AN ORDINANCE
AUDITING AND ,ALLOWING CLAIM OF UVALrDE ROCK ASPHALT
COMPANY FOR CONTRACT PRICE OF WORK PERFORMED UNDER CONTRACT
BETWEEN SAID OOMPANY AND THE CITY OF BEAUMONT, AS COVEPID
BY A CERTIFICATE -FURNISHED BY THE CITY.ENGINEER, AND AUTHOR3L
_ I ZI NG THE DELIVERY TO SAID COMPANY OF CITY OF - BEAUMONT
STREET-I11PR0VEMENT-_WARRANTS, UVALDE ROCK ASPHALT COMPANY
SERIES, TO THE AMOUNT OF _$9,000:'00: AND DECLARING_ AN ENERL
GENCY.
WHEREAS, heretofore on the 7th day of March, 1924, -the City
of Beaumont entered into a contract with Uvalde Rock As_phalt
Company for the construction of certain street improvements in and
for said City, which contract is recorded in Book 7, of the Minna
tes of the City Commission of said City; and
WHEREAS, on the 30th day of April, 1924) a supplemental
contract was entered into by and between said city and said Com-
' parry wherein and whereby it was agreed that the contract price for
the construction of said street, improvements shall be payable in
the issuance of City of Beaumont Street Improvement Warrants, not
to exceed 035,00000O.to be delivered -in installments in payment -
of work completed, . as covered by certificates of the City Engineer,
after claim covering such certificate has been duly audited and
allowed by the City Commission of said City; and
WHEREAS, the said UvaldeRock Asphalt Company has --
presented to the City Commission a Certificate duly made -by
the City Engineer, covering work completed under said contract,
wh-ch--certifi-catb is --in words and- figures as follows:

WHEREAS said cettificate has.been duly audited by this
Commission and fotnd to .be cbrre'ct; and
WHEREAS: the said Commission has investigated and found
that there are no claims due against said contractor for material
furnished or labor performed under said contract _and_ that said
Company is entitled to receive the full amount as shown by said
ce rtif i cat e;
NOW, THEREFORE., BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF-tEAUMONT..
That claim of said Uvalde Rock Asphalt Company,- as covered
by certificate.of City Engineer herein set out, be and the same
is hereby -allowed. That the indebtedness of the City, of Beaumont,
as shown by said certificate, be evidenced by the issuance and
delivery to said Uvalde Rock Asphalt Company of CITY OF BEAUMONT
k STREET_ IMPROVEMENT WARRANTS:- UVALDE _ROCK ASPHALT COMPANY SERIES
numbers 25 to 33, inclusive; aggregating $;,,9,000:00, , of an issue
of thirty-five warra2Yl s of the denomination of $1,000:'00 each,
aggregating $351000:00, dated June 1, 1924, bearing interest at
the rate of 7% per annum, authorized to be issued by an ordinance
passed by the City Commission of said City on the 6th day of May,
1924, recorded in -Book 5 pages 32 .et - seq. of the Minutes of said
Commission: That the City of Beaumont has received full value
and consideration for said issue of warrants:'
The fact that the work provided for under the contract
between..the -_Cit--y__ _of- Beaumon-t---and-the-Uvalde bock Asphalt Company
has,been completed in full compliance with the obligations
of the Uvalde Rock Asphalt Company and the bikance payable .to said
Company on said contract is now past due, and the good faith
and credit of the City of Beaumont requires prompt payment of
to be read on three separate meetings, said -rule is, therefore,
hereby suspended and this ordinance shall take effect' from and
after its passage
