HomeMy WebLinkAboutORD 72-EAIkT ORDINANCE ENTITLED AN ORDINANCE LEVYING AND ASSESSING AS A TAX UPON THE LOTS, PARTS OF LOTS, BLOCKS, OR TRACTS OF LAND WHERE NOT DIVIDED INTO LOTS OR BLOCKS, FRONTING OR ABUTTING ON, IRVTN AVE FROM THE SOUTH SIDE OF SHAMROCK AVENUE TO THE SOUTH SIDE OF MADISON AVENUE, SPRUCE AT ,,i, FROM THE WEST SIDE OF GULP' STREET TO THE SOUTH SIDE -0 LIVE OAK STREET, ,AND LIVEx STR>■"EF, FROM THE NORTH SIDE OF SPRUCE STREET TO THE WEST SIDE OF GRAND AVENUE; TWO THIRDS#2/3) OF THE COST OF PAVING AND GUTTER AND INCIDENTAL DRAINAGE AND ALL THE COST OF CURBING SAID, IRVING AVENUE FROM THE SOUTH SIDE OF SHAMROCK AVENUE TO THE SOUTH SIDE OF MADISON AVENUE, SPRUCE STREET FROM THE WEST SIDE OF GULF STREET TO THE SOUTH SIDE OF LIVE OAK STREET AND LIVE OAK STREET FROM TH_ NORTH SIDE OF SPRUCE STREET TO THE WEST SIDE OF GRAND AVENUE; APPORTION& i,BLE TO THE HEREINAFTER REFERRED TO PROPERTY, LEVYING AND ASSESSING AS A TAX UPON THE EASTERN TEXAS ELECTRIC COMPANY TRACKS ON IRVING AVENUE FROM SOUTH SIDE OF SHAMROCK AVENUE TO THE SOUTH SIDE OF MADISON AVENUE ALL THE COST OF PAVING BETWEEN AND TWO (2) FEET ON EACH SIDE OF THE TRACKS AND RAILS OF SAID COMPANY; AND DECLARING SAID TAX A LIEN UPON SAID PROPERTY AND A PERSONAL DEBT UPON THE OWNER OR OWNERS THEREOF AND PROVIDING A TIME WHEN SAID TAX SHALL BECOME DUE AND PAYl- BLE, PROVIDING FOR THE COLLECTION OF SAME AND ALL COST INCUR& RED IN COLLECTION OF SAME, IF NOT PAID AT THE TIME IT BECOMES -DUE AND PAYABLE; AND PROVIDING THE RATE OF INTEREST SAID TAX SHALL BEAR FROM THE TILE IT BECOMES DUE UNTIL PAID AND DECLAR- IND AN EMERGENCY. WHEREAS, pursuant to the requirements of Sub -division (h) of Section 68 of the Charter of the City of Beaumont, the City Commission of the Pity of Beaumont caused to be published for the time and in the manner required therefor by the City Charter, a notice of a resolution of said Commission, passed heretofore on the 4th day of ARgust A.D. 1925 ordering a hear- ing to be given to the persons, fhrms, corporations or estates, their agents or attorneys owning property abutting on Irving Avenue from South side of Shamrock Avenue to the South side of Madison Avenue, Spruce Street from West side of Gulf Street to the South side of live Oak Street and Live Oak Street from the North side of Spruce Street to the West side of Grand Avenue; and calling upon all persons interested in said matter to appear and show cause, in conformity with the provisions of the Charter above referred to, why the assessment in said notice should not be made against said property and or the onners thereof, which hearing was to be held in the Council Chamber of the City Hall of Beaumont Texas at 3 o'clock P.M. on the 25th day of August A.D. 1925; AND, WHEREAS, a full and fair hearing in conformity with the Charter and the law in such cases having been had in conformity with said notice, and the Cammission having inquired into and derermined all facts necessary to the adjud- ication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; And it appearing that the assessments as proposed in the above mentioned resolution passed on the 4th day of August A.D. 1925 with the exceptions hereinafter noted, are i -n Ali t•an„anf_n fni.+ wnA a"A +7,a+ +'Dara as4l l 7,a against the abutting property and the respective owners thereof. NOW , TEMP ORE BE IT ORDAINED BY THE CITY C OMIS- SION OF THE CITY OF BEAUMT; SECTION 1. That there is hereby assessed against the several owners of property and against their respective property abutting upon Irving Avenue from the South side of Shamrock Avenue to the South side of Madison Avenue; Spruce Street from the West side of Gulf Street to the South side of Live Oak Street and Live Oak Street from the North side of Spruce Street to the West side of Grand Avenue; as a tax two thirds (2/3) of the cost of paving and gutter and incidental drain- age, and all the cost of curbing said Irving Avenue from the South side of Shamrock Ave to the South side of Madison Ave. nue, Spruce Street from the West side of Gulf Street to the South side of Live Oak Street and Live Oak Street from the North side of Spruce Street to the West side of Grand Avenue; The lot, lots, parts of lots, blocks or tracts of land on which said tax is levied and assessed is hereinafter described, together with the number of feet front on such lot, lots, parts of lots, blocks or tracts of land, the name or names of the owner or owners thereof and the proportionate amount of the cost of said paving and gutter, and the cost of said curbing th be borne and paid for by such owner or owners as shown by the statement prepared by the City Engineer of the City of Beaumont, which said amount is hereby levied and assessed as a tax upon such lots, parts of lots, blocks or tracts of land as shown to -wit; c" 4 SECTION 2. That said tax so levied and assessed shall become due and payable upon the completion of the paving upon the por- tions of said streets, upon which said lot, lots, parts of lots, blocks or tracts of land front and abutt, and the amount of the tax hereby levied and assessed together with the cost of collecting same and seven (7%) percent per annum from the date same is collectable until paid is hereby declared a lien against the said lot, lots, parts of lots, blocks or tracts of land, superior to all other liens, claims or title except City, County and State taxes, and shall constitute a personal charge or claim against the owner or owners of said lo#s, blocks or tkacts of land. SECTION 3; That all the costs of gradin; and paving that portion of Irving Avenue between the South side of Shamrock Avenue and the South side of Madison Avenue as is occupied between the rails of the tracks of the Eastern Texas Electric Company and a space twenty four inches beyond the outer egge of the rails of said company located on said street shall be borne by the said Eastern Texas Electric Company, and such costs of said improvements are hereby assessed against the said Eastern Texas Electric Company, and shall be collected as other assessments levied under this ordinance, provided such work shall be done in accordinace with the City Ordinances regulating the construction of railroad in the streets of the City of Beaumont, and the paving of such streets traversed by same. SECTION•` -4. The fact that the portions of the above named streets as indicated are in bad condition and jeopardize the safety of the people travelling thereon creates an emergency and an imperative public necessity, necessitating the suspension of the rule requiring ordinances to be read on three several days before their passage, said rule is therefore, hereby suspended and this ordinance shall take effect and be in full force and, effect from and after its passage and publication, passed this the 25th day of August A*D. 1925.by the affirmative vote of all members of the Commission.
