ENTITLED AN ORDINANCE DETERMINING THAT CERTAIN
STEPS HAVE.HERET.OFORE BEEN TAKEN IN CONNECTION
WITH THE ADVERTISING FOR AND. RECEIVING OF BIDS
FOR,.THE CONSTRUCTION OF IMPROVEMENTS ON LAUREL
AVENUE WITHIN THE LIMITS HEREINBELOW DESCRIBED;
ACCEPTING THE BID OF R'. P. FARNSWORTH -& COMPANY,'
INC:, FOR .THE -CONSTRUCTION OF SAID IMPROVEMENTS
A'S .THE LOWEST'AND BEST RESPONSIBLE BID -THEREFOR;
AWARDING A CONTRACT TO SAID R. P., FARNSWORTH &'
-COMPANY, INC., UPON SAID BID FOR SAID IMPROVE-
MENTS; MAKING APPROPRIATION.OF.FUNDS FOR.THE.
PAYMENT OF'THE CITY OF BEAUmmiils SHARE OF THE
COST, OF SAID IMPROVEMENTS; APPROVING THE, CONTRACT,
PERFORMANCE AND MAINTENANCE BONDS EXECUTED BY
SAID CONTRACTOR AND ITS SURETY FOR SAID IMPROVE-
MENTS, AND AUTHORIZING THE CITY MANAGER AND THE
CITY. CLERK,TO.EXECUTE AND ATTEST SAID CONTRACT
FOR AND. ON BEHALF OF, THE CITY OF BEAUMONT.
BE IT .ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
The City .Council'of*The.City-of Beaumont,.Texas, hereby
finds and determines:
a. That the City.'Council of The City of Beaumont,
Texas, has heretofore received, and opened in public meeting bids
for the --improvement of'Laurel Avenue from Eleventh Street west
Twenty -Two Hundred (22001) f eet,'pursuant'to'advertisements for such.
bids published for the length of time andjn the manner required by
law and the '-Charter of said City; .which bids were by . sai'd City
Council ref erred"to? the ;City: Manager for tabulation and- recommenda-
tion; and
b. That thereafter the City Manager did make recom-
mendation of the City Council recommending that the bid of R. P.
Farnsworth & Qompany, Inc.-, in the sum.of,.Twenty--Six Thousand Eight
Hundred and Sixty-one („26,$61.00) Dollars be accepted;
C. That the City Engineer.has prepared and filed with
the City Council an -estimate of the portion of the costs of said
improvements ,to be .paid by,The City of Beaumont,' said estimate being
the sum of Five Thousand,Eight-Hundred Twenty-Eight'Dollars and
Eighty-Four.Cents ($5,$2$.$10, and it is -,hereby found and determined
that there are available funds-on,hand in the Treasury,o'f.The
City of Beaumont sufficient to..cover said costs to The City of
Beaumont and available for -appropriation for such use;
d. That said R.. P. Farnsworth & Company, Inc., have
executed a proper contract, performance bond and maintenance bond,
said bonds being executed by an acceptable . surety company, all -
pursuant to.its bid proposal:"in accordance -with the notice,to bid-:.
ders and general spec fications,`all of'which are,in the form and
manner as. required by law and the Charter: of said City; that said
contract, performance bond.,and maintenance bond have -been presented
to and filed with the City C,ouricil and same are found to be in due
and proper form:and.acceptable'to The'City Council.
Section 2.
That the bid of R. P. Farnsworth &Company, Inc®, for the
construction of said improvements in the sum of'Twenty-Six Thousand
Eight Hundred and Sixty=One ($26,$61.00) Dollars'.be and the same is
hereby'accepted'as the lowest and. -best bid by a responsible bidder,
and the.contractAfor the construction of said'improvements is here-
by awarded to said R. P. Farnsworth &•Company, Inc., upon said bid.
Section 3i.
That said R. P. Farnsworth.& -Company, Inc.,_ -having already
executed and submitted to the City Council for its.ap"proval the
contract, performance bond.and maintenance bond as required by the
notice to bidders and the general specifications for the construc-
tion of said improvements,, such contract; performance bond and main-
tenance bond are hereby approved and accepted as.in full compliance-
with
ompliancewith all requirements'of the law, &nd'the Charter of said_City'and
the notice to bidders and specifications covering said improvements,
and that the surety on 'said performance and maintenance bonds be and
the same are hereby approved aind accepted; further, that'the City
ftI Rater. and the City Clerk of The City, of Beaumont, Texas,, are here-
by authorized and directed to -execute and attest said cont ract,Tor

and on behalf of The City of Beaumont, Texas. -
Section 4.
That there is hereby appropriated out of the Street and
Highway Bond Fund, 1929 Series F, the sum of Five Thousand Eight,
Hundred Twenty -Eight Dollars and Eighty -Four Cents ($50$2$:$4)
to pay the Cityts portion of the'cost,of said improvements under
the above contract therefor 'and proper warrants are hereby auth-
orized'to be issued in said amount, or so much thereof as may be
necessary agairist said fund to pay and discharge the obligations
of. The City of Beaumont chargeable thereto under said contract.
