ENTITLED AN ORDINANCE TERMINATING THE SOLID
WASTE FRANCHISE AGREEMENT WITH IMPACT
WASTE, LLC.
WHEREAS, on March 21, 2017, the City Council of the City of Beaumont, Texas
passed Ordinance No. 17-017 approving the transfer of a franchise agreement from
Industrial Transportation Waste, LLC (ITW) to Impact , Waste, LLC for solid waste
collection and transportation services in the City of Beaumont; and,
WHEREAS, Impact Waste, LLC has failed to report monthly receipts and
franchise fees and currently has failed to make full payment for the amounts due for
January 2019, February 2019, March 2019 and April 2019; and,
WHEREAS, such failure to pay the required franchise fees is a violation of its
franchise ordinance; and,
WHEREAS, City Council is of the opinion that it is in the best interest of the City
to terminate the franchise agreement with Impact Waste, LLC;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby,
in all things, approved and adopted; and,
THAT the franchise agreement with Impact Waste, LLC be and it is hereby
terminated effective upon the mailing of notice to company of this action to terminate;
and,
BE IT FURTHER ORDAINED THAT this action is not intended to waive any right
to collect any outstanding payments due under the franchise.
The meeting at which this ordinance was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
