HomeMy WebLinkAboutORD 40-Ha I AN ORDINANCE -H r a AUTHORIZING THE VACATING AND CLOSING OF THE ALLEY LOCATED IN BLOCK No: 2 OF THE LANDHAM ADDITION TO THE CITY OF BEAUMONT, TEXAS WHEREAS, a petition duly signed by A. M. Kaufman, acting for Kaufman Investment Company, W. F. Palique, F. B. Palique, M. R. Dutton sad Benjamin Greenberg,, owners of all the property in Block No; 2 of the Langham 9ddition to the City of Beaumont, has been presented to this -City Commission of the City of Beaumont requesting that such alley be closed and vacated: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT : That the alley located in Block No: 2 of the Langham Addition to the City of Beaumont be, and the same is hereby authorized to be vacated and closed, and that the title to such alley shall revert to and become the property of the respective owners of the lard in said blocks bordering on said alley, as provided by law; provided, however, that the closing of this alley shall in no way affect the rights of the City as to placing and maintaining therein of any sewer or water lines, or any other service or utility of the City, all of which rights are hereby re served; Passed this the 3rd day of June, A.D. 1930; AUMRIZINQ THE VACATING AND CLOSING OF M ALLEY LOCATED IN BLOCK No. 2 OF THE LAMAM ADDITION TO TO CITY OF BEAWNT, TEXAS. Fletoher Mwor TO THE HONORABLE 129MT FLETCHER, MAYOR, and the HONORABLE CITY COMMISSIONERS OF THE CITY OF BEAMIGNT, TEXAS: We, the undersigned, being all of the owners of all of the property located in Block Bo. 2 of the Langham Addition to the City of Beaumont, Texas, the following, to -wit: Kaufman investment Company, being the owner of Lots No's 11 and 12, W. Y. and F. B. Palique, being the owners of Lots No's 13, 14 and 15, ,/ f 'Benjamin Greenberg, being the owner of Lots No's 16, 17 and 18,_ M. H, Dutton, ,being the owner of lots Boo's 19 and 20, hereby respectfully petition your tionorable Body that that portion of the ten foot alley lying between Lots No's 11, 12 .and 13, on the lvorth, and Lots No's 1.6, 17 and 18, on the South, all in Block Ivo. 2 of the Langham Addition to Beaumont, Texas, being the East 180 Feet of said alley, running from the Uest line of Park Street, Wert 180 Feet, be closed in the manner permitted by the statutes of the State of Texas, and that said portion of said alley become the absolute property of the owners of the land in said block adjacent to and abutting on that portion of the alley; it being understood, however, that the closing of that portion of the alley, shall in no way affect the rights of the City of Beaumont as to placing and maintaining therein any sewer or water lines, or any other services or utility of the City of Beaumont, and shall in no way affect the West 120 Feet of said alley, but said 120 Feet shall remain open, as heretofore. Your petitioners would further show to this Honorable Body that the portion of said alley herein petitioned to be closed, has never been used as a passage- way and has grown up in weeds and underbrush, and is both unsightly and unsanitary; that the closing of said alley will not affect the rights of anyone other than the peti- tioners whose names are signed hereto.
