FARES IN THE CITY OF BEATTMIONT; PENALTIES FOR

VIOLETIONS., AND REPE&LING
SECTIONS OF ORDINkNCES IN M!FLICT HEREWITH.
BE IT ORDAINED BY TICH CITY OF BEAUMONT:
Article 1.

Section 1. The following words and phrases when used in this
ordinance shall for the purpose oP this ordinance have the
meanings respectively, ascribed to them in this !�rticle:
VEHICLE. Every device in, upon, or by which any person
or property is or may be -transported. or drawn upon a highway,
except devices moved by hum -an power or used exclusively upon
stationary rails or tr�acks,
YOTOR VEHICLE, Every vehicle which is self-propelled.
AUTHORIZED EMERGENCY VEHICLE. Vehicles of the Fire
Department, police vehicles, and such ambulances and emergency

vehicles of municipal departments or public service corporations
as are designated or authorized by the Chief of Police of this
City.
BICYCLE. Every device propelled by human power upon
which any person may ride havinrj� two tandem wheels, either of

which is over twenty (20) inches in diameter and including any
device generally recognized as a bicycle., though equipped with
two front or two rear wheels.
1�10TORCYCTE, Every motor vehicle having a saddle for
the use of the riderP and designed to travel on nor -more than
three wheels in contact with the ground., but excluding a tractor.
The term "_Eotorcycle" sha'l� include all forms of motorbikes.
TRLFFIC. Pedestrians., ridden or herded aninals., vehi-
cles, streetcars, and other, conveyances, either singly or to-
gether while using any street for purposes of traveJ.

PRIVATE ROAD,'OR. DR IVEWAY, Every way -or place in private
ownership., and used f or,- v ehicular travel by the -owner-and..those.

ROADWAY. That�portion of a street br-highway improved

but not to all such roadways collectively.
SIDEWALK.. That portion of the,street 'between the curb
lines'.. or the lateral lines of a,roadway, and the adja'cent pro-
perty line intended'for the use of pedestrians.
IANED STREET OR ROADWAY. A street or roadway which is
divided into two or mor'e clearly'. -marked lanes for -vehicular
traf f ic.
INTERSECTION, The area embraced within the prolongation
or connection of the.lateral'curb lines or, if none., then the
lateral boundary.lines- oT.'th6.` roadways of two highways which
join one another at or approximately at riSht angles, or the
are.�i within which vehicles traveling upon d
ifferent highways

CROSSWALK, (4) That part of a roadway'at an intersec-
-tion included within'the connections of-thelaterlal lines of
the.sidewalks on opposite sides of the highway measured from
the curbs . or in the absence of curbs from the edges of.the
trav'ersable roadway.
(b) Any portion of a roadway at an inter-
section, or elsewhere distinctly indicated for pedestrian cross-
ing by lines or other markings on the surface.
SAFETY ZONES, The area of space'officially set apart
within a roadway for the exclusive'use of pedestrians and which
is protected or is so marked or indicated by adequate signs as
to . be plain . ly vi.sible at --all times while set,apart as a safety
zone,
CURB L01MNG ZONE. A space adjacent to a curb'reserved
for the exclusive use of vehicles during the loading or unload-
ing of passengers or materials.
OFFICIAL TRAFFIC I CONTROL DEVICES, All signs., signals,
markings, and devices not inconsistent with this ordinance
placed or erected by authority of a public body or official

having jurisdictions,for'the purpose- of regulating., warning,
or guiding traffic''.
TRAFFIC CONTROL SIGNAL. Any device whether manually..
electrically, or mechanically operated bywhich traffic is al-
ternately directed -to stop and to proceed.
Article 2.
TRAFFIC ADMINISTMTION.
Section 1, "POLICE ADMINISTRATION. There is hereby established.
in the Police Department of this City a Traffic Division to be
under the control of an officer of police appointed"by and di-.
rectly respon.s-ibl.e to the, Chief of Police-,

the Traffic Division., ;:w-ith such aid as,may be rendered by other

and to carry out those duties.specially imposed upon said Division
by this ordinance and the traffic ordinances of this City.
Section 3. TRAFFIC ACCIDENT STUDIES. Whenever the accidents

-shall cooperate with the Director of Traffic Planning a lain-
tenance in.conducting-studies of. such,accident's 'and determining
remedial measures,
Section 4.- TRAFFIC- DIVISION, TO DESIGNATE METHOD OF IDENTIFYING
FUNERAL PROCESSIONS AND ROUTES, The Traffic Division shall de-
signate a type -of p.ennant or other'identifying 'insignia to be-

Section 5. TRAFFIC PLA.NNING-AND M&INTENLXCE DIVISI ON. The
office of Traffic Planning and Iviainte"nance Division is hereby
established, The Director of said Division shall be known as
Director of Traffic Pla
nning and-l�fiaintenance-and,shall..be'ap-
pointed by the City Manager and.he..-shall exercise the pow ers. and
duties as provided in this,.'ordinance and in the traffic ordi-
nances of this City.,
Section 6. TRAFFIC CWSlISSION ITS ..PO VVERS, AND DUTIES.
(a) There is hereby established a Traffic Commission
to serve without compensatiori- 'consi sting- of th . 6 Mayor the City
Manager, the City Attorney, . the Chief of Police.P. or in -his dis-
cretion.as his representative the chief of the Traffic Division
and.D.irector of Traffic Planning.and Maintenance. The -Mayor
.shall act as Chairman,
(b) It shall be the d"uty of the Traffic Commission to
co-ordinate.traffic activa"ties.., to carry'on educatior-laf-activ-
ities.in-traffic matters., to supervise the preparation and publi-
cation cif,traffie'reports' and to recommend to the -City Council
and to the Director -of Traffic Planninc, and -,Maint . endnce and the

Chief of Police-.9,ways.and means for improving traffic conditions
and the a I draini-stration and enf orcement, of traffi,d regulations,
Article 3. -
ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGUL&TIONS.
Section 7. AUTHORITY -�OF- POLICE'AND FIRE DEPARTIv"TENT OFFIC IALS.
(a) It shall be�t.he duty of,the officers of the Police
Department., 'or _,suph officers. as.. are as6luned by,.the Chief of

(b) Officers.of-the Polic6-Department, or such offi-
cers,as are'assigned,by'.the-Chief of..Police, are hereby auth-
orized to direct all.traffic by voice, hand or signal'in con-
formance with traffic..,laws., provided that.,. in the event of a
fire or other,emergency or to expedite'traffic or to safeguard
p-edbstri-ans'. officers of the Police Department may direct 'traf-
f ic- as conditions may require. notwi thstanding the.provisions of
the traffic laws.
(c) -Officers.of the Fire Department., when at the scene
of a fire, may direct or. assi.st the Police -in direct'ing traffic.
thereat or:in,.the. 'irm4ediate:'Vicinity.
Section -.8. REQUIRED --.'OBEDIENCE. T-0 TR&FFIC ORDINANCE. - It is

Section 9.
OBEDIENCE _T 0 POLICE AIM FIRE DEPkRTTJENT OFFICIALS. -
No person shall wilfully'fail:or refuse to comdy with any law -

ful order or direetion of a Police'Office'r oj� of'a Fire -Depart-
ment
official inv'ested.by law with -authority to,direct,,, control., or
regulate -traffic.
Section 10. PERSONS PROPELLING PUSHCARTS OR RIDING ANIMALS TO
OBEY TR&FFIC REGUIATIONS..- Every person propelling any pushcart
or riding an'animal ubon a roadway, and every person driving any
animal -drawn vehicle.shall be subject to the provisions'of this
ordinance applicable to the driver -of any vehicle P except those
provisions.of this ordinance which,by their very nature can have
no application,
Section 11.
PUBLIC
EMPLOYEES
TO -OBEY TRA-FFIC REGUIATIO'NS. - The
provisions of
-this
ordinance
shall apply to the driver of any

vehicle owned by or used in the service of the United States
Government this State County., City., town or district or any
other political subdivision of the State., and it shall be un-
lawful for any such driver to violate any of the provisions of
this ordinance except as otherwise permitted in this ordinance
or by State Statute.
Section 12. EXCEPTIONS TO AUTHORIZED EMERGENCY VEHICLES. - The
driver of any authorized emergency vehicle when responding to
an emergency call upon approaching a red or stop signal or any

stop signs shall slow down as necessary for safety but may pro-
ceed cautiously past such red sign or signal. At other times
drivers of authorized emergency vehicles shall stop in obedience
to a stop sign or signal.
No driver of any authorized emergency vehicle shall as-
s'ume any special privilege under this ordinance, except when
such vehicle is operated in response to an emergency call or in
the immediate pursuit of an actual or suspected violator of the
law,
Section 13. OPERATION OF VEHICLES ON APPROACH OF AUTHORIZED
EMERGENCY VEHICLES. -
(a) Upon the immediate approach of an authorized emer-
gency vehicle equipped with at least one lighted lamp exhibiting
red light visible under.normal atmospheric conditions from a
distance of five hundred (500) feet to the front of such vehicle.,
and when the driver is.giving audible signal by siren, exhaust
whistle or bell, the driver,of every other vehicle shall yield
the right of way and shall immediately drive to a position paral-

lel to., and as close as possible to, the right-hand edge or curb
of the roadway clear of any intersection., and shall stop and re-
main in such position until the authorized emergency vehicle has

pas,sedY except -when otherwise ai'vected by a Police Officer.
(b) This Section 'shall not operate to relieve .. - the
driver of.' an emergency vehicle from,the duty to drive with due
regard.for the sa I fety of all. persons us,ing the highway.

TRAFFIC CONTROL DEVICES.

conform to the manual and Ppecifications approved and adopted by
the State Highway Gommission of the.State of Texas. All traffic -
control devices so erecte.6 and not inconsist-ent.with the:provis�-
ions of State'law,or this ordinance shall be.''official traffic -

Section 170 OBEDIEIVCE'.TO OPFIC IAL TRAFFIC CONTROL DEVICES
The'driver of -any vehiclb-shall--obey the'instructions of' any
official traf.fic-contr'ol device applicable thereto. '-ed i"

accordance with the traffic ordinances of this City unless
otherwise directed by a police officer, subject to the exce-p-
tions. granted the driver of an authorized emergency vehicle
in this ordinance.
Section 18, TRAFFIC -CONTROL SIGNAL LEGEND. - Uhenever traffic
is controlled by traffic -control signals exhibiting Une words
"Got'S "Caution". or 11stoptl J. or exhibiting different colored
lights successively one at a time, or with arrows the following

colors only shall be used and said terms and liuht6 shall indi-

cate and apply to drivers of vehicles end pedestrians as fol-
lows:
(a.) Green alone., or "Goll:
(1) Vehicular traffic facing the signal may pro-
ceed straight through orturn right or left unless a sign at
such place prohibits either such turn. But vehicular traffic
including vehicles turning right or left., shall yield the right

of way to other vehicles and to pedestrians lawfully within the
intersection or an adjacent crosswalk at the time such signal is
exhibited.
(2) Pedestrians facing the signal may proceed
across the roadway within any marked or unmarked crosswalk.
(b) Yellow alone., or "Caution".. when shown following
the green or "Go" signal:
(1) Vehicular traffic facing the signal is thereby
warned that the red or "Stop" signal will be exhibited i=iiediate-
ly thereafter and such vehicular traffic shall not enter or be
crossing the intersection Y,--ihen the red or "Stop" signal is exhib-
ited.
(2) No pedestrian facing such signal shall enter
the roadway until.the green or "Got' is shown alone., unless auth-
orized so to do by a signal indicatinS walkinr.; is permissible.

(c) Red alone, or ilstop1l:
Vehicular traffic facing the signal shall
stop befor6 entering the crosswalk on the near side'of the in-
tersection., or if none., then before entering th.e intersection
and shall remain standing -until green or "Go" is shown alone.
.(2) No,pedeotrian facing such signal shall. enter
the roadway until the green or"Go" is.shown alone, unless auth-
orized so to do by a signal indicating that walking is permissi-
bl e.
(d) Red with.green arrow:
(1), Vehicular,traffic facing -such signal may cau-
tiously enter the intersection.only to make the move indicated
by such arrow but shall 'ield the right of way,to pedestrians

lawfully within a crosswalk and to other traffic lawfully using
the intersection.
(2) No,pedestrian f4cing-such signal shall enter
the roadway unti.1 the green or"'G61''lls' shown alone., unless auth-

(e) Iri -the event'an official traffic -control signal is
erected and maintained at a place other than an intersection.,
the provisions of this Section -shall be Capplicable except as to
those provisions- which -by their nature can- have no application,
Lny stop required shall be made at a sigh or marking on the pave-
ment indicating where the stop shall be -made., but in the absence
of �.ny such.sign or -marking the stop shall -be -made at the signal,
Section 19..
PEDESTRIAN WALK AND WAIT SIGNPLLSO -- Vihenever spec-
ial pedestrian -control signals exhibiting words indicating that
it is'permissible to walk., or that pedestrians should wait are
in place, such signals shall indicate as follows:
(a) Signals.indicating walking is permissible. Pedes-
trians.fac.ing such signal may proceed across the roadway in the

direction of the signal -and shall-begiven the right of way by
the drivers of all vehicles.
(b) 'Signals indicating.it is necessa
ry to wait. No.
pedestrian shall start to'cross the roadway -in the direction of
such signal, but any pedestrian who has partially 'completed his,
crossinglon the walk signal shall proceed to a sidewalk or safety
island while' the'wait signal is showing,
Section 20. FLASHING SIGNALS. - Whenever flashing red or yellow
signals..are used.they.shall require obedience by vehicular traf-_
fic as follows:
(a) Fiashing,red (stop signal)* When a red lens.is illu-
minated with rapid intermittent flashes, drivers of vehicles shall
stop before entering the nearest'crosswalk at an intersection or
at a limit line when marked, or, if none,, then before entering the
intersection, and the right to,proceed-shall-be subject to the
rules applicable after making.a stop at a stop sign,.
Flashing y-ellow,(caution signal). When a yellow lens
is illuminated with 'rapid intermittent flashes,,drivers of vehicles
mayippoceed through the in tersection or past,such signal only with
caution,

Section,21._DISPLAT 9F-UNAUTHORIZED.SIGN8,-:SIGNALS�.OR MARKINGS.
(a). No-pers-qp shall place.,';maintain or' display upon or in
view of any highway any unauthorized sign,, signal, markinp, or de-
vice which purport's-to'll-be-or-is an imitation -of or r esembles an
.official traffic-coritrol device or railroad sign or signal, or
which atteJnpt to.direct the movement of traffic or which.attempt'
to control parking or which hides from view or-interferes'with the
effectiveness of any official traffic -control device or any railroad
sign or signal., and no person.shall place or maintain nor shall any
public authority permit upon any -highway any traffic sign or signal
bearing thereon any -commercial advertising. This.shall not be
deemed to prohibit the erection upon Private, -property adjacent t6
highwaysof signs giving useful directional information and of
a type that cannot be mistaken for official signs.
(b) Every such prohibited sign, signal or marking is
hereby declared to be a public nuisance, and the Chief of Police
is hereby empowered to remove the.same or cause it to be removed
without notice,
Section 22. INTERFERENCE WITH OFFICIAL TRAFFIC -CONTROL DEVICES
OR RAILROAD SIGNS OR.SIGNALS.., Noperson shall without lawful
authority attempt to or in fact alt . er., defac'e-, injure., knock down,,
or remove any official traffic -control device or any railroad sign
or signal, -or any -other i3art thereof.
Section 23. AUTHORITY TO ESTABLISH PLAY -STREETS. - The Director
of Traffic Planning and Malintena . nee shall have authority to declare
any street or part thereof adjacent to -a private or public school
a play street and to place appropriate signs or devices in the
roadway indicating and helping to protect the same,
Section 24. PLAY STREET. - Whenever authorized signs are erected.
indicating any street or part thereof as a play street, no person
shall drive a.vehicle upon any such street.or portion thereof ex-
cept drivers of vehicles having business or whose residences are
within such closed area,, and then any said driver shall exercise
the greatest care in driving upon any such street or portion there-
of.
Article 5.
DUTIES OF'DIRECTOR OF TRAFFIC PLANNING AND MAINTENANCE.'
Section 25. Whenever and wherever congestion of traffic, the fre-
quency of passage of vehicles or pedestrians, or both, the direc-
tion of the flow of traffic, the dimensions of the stretts and
sidewalks, and the use of.property abutting the streets,, are such
that he finds it to. be necessary for the free flow and the expedi-
tious handling of traffic and the safety.of .'persons and property,
the,Director of Traffic Planning and Maintenance -is authorized:

highwaysof signs giving useful directional information and of
a type that cannot be mistaken for official signs.
(b) Every such prohibited sign, signal or marking is
hereby declared to be a public nuisance, and the Chief of Police

Beaumont which shall not be used as spaces for the parking of
vehicles and to mark such areas1with appropriat.e signs or mark-
ings.
(1) To designate intersections of streets at which driv-
ers operating vehicles approaching the intersection on one or more
of the intersecting streets -must bring such vehicle to a complete
stop before -!proceeding into such intersection, and to install and
maintain appropriate signs and markings directing such drivers to
stop at such intersectians.
(m) To designate intersections of streets at which driv-
ers operating vehicles approaching the intersection of one or
more of the intersecting streets'must-reduce the speed of such
vehicle to not to exceed ten (10) miles per hour upon reaching
for a distance of one hundred (100) feet,and to install appro-
priate signs and markings directing suah drivers thus to reduce
the speed of their vehicles.
(n) To designate the routes which must be followed by
commercial vehicles in using the streets of the City of Beaulfiatt.
Provided that no such vehicle shall be prohibited from using any
street for the purpose.of going directly to or from any residen-
tial, commercial or industrial establishment abutting on such
street.
(o) To determine and allocate parking time limits on
streets and portions of streets and place appropriate signs or
markings giving notice thereof.
(p) To designate intersections, the crossing of which
shall be controlled by red, green and amber lights and arrows as
elsewhere herein provided, and to determine the type of such
lights or traffic control devices to be installed at each inter-
section, and to cause the sa'me,to be installed,, and it -shall be

unlawful for any person to fail or refuse to obey the instruc-
tions.transmitted by means of such lights or traffic -control
devices.
Section 25*a.Whenever he finds it is necessary to the public
health, comfort and safety, the Director of Traffic Planning and
Maintenance is hereby ,authorized to designate areas of the
streets of the City of Beaumont to be known as "Quiet ZonesR in
the vicinity of any hospital, church, school, or public institu-
tion, and to mark such area with appropriate signs directing the
drivers of vehicles not to sound a horn -or other warning device
while traveling in the area thus designated.
Section 26. Every regulation, designation, delineation, or deter-
mination promulgated by the Director of TrafficiPlanning and Main-
tenance pursuant to the authority granted in this ordinance shall,
unless otherwise provided herein be described in_,,writing and filed
with the City Clerk of the City of Beaumont'.. Such writing shall
constitute a public rec ' ord and'all persons shall be charged with
notice of the contents of same.
Section 27.' The installation - under'the direc tion of the Director
of Traffic Planning and Maintenance of any traffic -control device,,
sign,, signal'or marking provided for in this ordinance shall at
once cause to be effective the instruction top6destrians or driv-
ers of vehicles transmitted by means of such device, sign, signal
or marking.
Section 28. It being un lawful'for any person other than the Dir-
ector of Traffic Planning and Maintenance to install or cause 'to
be installed any sign purporting to direct the'�_use of the streets
or the activities on the streets of pedestrians or vehicles, proof
in any prosecution for violation of this ordinance that any traf-
fie control device, sign, signal or marking was actually in place

on any street in the City of Beaumont shall constitute prima facie
evidence that the same -was installed by the.Director of.Traffic
Planning and Maintenance pursuant to -the authority,herein granted.
Section 29. It shall be unlawful for any person knowingly to
fail to observe or obey any instruction' -6f any traffic control
device, signal light, sign or marking installed -as provided for
in the preceding sections of this Article.
Article.6.'
SPEED REGULATIONS.
Section 30. STATE SPEED LAWS -APPLICABLE. The State traffic -laws
regulating the speed of vehicles shall be�applicable upon.all
streets within this.Citk except as this ordinance, as authorized,
by StAte law hereby declares and determines upon the basis of
engineering and traffic -investigation that certaini- speed regula-
tions shall be applicable upon specified streets or in certain
aredsi! iii which event it shall,be prima'facie.unlawful for any,
person to drive a vehicle at a speed in excess of any speed so
declared in this ordinance when signs are"in place giving notice
thereof.
Section 31,1NCREASING.STATE SPEED LIMIT IN CERTAIN ZONES. - It
is hereby d:etermined,'on�--the-basis' of -'an engineering, and -traffic
investigation that the spp�ed permitted by'State law upon the fol-
lowing streets'.is.less'than is nec , essary-for safe operation of
vehidles.thereon by reason of the designation and sign -posting of
said.,streets as through highways and by -reason of widely spaced
intersections, and it is hereby declared that the prima facie
speed limits shall be as.hereinafter set'forth on those streets
or.parts of streets herein designated when signs are.erected giv-
ing notice thereof, and the speed limit designated . for each of
said streets or speed zones is declared.to be the maximum, reason-
able and pru4ent speed limit therein.

TURNING MOVEMENTS.
Section 32..' REQUIRED POSITION AND METHOD OF TURNING AT INTERSEC-
TIONS. The driver of 'vehicle intending to' turn at an intersec-
tion shall do so as follows:
(a) 'Ona,two-way street both the approach for a' -right
turn and a right turn shall be,ma de as close as practical to the
right-hand.curb or edge of the roadway.
(b) 'on a two-way street the' -approach for.a left turn shall
be made in that portion of the righthalf--ok the roadwaynearest
the 6enterline thereof and after entering the intersection the
left.'- turn shall -'be made so as to.leave the intersection to the
right of the centerline of the roadway being ent ered.
(c) On a one-way street both the approach for'a right
turn and a right, turn shall be made only from t , he line of traffic

Article 8.
ONE-WAY STREETS AND ALLEYS. -
Section 33. AUTHORITY TO DESIGNATE ONE-WAY STREETS AND-.-ALLEYS.o
Whenever any ordinance of this City desig'nates'any one -'way street
or alley, the Director of Traffic Planning and Maintenance shall
place and maintain signs giving notice thereof, and no such regu-
lation shall be effective'_',unless such signs are in place. Signs
indicating the direction of lawful traffic movement shall be
placed at every intersection where - movement of traffic in the
opposite direction is prohibited.
Section 34.1 ONE-WAY STREETS AND ALLEYS. - Upon those streets and
parts of streets and in those alleys so designated2-vehicular
traffic shall move only in the indicated direction when signs in-
dicating the direction of traffic are erected and maintained at
every Tintersection where movement in the opposite direction is'
prohibited.
Section 35., PASSING FROM ONE TRAFFIC LANE INTO ANOTHER. - On one-
way streets which are marked into't'r-aff-ic lanes by solid lines
and dash stripes,_it shall be unlawful for the driver of a vehicle

Section 39. -CROSSING FIRE HOSE. No vehicle shall be driven
over any.unprotected hose.of-a fire department, when laid down on
any street or private driveway to be used at any fire or 'alarm of
fire,'Without the consent of the fire department official in com-
mand.
Section 40., DRIVING'THROUGH FUNERAL OR OTHER -PROCESSION. -'No
driver of a vehicle shall drive,between the . vehicles comprising

PEDESTRIANS RIGHTS AND DUTIES.

tofore -declared in Section 19 of this.ordinance, but at all other
places -pedestrians shall. be. granted those rights and.be.-subject

The foregoing rule has 'no application under the conditions,

Section 54. PROHIBITED CR08SING.
(a) Between adjacent intersectlons'at which'traffic-con-
trol-signals are in operation', pedestrians. shall not cross at any
place except in,a crosswalk.
(b) No pe.desttian-shall. cross a.roadway other than in a
crosswalk in the central business district.'
Section 55.' PEDESTRIANS WALK-ING ALONG ROADWAYS.
(a) Where sidewalks ar'
q provided it shall be unlawful for
any pedestrian'to walk,along and:upon an adjacent roadway.'
(b) Where sidewalks 'are not provided,any.pedestrian walk-
ing along or -upon a highway shall when practicable walk only on
the.left side of the roadway or its shoulder facing traffic which
may approach from the opposite direction. -
(c) No person shall stand in a -roadway for the purpose of
soliciting a ride from -the driver of any vehicle.
Section 56. DRIVERS TO EXERC ISE DUE CARE. Notwithstanding the
.foregoing provisions of-this..Article, every driver of a vehicle'
shall exercise'due care to avoid colliding with any pedestrian
upon any -roadway and shall give warning by sounding the horn when

necessary and shall exercise.proper precaution upon observing
any child'or any confused or incapacitated person upon a.roadway.
Article 12.
REGULATIONS FOR BICYCLES.
Section 57. -EFFECT-OF,REGULATibNS.
(a) It -is a mi6demean , or for any person to do any act for-
bidden or fail to perform any act�required in this'Article.
(b) The parent of any�child and the guardian of. any ward
shall not authorize.or. knowingly -permit any -such child or ward
to violate any of the provisions 6f.this Article.'
(c) 'These regulations.�appjicable to bicycles shall apply
whenever a bicycle is operated upon any street or upon any public
path set aside for the exclusive -use of bicycles,'subject to those
exceptions-stated,herein's
Section 58. TRAFFIC LAWS TO APPLY TO PERSON8'RIDING BICYCLES. -
Every person riding a bicycle upon a -roadway shall be granted all
of the rightsand shall be subject.to all of the'duties applicable
to the driver of a vehicle by the laws of -this State declaring
rules of the road applicable to vehicles, or by the traffic ordi-
nahces of The City of Beaumont applicable'to the driver of a vehi-
cle, except as to special',.regulati'on.s-'in't.his Article and except
as'to those of laws -'and ordindnces-which by their nature
.provisions
can have no application.. -
Section 59. OBEDIENCE TO TRAFFIC CONTROL DEVICES.
(a) Any person 6perat,ing a bicycle shall obey the instruc-
tions of official traffic -control signals,, signs and -other control
devices applicable to -vehicles., unless otherwise directed by a
police office're
(b) Whenever authorized signs are erected indicating that
no right'or left or U-turn is permitted, no person operating a
bicycle shall disobey the direction of any such sign, except where
such person dismounts from the bicycle'to make any such turn., in

Section.'60. RIDI NG ON BICYCLES.
.(a) A person propelling a bicycle shall not ride other
than astride a permanent and regular seat attached thereto.
(b) No bicycle -'shall be used to carry more persons at
one time thAn,the'number for which it is designated and equipped.
Section 61. RIDING -ON ROADWAYS -AND BICYCLE PATHS.
(a) Every person operating a''bicycle upon a roadway shall
ride as near to the right-�-]�and,side . of the',roadway as practicable,
exercising-due.care when passing a standing vehicle or one proceed-
ing in the same direction.-

Section 63. EMERGING FROM ALLEY OR DRIVEWAY. The operator of a
bicycle emerging from an alley, driveway, or building shall upon
approaching a,sidbwalk or the sidewalk area extending acrosz any
alleyway, yield the right of way to all pedestrians approaching
on s I aid sidewalk..or sidewalk area, and upon entering'the roadway
.shall yield.the right of way to -all vehicles approaching on said
roadway.
Section 64. CLINGINGJTO VEHICLES. 7 No person riding upon any
bicycle shall attach the same or himself to any vehicle upon a

Section 65., PARKING. No person shall park a bicycle upon a
street other than upon the'roadway against the.curb, or upon the
sidewalk in a'radk to support the bicycle,,or against . a building
or at the curbin such'a manner as,to afford the least obstruc-
tion to pedestrian traffic.
Section 66. PARKING PROHIBITED. - No per -son shall park a bicycle
in a prohibited vehicular,,parking zone or in officially designated
f ire lanes
Section 67� 'RIDING ON-ZIDEIKALKS.
(a) No person shall ride a bicycle upon'a -sidewalk .:with-

(c) -Wh-enever-.a'ny person is riding a bicycle upon a side-
walk, such person shall yield the right of way to any pedestrian
and shall'give audible signal before overtaking'and,'Pas-sing'such
pedestrian.
Section 68�. LAMPS AND OTHER EQUIPMENT ON BICYCLES.
(d)' Every bicycle when in use,at night time shall be,
equipped.with a lamp on the front which shall emit' a'white light
visible from a distance of at least five hundred (500) feet from
the front and with a red reflector upon the rear, of a type which
shall be visible from all di . stances fr - om fifty -(50) feet'to three
huridr.ed,.(300) feet to the rear.when directly in front of -lawful.
upper beams of. hea'dlamps on a motor.vehicle. A lamp emitting a
red light visible from a distance of five hundred (500) feet to
the rear,ma' be used,in addition to the red reflector.

(b) No person shall operate a bicycle unless it is equip-
ped with a,bell or,oth.er-dpvice capable'of'giving a signal audible

for a distance of at least fifty (50) feet., except that a' bicycle
shall not be equipped with., nor shall any person -use upon a bicy-
cle, any -siren or whistle.
(c) Every bicycle shall be equipped with a''brake which
will enable the operator to make the braked.wheel skid on dry.,
level, clean pavement,
Section 69. PENALTIES. - Every person violating any of the pro-
visions of this -Article shall be.guilty o'
f a misdemeanor,
Article 13.
PARKING.
Section 70. STANDING OR PARKING CLOSE,TO CURB. --No person shall
stand or parka vehicle in a roadway other than paralle'lwith.t.he
edge of the roadway headed in the direction of lawful 'traffic move-
ment, and -with the wheels 'of the vehicle on the'side next to the
curb within eighteen,.(18) inches of the edge of the curb or edge
of the roadway, except as otherwise provided in this Article.
Section 71. ANGLE PARKING. �- No angle parking shall be permitted
on any of the streets of The City of Beaumont.
Section 72.1 BACKING ANGLE -PARKED VEHICLE. -.It shall be unlawful
for anyone angle -parked on private property to back the' vehicle
across the sidewalk or into'a roadway_provided, however, this shall
not apply to vehicles backing from a'drive'wdy in connection with

a residence or backing.from aregularly dedicated alley.
Section 73. PERMIT FOR LOADING OR UNLOADING AT AN ANGLE TO THE
CURB. � The Director of Traffi& Planning,and Maintenance is auth-
orized to issue special permits to'pe'rmit the b acking of a vehicle
to the curb for the purpose of loading or unloading merchandise or
materials subject to the' terms and conditions of such permit. Such
permits may be issued either to the owner or lessee of real proper-
ty, or to the owner of -the vehicle, and shall grant to such person
the privilege as therein stated and authorized herein., and it shall

Article 14.
STOPPING, STANDING OR.PARKING PROHIBITED IN SPECIFIED PLACES.
Section 74.. -STOPPING., STANDING OR PARKING -PROHIBITED - NO SIGNS
REQUIRED. -
(a) No person 'shall stop, stand or park a vehicle except
when necessAry.to avoid conflict -with other traffic., or in com-
pliance with law or the direc , tions of'd Po . lice Office:& or traf-
fic -control device in any of the following'pla-ces:
(1) On a,sidewalk or sidewalk area or on public
property between property line and curb.
(2Y In front of'a public or private driveway.
(3) Within an intersection.
(4) Within'fifteen (15) feet of a.fire hydrant.
(5) On a crosswalk.
(6) Within twenty (20) feet of a crosswalk at an
intersection..
_(7) Within thirty (30) feet upon -the approa'ch"to
any,flashing,�5acon�.,stop'si-gn., 9r.traffic-control signal located
at -the side of a roadway.:
(8) Within f.ifty,(50) feet upon the approach to the
nearest rail ofa-raili . �oad c ros . sing.
(9). Within twenty (20) feet of the driveway entrance
to any Fire Stationand on the side of -a street opposite the en-
trance to any Fire Station within seventy-five (75) feet of said
entrance,(when,properly sign -posted).
(10,) Alongside or. opposite.any street'excavation..'
building construction protruding into a stree't,., or other obstruc-
tions when stopping, standing or parking would obstruct traffic.
(11) On the roadway side of any vehicle stopped or
parked at the edge or curb' of a street. .-.

(12.) Upon any bridge, viaduct or other. elevated
structure upon a highway.
(13) -At any place where official signs prohibit
stopping.
(b) No person'shall move a vehicle not lawfully under
his control into any such prohibited area or away from'a curb
such distance as is unlawful.
Section Z5. PARKING.I.N'ALLEYS.--. No',.person shall park a vehicle
within an.alley in..such a manner or under such conditions'as to
leave available less,than ten (lO) feet of-the,'.width of the road-
way for the free movement of.Vehicular traffic., and no person
shall stop, stand or park a'vehicle,within an 'alley in such a
position as to blodk-the driveway entrance to any abutting pro-
perty.
Section 76. ALL NIGHT PARKING PROHIBITED-. No person shall park
a -vehicle on any paved street, for a period of time longer than
thirty' (30) minutes between the hours of two (2:00) a.m-. and five
(5:00) aim. of any day, except physicians on emergency calls.
Section 77. PARKING FOR.. -CERTAIN PURPOSES PROHIBITED..- No person
shall park a vehicle -upon, any roadway for -the principal purpose of:
(a) Displaying such-vehiclerfor'sale.
(b) Washing, greasing',, or repairing.such vehicle except
repairs necessitated by an emergency.
(c) Using such vehicle ortrailer for advertising.purposes
or displaying -large signstherefrom containing.pictures or reading
matter.
Section 78. PARKING PROHIBITED:,ON NARROW STREETS. -
(a) The Director of Traffic Planning and Maintenance is
hereby authorized tolerect signs indicating no parking'upon any
street when the width of the roadway . does not exceed t . wenty (20)
feet, or upon one sid . e of a street as indicated by --.such'signs

when the width of the roadway does not -exceed forty (40) feet.
(b) -When official signs prohibiting parking are erected
upon narrow streets as authorized herein, no person shall park a
vehicle upon any such street in violation of any such sign.
Section 79. STANDING OR PARKING ON ONE-WAY STREETS. - The Direc-

the side of any one-way street to prohibit the standing or park-
ing'of vehicles, and when such signs are in place, no person
shall stand or park a vehicle upon such side in violation of any
such. sign.
v82ction 80. NO STOPPING STANDING OR PARKING NEAR HAZARDOUS OR
CONGESTED:,?.LACES.
(a) The Direct,o'r of,traffic Planning and.Maintenance is
hereby',,aut.horized to'det.ermine'and-designate . by proper signs
placesn6t exceeding'.one huhdr.ed (1,00) feet in''length in which the
stopping,'standing.or parking'of vehicles would create an espec-
ially hazardous condition or would cause unusual delay.to traffic.
(b) When.of-ficial signs ar'e-er.ect�ea at hazardous or con-
gested places as authorized herein.no,person shall stop, stand, or
park a vehicle in any such designated place.
Section 81. UNATTENDED MOTOR VEHICLES. - No person driving or in
charge of a motor vehicle shall permit it to stand unattended
without first stopping the engine and effectively setting the
brake thereon, and when -standing upon any grade turning the front
wheels to the curb or side of the roadway.
Article 15.
STOPPING FOR LOADING OR UNLOADING ONLY.
Section 82. DESIGNATION OF CURB LOADING ZONES. The Director of
Traffic Planning and Maintenance is hereby authorized to determine
the location of passenger and freight curb loading zones and shall
place and maintain appropriate signs indicating the same. The

tached thereto more than one veh.iclej and such 'vehicle -may be a'
trailer, semi -trailer, pole trailer, or another motor v6hicle.
(b) When one vehicle is towing,another and'the connection
consists -of a chain., rope or. cable, there shall be displayed upon
-such connection a white flag or.cloth not. -less than twelve (12),
inches square..

Section 94(
UNLAWFULLY RIDING. - No person shall ride upon any
vehicle upon any portion thereof not designated'or intended for
the'use of passengers. This provision shall not apply to any
employee engaged in the necessary discharge of a duty,, or to per-
sons riding within truck bodies in space -intended for merchandise.
Section 9,�90 BOARDING OR ALIGHTING FROM VEHICLES. - No person
shall board'6r alight',from any vehicle while 6uch'veh:icle is in
motion.
Section.94, UNLAWFUL TO GIVE WRONG,NAME OR ADDRESS. -It shall
be unlawful for any person when giving -a writt6n promise to ap-
pear or when given a written notice by any police officer to
appear before the Corporation Court of The City.of Beaumont., to'
answer for an offense against the laws -of this State,,or any or-
dinance of the -City olf..Beaumont, to give a n,assumed or fictitious
name or a false place.of r esidence or address,,,or any other than
the true name and true place of his residence or address, upon
the request of such offic.er.
Section 91., HORNS ANDWARNING, DEVICES.
(a) Every motor.vehicle when operated upon a roadway
shall be equipped with a -horn in -good working order and capable
of emitting sounds audible under normal conditions from a distance
of not less than two hundred (200) feet. No horn or other warn
ing device shall emit an unreasonably loud or harsh sound or a
whistle. The driver of a motor vehicle shall, when necessary to
insure safe operation, give audible warning with his horn, but
shall not otherwise use such horn when upon a.roadway.
(b)- No vehicle'shall be equipped with nor shall any per-
son use upon a vehicle any siren., whistle or bell except as
otherwise permitted in this Section.
(c) It shall be unlawful for the operator of any taxicab
or other -commercial vehicle to use his horn as a signal to pros-
pective customers.

Sect MUFFLERS9 PREVENTION OR -NOISE.
(a) Eve'ry-motor vehicle shall at all times be equipped
with'a muffler in good working order and in constant operation
to prevent excessive or unusu'al',noises and annoying.smoke
and
no person sha ll'use a muffler, cutout, bypass, or similar device
upon a motor vehicle on a roadway..
(b) the -engine and,.power mechanism of every motor vehicle
shall be so equipped'and a.djusted as to -prevent the escape of,
excessive fumes or smoke.
'Article 17.
PENALTIES AND PROCEDURE ON ARREST.
Section 19. PENALTIES. --It is a misdemeanor for any person to
viol -ate any of the provision s'of this ordinance unless another
penalty; is expressly provided by law. Every person convicted of
a misdemeanor for violation of any ot the provisions of this ordi—
nance., for which another penalty is not provided, shall be pun—
ished-by a fine of not less than -one ($l.'00) dollar nor more than
two hundred ($200.00) dollars.
Sect`on-101D. PROCEDURE OPONARREST. Except when authorized or
directed und6r.State la.w.to immediately take a person arrested
for a violation of any of the.traffic laws'before a magistrate,
any police officer, upon making an arrest for violation of the
State traffic laws or traffic ordinances of this city, shall take
the name, address, and.,operator's license number of the alleged',,',,
violator and the registered number of the motor vehicle involved
and shall -issue to him,,in writing on a form'provided by the City -
a notice to answer to the charge against him'at a place and at a
time at least five (5).' -days after such arrest to be'spb9ified in
the notice.* ThO o'fficer,.upon,receiving the written promise of
the alleged violator to answer as-specifi.ed in the notice, shall
release such person from custody.

In.any prosecution charging a violation of any law or regulation
governing the standing or parking of a vehidleproof that the
particular vehicle desbribed'in the complaint was parked -in vi6-
lation:ofmany buch.law,or regulation., together witli proof that
the defendant named in the-complairit was at t,h'e'time of such
parking the-reglistered owner of such vehicle, shall constitute.
in evidencea prima facie presumption that the registered owner
of such -vehicle was -the person who parked or placed such vehicle
at the point.where, and'for the time during which, such,violation
