AN ORDINANCE
ENTITLED AN ORDINANCE OF THE C ITY OF
BEAUMONT, TEXAS, RECEIVING AND ACCEPT-
ING THE ZNTORK OF IMPROVING HARRISON STREET,
FROM THE VIJEST PROPERTY LINE OF PINE
STREET 1ATEST!ATARD TO THE EAST PROPERTY LITE
OF GRAND AVENUE IN THE CITY OF-BEAUMONT,
TEK&S, AUTHORIZING AND DIRECTING THE
EXECUTION AND ISSUANCE OF SPECIAL ASSESS-
MENT CERTIFICATES TO TROTTI & THOMSON,
INC., THE.CONTRACTOR PERFORMING SAID WORK;
APPROVING THE FORI,I OF SUCH SPECIAL ASSESS-
MENT CERTIFICATES.
BE IT ORDAINED BY TIME CITY OF BEAUMONT:
SECTION 1:
That the work of improving the following described
street in the City of Beaumont, Texas, to -wit:
HARRISON STREET, from the Zest
property line of Pine Street
Westward to the East property
line of Grand Avenue
by raising, grading, filling, widening, paving,__ repaving or
repairing same and by constructing such drainage lines and
facilities and other incidentals and appurtenances thereto as
deemed necessary and adequate by the City Engineer and as pro-
vided for in the Plans and Specifications therefor, said pav-
ing consisting of the construction of a Six Inch (6`t) Reinforced
Portland Cement Concrete Slab together with integral curb and.
of the type and width as provided for in the Plans and
Specifications therefor ?prepared by the City Engineer, and here-
tofore approved and adopted by said City Council, all of said
improvements being as provided for and described in said Plans
and Specifications, and all of same having been performed and
completed in full accordance with all the terms and provisions
of the Contract dated October 28, 1948, between said City of
Beaumont, Texas, and Trotti & Thomson, Inc., and said Plans and
Specifications therein contained; and said City Engineer having
measured, examined and caused to be tested the finished improve-
ments by the, means and in the manner provided by the terms of
said Contract and the Plans and Specifications therein contained,
and said City Engineer having found that such improvements have
been constructed and completed in full compliance with all
provisions of said Contract and said Plans and Specifications,
and said City Engineer having approved and accepted said work
and improvements and having heretofore issued= his Certificate
of Final Acceptance, and so certified to said City Council and
recommending that said City Council accept and receive said
work and the improvements as constructed and completed by said
Trotti & Thomson, Inc., and said work and improvements having
been examined and found by the Mayor and the City Council of
said City of Beaumont, Texas, to have been performed and com-
pleted in full compliance with said Contract and said Plans and
Specifications therefor, said work and improvements are hereby
found by said City Council to have been performed and completed
by said Trotti 8; Thomson, Inc., in full compliance with the
terms and provisions of said Contract and said Plans and
Specifications -therefor, and same are hereby accepted and receiv-
ed by said City Council of the City of Beaumont, Texas, said
improvements referred to hereinabove are referred to in that
certain Contract dated October 28, 1948, as Unit 10.
SECTION 2:
That the Mayor and City Clerk of the City of Beaumont,
Texas, are hereby authorized and directed to execute and issue
to Trotti 8. Thomson, Inc., Spacial Assessment Certificates
evidencing the assessments levied against the properties im-
proved abutting upon the above described street and against the
real and true owners thereof, which, by the terms of said
Contract, the City of Beaumont, Texas, has agreed and obligated
itself to issue and deliver to said Trotti & Thomson, Inc., in
accordance with the provisions of the Final Assessment,Ordinance
and other proceedings heretofore had and adopted by said City
Council; said Special Assessment Certificates shall be executed
in the name of said City by its Mayor and City Clerk, and impress-
ed with the seal of said City, and dated as of the date hereof,
and such officers are hereby authorized and directed to execute
said Certificates in their official capacities on behalf of said
City, and deliver same- to said Trotti & Thomson, Inc., said
Special Assessment Certificates having heretofore been prepared,
a copy of tivhich is on file with the City Clerk, the form and
contents thereof are hereby approved and adopted.
