Home My WebLink AboutORD 31-G1 AN ORDINANCE ORDERING AN ELECTION WITHIN AND FOR THE CITY OF BEAUMONT TO BE HELD ON TUESDAY, JUNE 51 1928, FOR THE PURPOSE OF SUB- MITTING AT SAID ELECTION THE QUESTION, "SHALL A COMMISSION BE CHOSEN TO FRAME A NEW CHARTER"; PROVIDING FOR THE ELECTION FROM THE CITY AT LARGE OF A CHARTER C OPdIivjISSION OF FIFTEEN MEMBERS TO DRAFT A CHARTER FOR THE CITY OF BEAUMONT, PROVIDED THAT A MAJORITY OF THE QUALIFIED VOTERS VOTING ON THE ABOVE QUESTION SHALL.HAVE VOTED IN THE AFFIRMATIVE; NAMING THE PLACES AT VaJICH SAID ELECTION SHALL BE IIELD; AND PROVIDING TRA.T SAID ELECTION SHALL BE HELD UNDER TEE GENERAL ELECTION LA'VV'S OF THE STATE OF TEXAS. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1 That in accordance with Chapter 13 of Titl6 28 of the Revised Civil Statutes of Texas of 1925, and the general laws of the State of Texas relating thereto, there shall be held in the City of Beau- mont on Tuesday, June 5, 1928,.an election for the purpose of sub- mitting at said election the ques•t,ion: tPShall a commission be chosen to frame a new Charter?" Section 2 Said election shall be held in the City of Beaumont at the following places, to wit: In the First Ward at the Central Fire Station, French School Building, the Gladys Street Fire Station, and the Averill School Building; In the Second Ward at the City Hall, Wiess Park, and the College Street Fire Station; In the Third }Hard at the Jefferson County Court House, Sabine Pass Avenue Fire Station, South Park Elementary School Building, the Ogden School Building, and the Hebert Colored School Building, Section 3 The following named persons are appointed -presiding j�dges of their respective voting boxes in said v:ards with the authority to select and appoint their own clerks: At the Central Fire Station, C. A. Ganoung; At the French School Building, R. E. Woodh.am; At the Gladys Street F-\'re Station, George Morgan; At the City Hall, S. E. \Bipham; At the Jefferson County Court House, John 0. Section 4 That said election_ shall be held under, and the qualifications of those voting thereat shall be controlled by, the provisions of the State Laws governing elections. Section 5 There shall be printed on the ballot, "Shall a Commission be chosen to frame a new Charter?" And thereunder shall be printed - two lines., "For Choosing a Commission to frame a new Charterand, "Against choosing a Commission to frema a new Cha rter", and those desiring to vote for, -the choosing of -a-commission to frame: anew_ - Charter shall run a line through'or across the words, "Against the choosing of a Commission etc.", and those desiring to vote against the choosing of a commission to frame,a new charter shall -run a line through or across the words, "For the choosing of a Commission etc.". And in addition thereto there shall be printed on the ballot the names of the candidates for a place om said commission to frame a hew Charter qualified to participate,in said election who have complied with the provisions of. Section 6 hereof. Section 6 Any person desiring his name to appear on said ballot as a - candidate for a place on said Commission to frame a new Charter shall file with the City Clerk of the City of Beaumont not later than April 28, 1928, a written request for his name to be printed on sttch official ballot as a candidate for a place on said commission to frame a new Charter, giving his occupation and Post Office ad- dress, giving btreet and number of his residence, and such request shall be filed and acknowledged by him before some officer author- ized to take acknowledgments to deeds. Such request filed and ac- knowledged by twenty-five qualified foters of the City of Beaumont r r_ '0- . may be filed on or before said date' requesting that the name of any.person named therein may be placed on said official ballot as a candidate for a place on said commission to frame a new Charter with like effect as if such request were;filed`by the person named as a,candidate therein, which request shall be endorsed by the � candidate named therein following his consent to -serve on said com- mission if elected. 0 Section 7 The City Clerk of the City -"of Beaumont shall place on said official ballot the names of all parties who are qualified under Section 6 hereof to have their names printed on said ballot as can- didates. The order of the names on the ballot shall be determined by placing the names of those who are qualified to appear thereon in a hat and the clerk shall draw from said hat the names placed therein, and in the order in which said names are drawn they shall be placed on the ballot. Section 8 The fifteen candidates on said ballot who receive the highest number of votes shall be declared elected to said commission to frame a new Charter; provided a majority of the qualified voters voting at said election shall vote in favor of"the proposition,of choosing a commission to frame a new Charter. Section 9 A copy of this ordinance signed by the Mayor I of the City of Beau- mont and attested by the City Clerk thereof shall serve as proper ands' sufficient notice of said election, and the Mayor is hereby directed to cause a copy of this ordinance, signed -by himself and attested by the City Clerk,,to be posted at each of the places herein designated for holding xaid election at least thirty days -prior to the date of holding said election, and said ordinance shall be published in a newspaper published in the City of Beaumont at -least thirty days prior to the date of holding said election.
