HomeMy WebLinkAboutORD 37-G6/ AN ORDINANCE AUTHORIZING AND DIRECTING THE PROPER OFFICERS OF THE CITY OF BEAUMONT NAMED HEREIN TO FORTHWITH PREPARE AND EXECUTE AND TO NEGOTIATE AND DELIVER, FROM TIME TO TIME AS NECESSITIES REQUIRE, LEGAL AND -BINDING OB- LIGATIONS OF THE CITY OF BEAUMONT, IN THE FORM OF DE- FICIENCY WARRANTS., DESCRIBED IN SAID ORIa MANCE, FOR THE PURPO SE*OF DEFRAYING THE CURRENT EXPENSE FOR THE MAINTENANCE AND OPERATION OF THE SEVERAL DEPARTMENTS OF THE GOVERNMENT MENTIONED IN SAID ORDINANCE., AP- PROPRIATING AN EQUAL PCE TION (F THE REVENUES OF THE CITY OF BEAUMONT APPORTIONABLE TO THE SEVERAL DEPART- MENTS AFFECTED, FOR THEYEAR 1928, FOR THE PAYHENT AND 11 SCHARGE OF SAID -WARRANTS; AND DECLARING AN EMERGENCY. WHEREAS, the City of Beaumont, pending the collection of current tax revenues, from all sources, being taxes for the year 1928, is without funds wherewith to pay its current obliga- tions incurred and to be incurred for the operation'of the several departments of the government, mA in order to acquire funds where- with to defray the current expense of all departments of the government pending the collection,ofsaid revenues, it is necessary that the City of Beaumont borrow money upon the faith and credit~; of said Cit�r, and to anticipate and pledge an equal portion(a the current tax,,revenues of the City for the year 1928: BE IT ORDAINED BY THE CITY COI&ISSION OF THE CITY OF BEAUMONT: Section 1 That E, W. Gross, Mayor of the Sity of Beaumont, be and he is hereby authorized to forthwith prepare, or have prepared,! and to execute, tggether with the City Clerk, and to be counter- signed by the City 'Manager, legal and binding obligations of the City of Beaumont, in the form of and evidenced by Deficiency Warrants dated on the date or dates when negotiated, and deliver- ed from time to time as hereinafter provided, payable to, «EEARERT on demand, bearing not more than 6% interest from their date until paid, which said warrants shall be and are hereby secured by the legal and binding pledges and hypothecation of ONE HUNDRED AND THIRTEEN THOUSAND DOLLARS ($113,000:00) of the current tax re- venues of the City of Beaumont, for the year 1928, as applied to the funds of the particular departments and in the amounts relating to such departments as hereinafter set forth; the said Deficiency Warrants to be paid and retired out of the first tax revenues collected for the year 1928 for the operation of and application to the several departments of the City government, as hereinafter set forth. The said warrants shall be executed, negotiated and delivered as and when it is requisite and necessary to raise money for the payment of existing obligations, and for defraying the our - fent expenses for the operation of the several departments of the government, as hereinafter set forth, until such time as there shall have been collected sufficient moneys from the source above mentioned wherewith to pay off, discharge and retire such warrants together with accrued interest thereon. And there is here and mw appropriated and set aside out of the first moneys so to be collected above mentioned and appor- tioned among the several departments a -s bblow shown, a sum suf- ficient wherewith to'pay off and discharge all of such deficiency warrants as may be so issued and negotiated to the then owners snd holders thereof; provided, however, the total amount of such warrants of this issue shall not exceed the sum of ONE HUNDRED THIRTEEN THOUSAND D0 LLARS ($113.9000;00)011 The said Deficiency Warrants shall be in the following form, to wit: #The State of Texas, Beaumont, Texas County of Jefferson. x192` On Demand, pay to the order of "BEARER" To the Director of Finance City of Beaumont COUNTERSIGNED: CITY MANAGER DOLLARS MAYO R ATTEST: GI„TY CLERK This Warrant is one of a series of several Warrants authorized by the Cit -9 Commission of the City of Beaumont, by Ordinance duly passed , 19282`A.D., and is payable out of the tax levied for the year 1928, and chargeable to the particular fund or department to which it applies when collected; d, This Warrant bears interest at the rate of not more than six per cent per annum fro m its date until paid; Each Warrant shall carry on its face the name of the depart- ment to which it relates. Whereas, The City of Beaumont, pend- ing the collection of current tax reve- nues, from all sources, being taxes for the year 1928, is without funds wherewith to pay its current obligations incurred and to be incurred for the operation of the several departments of the government, and in order to acquire funds wherewith to defray the current expense of all de- parkments of the government pending the collection of said revenues, it is necessary that the City of Beaumont porrow money upon the faith and credit of said city, and to anticipate and pledge an equal por- tion of the current tax revenues of the city for the year 1928. --Be it ordained -by the City Commission of the City of Beaumont: Section 1, That - E, W. Gross, Mayor of the City of Beau- mont, be and he is hereby authorized to forthwith prepare, or have prepared, and to execute together with the City Clerk, and to be countersigned by .the City Man ager, legal and binding obligations of the City of Beaumont, in the form of and evi- denced by Deficiency Warrants dated on the date or dates, when negotiated, and delivered from time to time as herein- after provided, payable to "Bearer" on demand, bearing not more than 6 per cent interest from their date until paid, which" said warrants shall be and are hereby secured by the legal and binding pledges and hypothecation of Sixty-two Thousand Dollars ($62,000.00) of the current tax revenues of the City of Beaumont, for the year 1928, as applied to the funds of the particular departments and in the amounts relating to such departments as herein- after set forth; the said Deficiency War- rants to be paid and retired out of the first tax revenues collected for the year 1928 for the operation of and application to the several departments of the City government, as hereinafter set forth. The said warrants shall be executed, ne- gotiated and delivered as and when it is requisite and necessary to raise money for the, payment of existing obligations, and for defraying the current expenses for the operation of the several depart- ments of the government, as hereinafter set forth, until such time as there shall have been collected sufficient moneys from the source above mentioned wherewith to r pay off, discharge and retire such war- rants, together with accrued Interest - thereon. And there is here and now ap- propriated and set aside out'of the first money so to be collected above mentioned and apportioned among the several de- partments as below_ shown, a sum suffi- cient wherewith to pay off and discharge all of such deficiency warrants as may be so issued and negotiated to the then owners and holders, thereof; provided, however, the total amount of such war- rants of this issue shall not exceed the sum of Sixty-two Thousand ($62,000.00) Dollars.
