HomeMy WebLinkAboutORD 43-HM • + AN ORDINANCE LEVYING AND ASSESSING AS A TAX UPON THE LOTS, PARTS OF LOTS, BLOCKS, CR TRACTS OF LAND WHERE NOT DIVIDED INTO LOTS CR BLOCKS, FRONTING OR A aJTTING ON Calder Avenue fram west line of Eighth Street to west line of Eleventh Street; Liberty Avenue from west line of Tenth Street to east line of Eleventh Street; Pecos Street from west line of Guffey Street to west line of Fourth Street; TWO-THIRDS (F THE C CST OF THE PAVING, GUTTER AND INCIDENTAL DRAINAGE AND ALL THE COST OF CURBING SAID STREETS APPORTI6NABLE TO THE HEREINAFTER RE- FERRED TO PROPERTY, AND DECLARING SAID TAX A LIEN UPON SAID PROPERTY AND A PERSONAL DEBT UPON THE OWNER OR OWNERS THEREOF, AND PROVIETNG A TIME MEN SAID TAX SHALL BECOME DUE AND PAYABLE, PROVIDING FOR THE COLLECTION CP SAME AND ALL COSTS INCURRED IN COLLECTING SAME IF NOT PAID AT THE TIME IT BECOMES DUE AND PAYABLE, AND PROVIDING THE RATE CF INTEREST SAID TAX SHALL BEAR FROM THE TIME IT BECOMES DUE UNTIL PAID, AND IECLARING AN EMERGENCY. WHEREAS, pursuant to the requirements of Subdivision (h) of Section 68 of the Charter of the City of Beaumont the City Commission of the City of Beaumont caused to be published for tie time and in the manner required therefor by the City Garter, a- notice of the Resolution of said Commission, passed on the 6th day of May, A.D. 1930 ordering a hearing to be given to the persons, firms, corpoations, and estates, their agents or attorneys owning property abutting on the above named streets, and calling upon all persons interested in said matter to appear and show cause, in con- formity with the provisions of the Charter above referred to, why the assess- ment in said notice should not be made against said property and against the owners thereof", which hearing was to be held in the Council Chamber of the City Hall of Beaumont, Texas, at 9:00 o'clock A.M. on the 27th day of May, A. D. 1930; sa d, WHEREAS, a full snd fair hearing in conformity with the Charter and law in such cases having been had in conformity with said notice and the Commission having inquired into and determined all facts necessary to the adjudication of all special benefits accruing to such owners by means of such improvements, aid said hearing having been duly closed; and, It appearing that the assessment as proposed in the above mentioned Resolution passed on the 6th dqr of May, A.D. 1930, with the exceptions here- inafter noted, are in all respects fair and equitable and that there will be a full and adequate and special benefit to the abutting property and the owners thereof from and by reason of the proposed pavement and improvement in excess of the amount assessed against the abutting property and the re- spective owners thereof: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1; That there is hereby assessed against the several owners of property and against their respective property abutting on Calder Avenue from west line of Eighth Street to west line of Eleventh Street; Liberty Avenue from west line of Tenth Street to east line of Eleventh Street; and Pecos Street from west line of Guffey Street to west line of Fourth Street, as a tax two-thirds of the cost of paving, gutter, and incidental drainage of said streets, ex- clusive of the whole cost between curb lines of improving said streets at their intersections with other streets and alleys, and all the cost of curbing ma4A m+-PAAa4-n_ Section 2: The said amounts so levied and assessed shall become due and payable upon the completion of the paving upon the portion of said streets upon which said lot, lots, parts of lots, blocks, or tracts of land front and abut,, and the amount of the tax hereby levied and assessed, together with the cost of collecting and interest at seven per cent (7,%) per annum from the date same is collectible until paid is hereby declared a lien against said lot, lots, parts of lots, blocks or tracts of land superior to all other liens, claims, or titles except city, county, and state taxes, and constitute a personal charge or claim against the owner or owners of said lot, lots, parts of lots, blocks or tracts of land': Section 3: The fact that the portions of the above named streets as Indicated are in bad condition and jeopardize the safety of the people travelling thereon creates an imperative public emergency necessitating the suspension of the rule requiring ordinances to be read on three several days before their passage: Wherefore such rule is hereby suspended, and this ordinance shall be in full force and effect from and after its passage and publication; Passed by the affirmative vote of all members of the City CcmBnission� this the 27th day of May., AD, 1930: AN ORDINANCE. accepting the work of improving Liberty avenue inthe City of Beaumont, in JeffersonCounty, Texas, in front of .lots 20 and 21, in block 49, Averill addi- tion to said City; levying assessments against said property and the owners thereof for a share of the cost of making such improvement in front ofaaix said property; fixing a lien thereon to secure the payment thereof; fixing the time and terms of payment of said assessment and penalties for default; providing for ti,e issuance to the contractor making said improvement of a special assessment certificate, evidencing said obligation and lien and the time and terns of payment and pen- alties for default; and declaring an emergency, WHET=, under date of march 4th, 1930, the City Commission of the City of Beaumont Texas, ordered the improvement of Liberty avenue in said jity between the west line of Tenth street and the east line of Eleventh str. et, in the manner therein specified, pland and specifications for which were furnished to and approved by the City Commission; and after advertisement for bids, contract for making said improvements was awarded to Gulf Bitulithic Company who there- after assigned tae same with the consentof the city commission to J. E. Broussard and W.F. Warfield, who thereafter, with the consent of said City Commission as- signed the same to Broussard-Viarfield Company, a corporation; and, ;1HEfREAS, after due notice and nearing to all owners of property abut- ting said street as provided for by the charter of said 'Vity, said contractor commenced said improvement and completed the same except in front of kkw=xx lots 20 and 21 in block 49, Averill addition in said City and said improvement, except in front of said last named property has heretofore been accepted by the City as being complete; and, '�Mpy,AS, the said Brous sard-Warfi eld Company aforesaid flas recently commenced and completed the improvement theretofore ordered to be made, in front of said ots 20 and 21, in block 49 as aforesaid, in compliance with said con- tract and the plans and specificationa, to the entire satisfaction of the 'ity engineer and the City Commission& Now therefore, BE IT ORDAI:;ED BY THE CITY CO.1,11ISSION OF '.SIL CITY OF 3EAMbDNTS Section 1& That the work of improving said street aforesaid in front of lots 20 and 21, in block 49, Averill Addition, as •.aforesaid, be and the same is here now accepted as beim complete in accordance with said plans and specifications. Section 2& That there be and thereis Thereby levied and assessed against said lots 20 and 21, in block 490 Averill Addition to the City of 2eaumont, Texas, fid, "-P } ), C2 19.30 Cr from April 7th, 1931 to date of payment, at the rate of seven per cent per annum, payable annually as it accrues, as sell as costs of collection and reasonable attorneys fees, if incurred, are hereby declared to be and are hereby made a personal obligation of said real and true owners aforesaid, and a lien is hereby created on and against said property aforesaid, to secure the payment of said assessment aforesaid, vhich lien is hereby declared to be superior to all other claims or titles, liens/except liens for State, County and City taxes. Said sum of money aforesaid is hereby declared to be due and payable April 7th, 1931, and if not paid when due.. shall -bear inte rest from said date until paid at the rate of 7% per annum, payable annually as it accrues. Said assessment is hereby made payable to Broussard-Warfield Company, a corporation, or its assigns.If default shall be made in the payment of said obligation when due, then at the option of said contractor or its assigns, the fullamount thereof together with accrued interest, costs and reasonable expenses for collecting the same, including reasonable attorneys fees, when incurred, shall be collectible. Section 3s That to evidence said obligation and lien, the time and terms of payment, penalties for default, the 11ayor and City Clerk are hereby authorised and directed to issue a special as essment certificate payable to the said Brous sard-Warfield Company, a corporation, or its assigns stating the amount of said assess�aent; the names of the oc.ners as above set forth; a description of said property as aforesaid; the rate of interest; provision as to default, costs of collection and reasonable attorneys f see; shall state the date of the original contract and the date of completion and acceptance of said work; and shall farther recite that "all proceedings had by said City with reference to making said improvements have been regularly had in compliance with the charter of said amity and all laws applicable thereto; and, all prerequisites to the fixing of the lien and claim of personal liability, evidenced by this certificate, have been performed".
