HomeMy WebLinkAboutORD 60-GAN ORDINANCE Authorizing the vacating and closing of Threadneedle Street from its intersection with Avenue A (nee Irvie Avenue) to its intersection with Pear Orchard Avenue; also that portion of the alley running through Blocks One (1) and Two (2) of the Pear Orchard Addition beginning at the S.E. corner of Lot One (1) Block One (1) and the N.W. of Lot Ten (10 ) Block One (1) of said Addition running west to the intersection of said alley with Pear Orchard Avenue, and the alley in Block Three (3) from Avenue A to Pear Orchard Avenue to the City of Beaumont, and reserving to the City of Beaumont the right to place and maintain water mains, sewer mains and other public utilities thereover. VMREAS, a petition duly signed by C.B. Shepard and R.L. Stuart, owners of property abutting on Threadneedle Street from its intersection with Ave me A (nee Irvie Avenue) to its intersection with Pear Orchard Avenue; alsD that portion of the alley running through Blocks One (1) and Two (2) of the Pear Orchard Addition beginning at the S.E. corner of Lot One (1) Block One (1) and the N.W. of Lot Ten (10) Block One (1) of said Addition running West to the intersection of said alley with Pear Orchard Avenue, and the alley in Block Three (3) from Avenue A to Pear Orchard Avenue has been presented to the City Commission of the City of Beaumont requesting that such street and alleys be closed and vacated. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COa1:"'ISSION OF THE CITY OF BEAUMONT: Section 1. That Threadneedle Street from its intersection with Avenue A (nee Irvie Avenue) to its intersection with Pear Orchard Avenue; also that portion of the alley running through Blocks one (1) and Two (2) of the Pear Orchard Addition beginning at the S.E. corner of Lot One (1) Block One (1) and the N.W. of Lot Ten (10) Block One (1) of said Addition running West to the intersection of said alley with Pear Orchard Avenue, and the alley in Block Three (3) from Avenue A to Pear Orchard Avenue to the City of Beaumont be, and the same is, hereby, authorized to be vacated and closed, and that the title to such property shall revert to and become the property of the respective owners of the land in said blocks bordering on said property, as provided by law; provided, however, that the closing of this property shall in no way affect the rights of the City 1. to place and maintain therein any sewer or water lines, or any other service or utility of the City, all of which rights are hereby reserved, and if the City shall be put to added expense in putting any of its utilities ov®r or. unser said streets or alleys so closed and vacated, the said R.Z. Stuart, his heirs and assigns agree by the acceptance hereof to pay such added expense. Section 11. This ordinance shall not be effective unless said R.Z. Stuart shall file with the City Clerk his acceptance hereof in writing within thirty days after its :final passage.
