HomeMy WebLinkAboutORD 11-GUC? y N '-30 5: ,t AN ORDINANCE ORDERING THE GENERAL"MUNICIPAL ELECTION FOR THE CITY OF BEAUMONT FOR THE YEAR 1928, AS PROVIDED BY THE CHARTER OF THE CITY OF BEAUMONT, ON THE DATE AND AT THE PLACESSET FORTH IN SAID ORDINANCE FOR THE PURPOSE OF ELECTING A MAYOR AND NINE COUNCILMEN AS DESIGNATED IN SAID ORDINANCE; NAMING THE PLACES AT WHICH SAID ELECTION SHALL BE HELD; AND FURTHER PROVIDING FOR A REFERENDUM VOTE AS PROVIDED IN SUBSECTION FOUR OF SECTION NINETEEN OF THE CHARTER OF THE CITY OF BEAUMONT'ON-THAT CERTAIN ORDINANCE ENTITLED, "AN ORDINANCE GRANTING TO THE BEAUMONT WHARF AND TERMINAL COMV ANY; ITS SUCCESSORS AND ASSIGNS, FOR THE PERIOD ENDING MARCH 23, 1947, THE RIGHT AND PRIVILEGE TO CONSTRUCT AND LAY A TRACK AND OPERATE ITS TRAINS AND CARS THEREON AND TO BE USED AS A MAIN LINE TRACK IN LEADING TO AND FROM THE WHARF AND VARIOUS INDUSTRIES LOCATED IN THE CITY OF BEAUMONT, BEGINNING AT THE PRESENT G. B. & K. C. TRACK ON RAILROAD AVENUE IN BEAUMONT, TEXAS, AT THE SOUTH LINE OF FANNIN STREET AND RUNNING IN A SOUTH- WARD DIRECTION ON A SEVEN -DEGREE THIRTY -MINUTE REVERSE CURVE 199 FEET TO A POINT WHICH IS 13 FEET WESTWARD AT RIGHT ANGLES FROM THE CENTER LINE OF THE K. C. S. MAIN LINE SPUR ON RAILROAD AVENUE, THENCE TANGENT IN A SOUTHWARD DIRECTION PARALLEL TO SAID K. C. S. MAIN SPUR 644 FEET, 'THENCE ON A SEVEN -DEGREE THIRTY-MINUTEsCURVE TO THE LEFT 112 FEET, THENCE TANGENT 60 FEET TO PRESENT B. W. & T. TRACK ON RAILROAD AVENUE AT -THE NORTH LINE OF COLLEGE'STREET, IN ALL.1015 FEET, MORE O'k- LESS IN THE CITY OF BEAUMONT, AND PRESCRIB- ING -THE CONDITIONS THEREOF; AND PROVIDING THAT - SAID ORDINANCE SHALL BE PRINTED ON THE BALLOT AT SAID ELECTION; AND THAT THERE SHALL ALSO BE PRINTED ON SAID BALLOT THE WORDS, " FOR THE GRANTING OF THE'FRANCHISE" AND THE WORDS, "AGAINST THE GRANTING (F THE FRAN- CHISE"; NND THOSE DESIRING TO VOTE FOR THE GRANTING (F THE FRANCHISE SHALL RUN A LINE THROUGH OR ACROSS'THE WORDS, "AGAINST THE GRANTING OF THE FRANCHISE", AND THOSE DESIRING TO VOTE AGAINST THE GRANTING OF THE FRANCHISE SHALL RUN A LINE THROUGH CR ACROSS THE WORDS, "FOR THE GRANTING OF -THE FRANCHISE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: Section 1. That in accordance with'Section 26, Subsection 4, of the Charter of the City of Beaumont and other provisions of said Charter, and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the first Tuesday in April, 1928, the same being the 3rd day of April, A.D. 1928, a regular municipal election for said city for the purpose of electing a mayor and for the purpose of electing three councilmen for the First Ward, three councilmen for the Second Ward, .and three councilmen for the Third Ward in said city. Section 2'. That said election shall be held in the City of Beaumont in the following places, to wit: In the First Ward at the Central Fire Station, French School Building and Gladys Street Fire Station. In the Second Ward at the City Hall. In the Third Ward at the Jefferson County Court House,\ Sabine Pass Fire Station, and the South Park Elementary School Building. Section 3. The following named persons are appointed presiding judges of their respective voting boxes in said wards, with the authority to select and appoint their own clerks. At the Central Fire Station, C. That said election shall be held under, and the qualifications of those voting thereat shall -be controlled by, the provisions of the State Laws governing elections. Section 5. There shall be printed on the ballot in addition to the names of the candidates who are qualified to participate in the election a copy of that certain ordinance entitled, "An ordinance granting to the Beaumont Wharf and Terminal Company, its successors and assigns, for the period ending March 23, 1947, the right and pri- vilege to construct and lay a track and operate its trains and cars thereon and to be used as a main line track in leading to and from the Wharf and various industries located in the City of Beaumont, beginning at the present G. B. & K. C. track on Railroad Avenue in Beaumont, Texas, at the south line of Fannin Street and running in a southward direction on a seven -degree thirty -minute -reverse cur 199 feet to a point which is 13 feet westward at right angles from the center line -of the K. C. S. main line spur on Railroad Avenue, thence tangent in a southward direction parallel to said K. C. S. main spur 644 feet, thence on a seven -degree thirty - .minute curve to the left 112 feet, thence tangent 60 feet to present -2- B. W. & T.-track on Railroad Avenue at the north. line .of .College Street, in all . 1015 feet, more, or less, in the City of Beaumont, and prea.cribing the conditions thereof." Passed by the City Com-m mission of the City of Beaumont on the 25t]i day of October, A.D. 19271 and there shall be printed on said ballot the words, "For the Granting cif' the Franchise", and the words, "Against the Granting of the Franchise"; and those desiring to vote at said election for the granting of the franchise shall run a line through or across the words, "Against the.Granting of -the Franchise" and those desiring to vote at said election against the granting of the franchise shall run a line through or across the words, "For the Granting of the Franchise." Section 6. That a copy of this ordinance signed by the mayor of the City of Beaumont, and attested by the City Clerk thereof shall serve as proper and sufficient notice of said election; and the mayor is hereby directed to cause a copy of this ordinance, signed by himself and attested by the City Clerk, to be posted at each of the places herein designated for holding said election at least thirty days prior to the date of -holding said election. -Section 7. That an ordinance has not yet been passed providing for and ordering a general municipal election for the year 1928 and that such ordinance is necessary, thereby creating an imperative public emergency necessitating the ,suspension of the rule requiring ..ordinances to be read on three. separate days before their -passage; wherefore, said rule is hereby suspended and this ordinance shall take effect from and after its passage and the signature of therfmayor.
