HomeMy WebLinkAboutORD 3-Ga sr AN ORDINANCE ENTITLED AN (R DI IdANCE LEVYING AND ASSESSING AS A TAX UPON THE LOTS, PARTS OF LOTS, BLOCKS OR TRACTS OF LAND VYI-ME NOT DIVIDED INTO LOTS OR BLOCKS FRONTING CR ABUTTING ON FMA1%U=_ T.Ru ^1 FROM FIVE FEET EAST OF THE CENTER LINNE OF THE MAIN TRACK OF THE DALLAS-SABINE BIIA'TCH -OF THE TEXAS AND NEW OULEANS RAILROAD COMPANY TO THE I'dEST LINE OF THE RIGHT-OF-WAY OF SAID DALLAS-SABINE BRANCH, TVIIO-THIRDS OF THE COST OF THE PAVING., GUTTER, AND INCIDENTAL DRAINAGE AND ALL THE COST OF CURB- ING SAID STREET APPORTIOIXABI ' TO THE HEREINAFTER REFERRED TO PROPERTY; - DECLARING SAID TAX A LIEN, UPON SAID PROPERTY A2,TD A P RSONAL DEBT UPal THE OIENER OR 0'PMERS TIIEREOF; PROVIDING A TIPrE I1IHEN St'?ID TAX SHALL BECOME DUE AND PAYABLE; PROVIDING FOR THE COLLECTINT OF SAKE AND ALL COSTS INCURRED IN COLLECTING SAI,9E, IF NOT PAID AT THE TI ,E IT BECOMES DUE AND PAYABLE; PROVIDING TILE RATE OF INTEREST SAID TAX SN4LL BEAR FROM THE TIT'!E IT BECOMES DUE UNTIL PAID; AND DECLARING AN EMERGENCY. ifiHEREAS, pursuant to the requirements of Subdivision (h) of Section 68 of the Charter of the City of Beaumont, the City Commission of the City of Beaumont caused to be published for the time in the manner required therefor by the City Charter a notice of the Resolution of said Commission passed on the 24th day of January, A.D. 1928, order- ing a hearing to be given to the persons, firms, corporations. and es- tates, their agents or attorneys owning property abutting,on Franklin Street from five feet east of the center line of the main track of the Dallas -Sabine branch of the Texas and New Orleans Rai lEoad Company to the west aide line of the right-of-way of said Dallas -Sabine branch, and calling upon all persons interested in said matter to appear and show cause, in conformity with the provisions of the Charter above re- ferred to, why the assessment in said notice°should not be made against said property and against the owners thereof; which hearing was to be held in the Council Chamber of the City Hall of Beaumont; Texas, at four o°clock P.M. on the 14th day of February, A.D. 1928; and, WHEREAS, a full and'Pair hearing in conformity with the Charter and law in such cases 'raving been had in conformity with said notice, and the -Conunission having inquired into and determined all facts ne- cessary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; and, It appearing that the assessment as proposed in the above mentioned Resolution passed on the 24th day of January, A.D. 1928, with the ex- ceptions. hereinafter noted, are'in all respects fair and egzitable and that there will be full and adequate and special benefit to the abutting property and the owners thereof from and -by reason of the proposed pave- ment and improvement in excess of the amount assessed against the abutting property and the respective"owners thereof: NOW5 THEREFORE, BE IT ORDAINED BY THE CITY C OMMISSI-CiV -OF THE CITY OF BEAUM( T: Section 1 That there is hereby assessed against the several owners of pro- perty and against their respective property abutting on Franklin Street from five feet bast of the centerline of the main track of the Dallas - Sabine branch of the T. & N. 0. Ry. Co. to the west line of the right-of- way of said Dallas -Sabine branch, as a tax two-thirds of the cost of paving gutter, and incidental drainage of said street, exclusive of the whole cost between curb lines of improving said street at its intersection with other streets -m d alleys, and all cost of curbing said street. The lot, lots, parts of lots, blocks, or tracts of land on which said tax is levied and assessed .are hereinafter described, together with the number of front feet on such lot, lots, parts of lots, or blocks or tracts of land; the name or names of the owner or owners thereof, and the proportionate amount of the cost of said paving and gutter, and the cost of said curbing to be borne -and paid for by such owner or owners as shown byf'the statement prepared by the City Engineer of the City of Beaumont, which said amount is hereby levied and assessed as a tax upon such lot, lots, -,parts of lots, blocks, or tracts of land as, s"fr&&, to wit: y Section 2. That said amounts so levied and assessed shall become due and payable upon the completion of the - paving upon the, por tion of said street upon.which said lot, lots, pparts of lots, blocks, or tracts of land front and. abut, and the amount of the tax hereby levied and assessed, together with the cost of collecting and interest at seven per cent per an.num from the date same is collectable until paid is hereby declared a lien against said -lot, lots, parts of lots, blocks, or tracts"of land superior to all other liens, claims, or titles, ex- gept city, county, and state taxes, and eonst_ itute a personal charge or claim against the owner or - owners of said lot, lots, parts of lots, blocks, or tracts of land. Section 3 The fact that the portions of the above named street# as in- dicated are in bad condition and jeopardize the safety of -the people travelling thereon creates an imperative public emergency necessitating the suspension of the rule` requiring Ordinances to be . read on three several days before their passage. -Wherefore, such rule is hereby sus- pended, and this Ordinance shall be in full force and effect from xand after -its passage and publication.
