BE IT OR.BAINED BY THE CITY COMMISSION OP THE CITY OF BEAUMONT: sFICTIONI That the. Beaunoht_Whtirf' & Terminal Company be and it is hereby granted the privilege to construct . and: maintain, at . its. ovrn , expense, three single standard =tailroad tracks, .along Austin Street, as. follows: Track IF22, .with point of. switch in the South Branch of the BW&T in'Austin Street 239 feet west of the west line of Dain Street - and9 running eastward on- a 9 degree- 30minute_curve--to` the right 106 feet. Track. #36, with point of switch in the South..Sranch . of the BW -&T in ,Austin Street 15.5 feet west of the .west line. of. main Street and running eastward on a 9 degree 30 minute curve to the left 75 feet: Track #19%,..with point of . switch in' the South Branch of the BW&T in Bustin Street 68.6. feet west of the west line of Main Street and ,running eastward on a 8 degree 30 minute curve to the right 11.4 feet, in the City of Beaumont. It being understood and agreed that these tracks are laid for the purpose of connecting the Texas & New Orleans Rail- road Company with,the tracks, of the Beaumont wharf & Verminal in order to better serve..the. municipal wharf. -- _ SECT ION T h The Grantee, its Successors and Assigns, shall have the right to operate trains, engines and cars over said tracks and sidings when done so as to further the interests for which this grant is given as SECTION III That the said Beaumont Wharf & Terminal. Company shall be re- quired, at its own expense, to eoustraot and maintain suitable ditches and culverts for the purpose of properly draining said streets, and to construct and maintain good and sufficient crossings at the inter- sections of all cross streets, crossed by its 43ai.d railroad tracks with. easy approaches thereto, so as to keep said street and crossings in such condition,.. as not to unreasonably interfere with public travel and traffic, thereon. SECTION IV .That said Beaumont ' Wharf & Terminal Company shall be further required to construct and. maintain said .railroad ..tracks. at the same grade or level as the established grade o.r level-of..said street, so as not to in any wise . obstruct the use of same .by the . public, and shall also within a reasonable time, not . exoeeding, thirty days after the con- struction, of said railraod tracks, ballast said railroad tracks along said street between the rails and to a distance of two feet on either side thereof. with rock, gravel, shells,__sand,_.cinders-__or other suita- ble material to be determined by the City Commission in -such manner that said tracks may be on a level 'with said street. SECTION V ',Xhe grant herein given ' is. for. single tracks only; and shall be laid under the direction ofthe City Engineer of the City of Beaumont, and should a dispute over said construction arise, .the Grantee, its Successors and assigns, hereby agree to refrain, from.doing said work until the matter of dispute has been determined..by.the City Commission of the City of Beaumont, whose, -decision. shall be final, SECTION VI Said railroad Uompany,. shall, .wi.thin.. thirty (-50j . days after written notice from the Cita, put in and construct permanent. grade cross- ings at all of the street crossings where said tracks as.relocated shall arose any street in the City of Beaumont, according to the plans and ..... ... i .03 n -4-9 1 - Cg4 i- tr nT - +••'�• ' 'SECT -ION V 11 This Franchise shall be subject to all the terms. and provi- sions of the charter of the City of Beaumont or any amendments thereto,, SECTION VIII The foregoing rights., and privileges are,. especially granted upon the expressed condition that the said grantee, its Suocessors or Assigns, shall within thirty (SOP days after the- passage and approval by the Mayor of thi Ilranchise, acting through. its proper. officer, file with, the City V its written . acceptance . of this ordinance and upon further condition that, the tracks to be constructed hereunder shall be completed within _� o days from the passage hereof and upon the failure of the grantee, its Successors or. I presume this request is receiving the usual handling and 'will be granted shortly and I am merely calling attention to it so that it -will not be overlooked.
