Entitled an Ordinance requiring any person, firm or cor-
poration now engaged in, or that may hereafter become engaged
in the business of contracting of making, constructing and lay-
ing of cement side -walks in the City of Beaumont, Texas, to
construct said side walks and to execute a bond payable to
the said City in the sum of TWO THOUSAND DOLLARS ($2,000.00)
in accordance with the conditions herein contained, declaring
the violation of any of the provisions of this Ordinance to be
a misdemeanor and providing a penalty for the violation of same.
BE IT ORDAINED BY THE CITY COT1lllIISSION OF THE
CITY OF BEAUMO NT :
Section 1.
That any person, firm or corporation now engaged in,, or
that hereafter may become engaged in the business of contract-
ing of making, constructing and laying cement side -walks in
the City ---of Beaumo--nt-,--Texas,-- be -a-nd—the- same are-- her-eby-re-
quired to execute a good and sufficient bond in the sum
of TWO THOUSAND DOLLARS ($2,000.00), payable to the City
of Beaumont and conditioned that any person or persons hav-
ing any cause of action secured by said Bonds are hereby
authorized to sue on such bond without impleading the City,
and that said Bond shall not be exhausted by the first re-
covery, but shall be subject to successive recoveries for
damages ac -curing to any person or persons by reason of any
defective or faulty material used therein, or by reason of
any defective or faulty workmanship thereon; conditioned
further that any said person, firm or corporation contract-
ing for the construction and laying of any cement side -walk
in the City of Beaumont will construct and -'lay said side-
walk according to plans and specifications to be furnished
by the City Engineer of the City of Beaumont, Texas, or

such plans and specifications as may be hereafter prescribed
and adopted by the City Commission of the City of Beaumont, and
that the said person, firm or corporation contracting to con-
struct and lay any cement side -walk in the City of Beaumont,
Texas, will keep and maintain said cement side -walk when so
constructed or laid for a period of three years, free of any
cost or charge to the o;-iner thereof caused by reason of any
defective or faulty material used therein, or by reason of
any defective or faulty workmanship thereon, or in the event
that said cement side -walk as made, constructed and laid shall
fail to comply -.with the specifications as herein provided.
Section 2.
Said Bond herein provided for shall be approved by the
City Manager of the City of Beaumont, Texas, and deposited with
the City Clerk before any such person, firm or corporation shall
engage in the business of making, constructing and laying cement
side -walk in the City of Beaumont.
Section 3.
Any person, firm or corporation now engaged or becoming en-
gaged in the. business of contracting of making, building and con-
structing cement side -walks in the City of Beaumont, without hav-
ing first procurred and deposited the said Bond as herein provid-
ed for shall be deemed guilty of a misdemeanor and upon convic-
tion in the Corporation Court of the City of Beaumont, Texas,
shall be fined in any sum not exceeding :200.00 and each and
every days violation of this Ordinance shall constitute a
separate offence,
Section 4.
It is further ordained herein that the owner or agent of
the abutting property on which said cement side -walk has been
made, constructed and laid, shall have the option of with -hold-
ing the payment for the making, constructirg and laying of
same until the said contractor shall Dresent a certificate from
the City Engineer, approving the making, constructing and laying

Section 5.
This Ordinance shall take effect and be in force from and-
after
ndafter it's passage, approval and publication.
