RA.ILWAY CGRPANY- AND TIE GULF BEAtMONT AND KANSAS CITY RA'IZWAY COMPANY ON .LAUREL AVENUE BETWEEN THE WEST SITDE OF MAGNOLIA AVENUE AND THE WEST SIDE OF F-OURThi STREk All THE COST OF PAVING BE-, TWEEN AND TWO -(2 )FEET ON EACH SIDE OF THE TRACKS AND RAILS OF SAID -0OMPANIES; AND DECLARING SAID TAX A LEIN UPON SAIDPROPERTYAND PER- SONAL DEBT UPON THE OWNER OR OWNERS THEREOF_ AND PROVIDING A TIRE WHAT ,SAID TAX SHALL BECOME DUE AND -PAYABLE, PROVIDING FOR THE COLLECTION OF -SAME AND ALL COST-1-NCURRED IN COLLECTION OF SAME IF NOT PAID AT THE --T-IM IT BECOMES DUB AND PAYABLE; AM PROVIDING THE RATE OF INTEREST SAID :TAX SHALL BEAR FROM THE TIME IT BECOMES -DUE UNTIL PAID AND DE.- CLARING AN EMERGENCY. WHEREAS, pursuant to the requirements of sub -division (h) of 3e.etion . 68 _-of, the _Charter- -of the _City _of Beaumont , the -City Commission of the City of Beaumont caused to be publishedforthe time and in the manner required therefor by the City Charter, a notice of a resolution of said 8ommission, passed heretofore on the 30th Day of March A. D. 1926 ordering a hearing to be given to the persons, firms, corporations or estates, their agents or attorneys awning. property abutting on Avenue "A" from the North Side of Washington Boulevard to the South Side of -College street, Laurel Avenue from the Wrist Side of -Magnolia Avgnue to the. Wgist Side of Fourth; _Street and Laurel Avenue from -the Vo-st Side of Fourth -Street to the West Side of Tenth Street; and calling upon all persons interested in said matter to appear and show cause`, in conformity with the -provisions of the Charter above referred to, why the assessment in said notice -should-- not be made against said property and against the owners there- gf,-which hearing was to be held in the Council Chamber of the City Hall of Beaumont, Texas at 3 OtClock P. M.. on the 20th Day of April A. D. 1926. AND WHEREAS, a full and fair hearing in conformity with the Char- ter and law in such cases having been diad in conformity vdth said notice, and the Commissi6n having inquired into and determined all facts necessary to the adjudication of all special benefits accruing to sueh owners by means of such improvements, aid said hearing having t been duly closed; RM it appearing that the aesessments as proposed in the above mentioned resolution passed. on the 30th Day of March A. SECTION 1. That there is hereby assessed against the several owners of operty and against their'respective property abutting upon Avenue "A" om Oe North Side of Washington Boulevard to the South Side of llege . Street , Laurel Avenue - from the east Side of Magnolia Avenue the West Side of Fourth Street and Laurel Avenue from the Nest de of Fourth Street to the Nest Side of Tenth Street; as a tax a -thirds (2/3) of the cost of paving and gutter and incidental ainage-, and all.the cost of curbing said Avenue "Aa from the North ie of Washington Boulevard to the South Side of College Street, urel Avenue from the West Side of Magnolia Avenue to the West ie of Fourth Street and Laurel Avenue -from the West Side of Fourth reet to the West Side of Tenth Street.. The, lot, lots, parts of lots, blocks or tracts of land -on which Ld tax is levied and assessed is hereinafter described, together ;h the number of front feet on such lot, lots, parts of lots, acks or tracts of land, the name or names of the ovrner or; owners Rreof and the proportionate amount of the cost of said paving and :ter, and the 'co st of said curbing to -be borne and peid for by :h owner or owners as -shown by the statement prepared by the City ;ineer of the City of, Beaumont, which said .amount is hereby levied L assessed as a tax upon such lots, parts of lots, blocks or tracts land as shown to -wit; SECTION -80 That said tax so levied and assessed shall become due and ayable upon the' completion of the paving upon the portion of said Ireets upon which said lot,, lots, parts of lots, blocks or tracts i of land, front and abutt, and the amount of the tax hereby -levied i and assessed together with the cost of collecting and. interest at Seven (7%6) percent per annum from the date same is_:collectable un- til paid is hereby declared a dein against said lot, 1-ots, parts of lots, blooks or tracts of land, superior to all otherleins claims or titles except City, County and State Taxes,and constitute a per- sonal charge or claim against the owner or owners of said lots; parts of lots, blooks or tracts of land. SECTION 39 - That . - That all the cost of grading and paving those portions of Avenue "All from the North Side of Washington Boulevard to the South Side of College Street and Laurel' Avenue from the West Side of I Magnolia Avenue to the West Side of Fourth Street and Laurel Avenue } from the West Side of Fourth Street to the West Side of Tenth Street as are occupied between the .rails' of the tracks_ of the Eastern Taxa_ s Electric Company, the Texas & -New Orleans Railway,. Company aid the Gulf Beaumont and Kansas City Railway Company and a space twenty ! four (24) inches beyond the outer edge of the rails of said Companies located on said Streets shall be borne by the Said Eastern Texas Electric Company, Texas land New Orleand Railway Company d the Gulf Beaumont and Kansas City Railway Company respective.Ili- , and such costs of said improvements are hereby assessi4against the said Eastern Texas Electric- Company, The Texas & New Orleans Railway Co- mpany, Gulf Beaumont and Kansas City Railway Company, 'respectivelly, and shall be collected as other assessments levied under this ordi- nance, provided such work shall be done in accordance with the City ---Ordinances: regulating the construction of- RailRoade in the Streets of the City of Beammont , and the paving of such Streets traversed by same. SECTION 4.. The fact that the portions of the above named Streets as in- dicated are in bad condition and jeopardize the safety of the peo- ple travelling thereon creates an emergency and an imperative public necessity, necessitating the suspension of the rule requiring or- dinances to be read on. three several days - before their passage, said rule is therefore, - hereby suspended and this ordinaree shall take effect and be in full force and effect from and after its pass- i age and publication.
