HomeMy WebLinkAboutORD 45-H— r AN ORDINANCE ENTITLED AN ORDINANCE AUTHORIZING THE EASTERN TEXAS ELECTRIC COMPANY, SUCCESSORS OF BEAUMONT TRACTION COMPANY, TO ABANDON STREET CAR TRACKS AND OPERATION THEREON, ON ROYAL, AVENUE F, AND FOCH STREETS IN THE CITY OF BEAUMONT UPON THE CONSIDERATIONS THEREIN STATED. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1. That the Eastern Texas Electric Company, successors to Beaumont Traction Company, be authorized to abandon its street railway tracks and the operation of cars thereon, on and along Royal Street from the point where said track intersects with the track laid on Park Stleet, thence along Royal Street to Wilson Street and on and along Avenue F from said intersection of Royal Street with Wilson Street ti to the intersection of Avenue F with Foch Street and on and along 1 Foch Street to Blanchette Street, the present terminus of the Royal street car line. Section 2. This ordinance is passed and the permission to remove said street car tracks is herein given on .the consideration that said Eastern Texas Electric Company agrees to gnd will substitute ade- quate bus service therefor to be temporarily routed along Avenue G and other Streets, in accordance with the proposal of said Company, and that said Eastern Texas Electric Company will with reasonable dispatch remove the above mentioned tracks, regrade the streets from which such tracks are removed on the unpaved portions thereof and restore the paving on the paved portions after such tracks are removed therefrom, in a manner to be approved by the City Engineer, and will pay to the Cityof Beaumont the cost of shelling or graveling the unpaved portion of said Streets from which such tracks: are removed, not to exceed the sum of Seven 1 t which said tracks have been removed as soon as such route is shelled or graveled and ready for use, such route to be changed only by per- mission of the City Commission; the fare for such bus service to be the same as obtains on the balance of the street car system of said Eastern Texas Electric Company in the City of Beaumont. Section 3. That upon the final passage of this ordinance and its acceptance by the Eastern Texas Electric Company, that the said Eastern Texas Electric Company shall be relieved of all of the provisions of its franchise, under which said Royal Street car line has been construct- ed, maintained and operated, except that the annual franchise tax on gross receipts shall be paid to the City of Beaumont on account of the bus service so substituted for the said Royal Street car line in the same amount as obtains or may hereafter obtain for the balance of its street car system. Section 4. That the rights herein granted the Eastern Texas Electric Company to abandon the above described tracks and the operation of cars thereon will attach, when said Company shall file with the City Clerk, a statement in writing accepting the terms of this ordinance, such acceptance to be made within 10 days from date hereof. Gentlemen: Tie have your letter of May 20, which outlines a plan under which you will consider granting permission for the substitution of bus service for Royal Streetcar operation. It being our desire to cooperate fully with the Commission, to meet their wishes in the matter, we accept the program suggested. Tile appreciate the consideration which you have given this matter, which is so important to the street car and bus riding population of Beaumont, and thank you for the time and attention you have given it. In the event permission to remove these tracks is granted, you will be relieved of an expenditure of approximately $19-,000.00 on paving now under consideration for Royal Street. The City proposes' that It, will' con- sider granting p ermisslan for you to remove your car tracks on the Royal street line from Park Street to the end of said line, and to substitute an adequAte bus service therefor to be temporarily .routed as proposed by you, provided you will with reasonable dispatch remove the above mentioned tracks, regrade the streets on the unpaved portions. thereof and restore the paving on the paved portions, and pay the City the cost of shelling the unpaved portions of streets from which such tracks are re- moved, not to exceed the sum of $7000.00; and that you will re-route your bus service and adequately maintain the same along the present route of the R Royal Street czar line as soon as such route is shelled and ready for use; the fare for such bus service to be the same as obtains on the balance of your street car system.
