FROM THE EAST SIDE OF CMITER STREET TO THE EAST SID OSA STREET; FORREST STREET FROM THE NORTH SIDE OF NORTH STREET TO THE SOUTHSTE OF HARRISON AVENUE; TWO THIRDS (2/3) OF THE COST OF PAVING AND GUTTER AND INCIDENTAL DRAINAGE AND ALL THE COST OF CURBING SAID MARIPOSA STREET FROM THE NORTH SIDE OF CALDER AVENUE TO THE NORTH SIDE OF HAZEL AVENUE; BAZEL AVENUE FRON THE EAST SIDE OF CENTER STREET TO THE EAST SIDE OF 11ARIPOSA STREET; FORREST STREET FROM THE NORTH SIDE OF NORTH STREET TO THE SOUTH SIDE OF HARRISON AVENUE; APPORTIONABLE TO THE HEREINAFTER REFERRED TO PROPERTY, AND DECLARING SAID TAZ A LEIN UPON SAID PROPERTY AND A PERSONAL DEBT UPON THE OWi' % OR THEREOF AND PROV- IDING A TIME WHEN SAID TAX SHALL BECOME DUE AND PAYABLE, PROV- IDING FOR THE COLLECTION OF 3AME AND ALL COSTS INCURRED IN COLLECTING SAME, IF NOT PAID AT THE TI10 IT BEC WES DUE AND PAYABLE; AND PROVIDING THE RATE OF INTEREST SAID TAX SHALL BEAR FROM THE TIME IT BECOMES DUE UNTIL PAID AND DECLARING AN EMER- GENCY. WHEREAS, pursuant to the requirements of subdivision h of section 68 of the Charter of the City of Beaumont, the City Commission of the City of Beaumont caused to be published, for the time and in the manner required therefore by the City Charter , a notice of a resolution of said Commission passed heretofore on the 16th day of June A.D. 1925 ordering a hearing to be gigen to the persons, firms, corporations or estates, their agents or attorneys owning property abutting on Mariposa Street from the North side of Calder Aveizue to the North side of Hazel Avenue; Hazel Avenue from the East side of Center Street to the East side of Mariposa Street; Forrest Street from the North side of North Street to the South side of Harrison Avenue; and calling upon all persons interested in the said matter to appear and show cause, in conformity with the provisions of the Charter above referred to, why the assessment in said notice should not be made against said property and or the owners thereof, which hearing was to be held in the council chamber of the City Hall of Beaumont, Texas at 3 o'clock P,M. on the 7th day of July A.D. 1925; into and determined all facts necessary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; And it appearing that the assessments as proposed in the above mentioned resolution passed on the 16th day of June A.D. 1925 with the exceptions hereinafter noted, are in all respects fair and equitable, and that there will be a full and adequate and special benefit to the abutting property and the owners thereof from and by reason of the proposed pavement and improvement in excess of the amount assessed against the abutting property and the respective owners thereof. NOW,THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: O RCTION 1 That there is hereby assessed against the several owners of property and against their respective property abutting upon Mariposa Street from the North side of Calder Avenue to the North side of Hazel Avenue; Hazel Avenue from the Bast side of Center Street to the East side of Mariposa Street; Forrest Street from the North side of North Street to the South side of Harrison Avenue; as a tax two thirds (2/3) of the cost of paving and Batter and incidental drainage, and all the cost of curbing on said Mariposa Street from the North side of Calder Avenue to the North side of Hazel Avenue; Hazel Avenue from the East side of Center Street to the East side of Mariposa Street; Forrest Street from the North side of North Street to the South side of Harrispn Avenue; r The lot, lots, parts of lots, blocks or tracts of land on which said tax is levied and assessed is hereinafter described, together with the number of feet front on such lot, lots, parts of lots, blocks or tracts of land, the name or names of the owner or owners thereof and the proportionate amount of the cost of said paving and gutter and the cost of said curbing to be borne and SECTION 2 That said tax so levied and assessed shall become due and payable upon the completion of the paving upon the portions of said streets, upom which said lot, lots, parts of lots, blocks or tracts of land front and abutt, and the amount of the tag hereby levied and assessed together with the cost of collecting same and seven per cent per annum from the date same is collec- table until paid is hereby declared a lien against the said lot, lots, parts of lots, blocks or tracts of land, superior to all other liens, claims or title except Cift, County and State taxes, and shall constitute a personal charge or claim against the owner or owners of said lots, blocks or tracts of land. SECTION 3 The fact that the portions of the above named streets as indi- cated are in bad condition and jeopardize the safety of the people travelling thereon creates an emergency and an imperative public necessity, necessitating the suspension of the rule requiring ordinances to be read on three several days before th6ir passage, said rule is therefore, hereby suspended and this ordinance shall take effect and be in Rill force and effect from and after its passage and publication. passed this the 7th day of July A.D. 1925, by the affirmative vote of all members of the commission.
