma Aveyue from the Aast Side of Avenue C to the Alley betwee-, Orange Street and Avenue A, The lot, lots, parts of lots, blocks or tracts of land on which said tax is levied and assessed is hereinafter described together with the number of front feet on such lot, lots, parts of lots, blocks or tracts of land, the name or names of the owner or owners thereof and the propertionate amount of the cost of said paving and gutter, and the cost of said curbing be borne and paid for by such owner or owners as shown by the statement prepared by the Cit# Engineer of the City of Bealmoift, which said amount is hereby levied and assessed as a tax upon such lots, parts of lots, blocks or tra*ts of land as shown to -wit; ilL F -3.► SVA RC TI ON 2. That said,�so levied and assessed shall become due and payable upon the completion of the paving upon the portion of said Streets upon Which said lot, lots, parts of lots blocks or tracts of land, front and abutt, and the amount of the tax hereby levied and asses a together with the cost of collecting and interest at seven (71/17o) peri from the date same is collectable until paid is hereby declared a lein against said lot, lots, parts of lots, blocks or tracts of laiA, supPrior to all other loins claims, or titles except City, County and State taxes, and constitute a personal charge or claim against the owner or owners of said lots, parts of lots, blocks or tracts of land. SECTION 3. All the cost of grading and paving those portions of AvmLue C from the North Side of Crockett Street to the South tide of Irma ®value as are oc- oupied between the rails of the tracks of the Eastern 4xas Electric Company and a space Twenty Four (24) inches beyond the outer enige of the rails of Said Compsay located on said Street shall be borne by the Said Eastern 4xas Electric Company and such costs of said improvements are hereby assessed against the said Eastern 'Texas Electric Company and shall _.be collected as other assessments levied under this ordinance, prokrided such work shallbe done in accordance with the City Ordinances regulating the construction of liailRoade in the 4treets of the City of Beaumont and the paving of such Streets traversed by -the same. SECTION 4. The fact that the peartions of the above named streets as indicated are in bad condition and jeopardize the safety of the people traveling thereon creates an emergency and an imperative Dublic necessity, neces- sitating the suspension of the rule requireing ordinances to be read on Three (3) several dayer before theft passage, said rule is therefore hereby suspended and this Ordinance shall take effect and be in full force and effect from ani after its passage ani bublication.
