HomeMy WebLinkAboutORD 68-G3 5"" � 1 AN ORDINANCE E ENTITLED AN ORDINANCE PROVIDING FOR THE INSPECTION AND APPROVAL UIM R THE DIRECTION OF THE HEALTH DEPAR9MIENT OF THE CITY OF ]EAUMONT OF THE I!EAT OR FOOD PRODUCTS OF A PTY CATTLE, CALVES, SHEEP, SWINE OR GOATS SOLD, KEPT FOR SALE, OFFERED FOR SALE, OR IN POSSESSION WITH INTENT TO SELL WITHIN THE CITY LI11ITS OF BEIL1 1ONT FOR HUMAN C ONSUI,1PT ION BY ANY PERSON, FIRM OR C ORPO T T ION, REPELIL ING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HERE1 ITH INSOFAR AS IN CONFLICT AND NO FURTHER, PROVIDING THAT THE HOLDING OF ANY SECTION OR SUBSECTION OF THIS ORDINANCE TO BE INVALID SHALL NCT AFFECT ANY OTHER SECTION OR SUBSIJCT ION BUT THAT THE SAP?E SILILL REI,AIN IN FULL FORCE AND EFFECT, PROVIDING A PENALTY FOR THE VIOLATION OF ANY OF THE TERMS HEREOF, AND DECLiRING AN ETE;RGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUI;IONT : Section 1. No person shall bring within the city limits of the City of Beaumont, or offer or expose for sale or sell within said city any sick or diseased animal commonly used for food purposes, or any part of the flesh thereof of any animal which when killed was sick or diseased, or that died a natural or accidental death. Section 2. It shall be unlawful for any person, firm or corporation to have, keep, sell or expose for sale, or to have in possession with intent to sell for human food within the city limits of Beau- mont the meat or food products manufactured in whole or in -part from the meat of any cattle, calves, sheep, swine or goats, unless the same stall have been slaughtered and inspected under the supervision of the Health Department of the City of Beaumont, in accordance with the provisions of this ordinance; provided, however, that this ordinance shall not apply to the meat or food products manufactured from the meat of cattle, calves, sheep, swine or goats.salughtered or inspected under the supervision of the United States Gove_.°nment in accordance with the regulations relating to the inspection of meat as prescribed by the Department of Agriculture of the United States and bearing the stamp of such inspector. Section 3. It shall be unlawful for any person, firm or corpor.tion to sell, have, keep or expose for sale or to have in possession with —; intent to sell for human food within the city limits of Beaumont, the meat or any portion thereof of any cattle, calves, sheep, swine or goats unless there shall have been placed on each primal part thereog or by or under the personal supervision of an inspector of the United States, or of the City of Beaumont, a mark, stamp or brand showing that the same has been inspected and passed for food purposes. Section 4. Live inspection and post mortem inspection must be had and obtained by the inspectors for the City of Beaumont, State of Texas, or the United States Government as provided for in Section 3 hereof, and no meat or meat products from any such cattle, calves, sheep, swine or goats shall be kept, offered, exposed or had for sale in the corporate limits of the City of Beaumont unless and until so inspected and stamped as hereinbefore provided for. Section 5. It shall be the duty of the inspectors of the Health Department, and they are hereby empowered to enter any place where the meat or flesh of any animal mentioned in this ordinance, or the products thereof may be stored, held, le pt, exposed or offered for sale, and also every establishment where meat is manufactured into articles of food or preserved, cured, canned or otherwise prepared for food and inspect the same and whenever such meat or flesh shall, upon inspection and examination, be found not marked, stamped or branded so as to show that the same has been inspected and passed for food purposes as in this ordinance provided, the inspectors of the Health Department shall condemn the same and shall order such disposal as will prevent E its. use as human food. Section 6. It shall be unlawful for any person or persons to transport or cause to be transported in any vehicle through the streets or public ways of the City of Beaumont any meat unless the same is securely wrapped in paper or tightly woven cloth covering, or unless such vehicle is provided with a tight cover which shall -2- be kept closed at all times during such transportation, so as not to expose the meat to dust, dirt, filth or other deleterious sub- stances. Section 7. It shall be the duty of the City Mamager of the City of Beaumont to appoint a veterinarian, vh o shall be a graduate of a reputable veterinary school and who skull be duly licensed to practice veterinary medicine and -surgery in the State of Texas, who shall under the direction of the Health Officer of the City of Be=- mont, have charge of the inspection as may be necessary for tke carrying out of the provisions of this ordinance, said veterinar ian shall be governed by the methods used by the United States Depart- ment of Agriculture, Bureau of Animal Industry, the Health Ordinances of the City of Beaumont, and the Sanitary Code of the State of Texas, in making the necessary inspection. Section 8. It shall be unlawful for any person, firm or corpor�,t ion except inspectors of the Health Department of. the City of Beaumont, to have in possession, keep or use any mark, stamp or brand provided or used for marking, stamping or branding as inspected and passed any article herein required to be so marked, stamped, or branded, or any mark, stamp or brand having thereon a device or words similar in character or import to the marks, stamps or brands provided or used for such purposes by the Health Department of the City of Beaumont. Section 9. The holding or adjudication of any Section or Subdivision of any Section of this ordinance to be invalid shall not affect the validity of any other section or subdivision of a section, but all other sections and subdivisions of sections shall be and remain in full force and effect. Section 10. All ordinances and parts of ordinances conflicting with this ordinance shall be, and the same are hereby repealed insofar as in conflict and no further. 1 -3- Section 11. Any person, persons, firm or corporation violating aly of the provisions of this o rdi nance shall be guilty cf a misdemeanor and upon conviction thereof shall be fined in arty sum not less that �vienty-five (; 25.00) Dollars, nor more than Two Hundred (:,x;200.00 ) Dollars, and each and every day's and parts of day's violation of this ordinance shall constitute a separ,,A a offense. Section 12. The fact that the City of Beaumont at this time has no adequate ordinance regulating the inspection and a�)proval of meat and meat products offered and exposed for sale in the city limits, creates a dangerous condition and a menace to life, endangerilE public peace, health and safety in the City of Beaumont, creating an imperative public emergency, necessitating the suspension of the rule requiring ordinances to be read on three separate days b§7,fnre final passage, wherefore such rule is hereby suspended and this ordinance shall be in full force and effect from and after its passage.
