CITY OF BEAUMONT TO CONSTRUCT AND MAINTAIN IN SAID ALLEY SEWER LINES, WATER LINES,.AND OTHER UTILITIES AND RESERVING THE RIGHT OF -THE CITY OF BEAUMONT TO GRANT A FRANCHISE RIGHT TO OTHERS, TO -CONSTRUCT AND MAINTAIN THE UTILITIES HEREINBEFORE MENTIONED THROUGH AND ALONG SAID ALLEY,°,AND PRO- HIBITING THE OBSTRUCTION OF SAME BY ANY BUILDING OR STRUCTURE. WHEREAS, a petition signed by all the property owners of s - the Lots in Block ."?Four -A (4-A) of the Cartwright Second Addition to The City of Beaumont has been presented to the City Council of The City of Beaumont, requesting that the alley running through Block Four -A (4-A) of the said Addition be -vacated and abandoned; and,- - - - _- WHEREAS, said petition -has been referred to the City Plan- ning and Zoning Commission for examination and approval and the same has been approved by the said Commission; and, WHEREAS, said petition has been duly canvassed and examined by the City Council and has been found to have been signed by all the property owners in said Block, and it appearing to the City Council that the request of the said property owners should be granted and that an ordinance should be enacted vacating and aban- doning:.said alley, reserving, however, to the City of Beaumont the right to construct and maintain all necessary public utilities in said alley, or to grant a franchise for. -the construction and main- tenance of such utilities in said alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: That the alley running through Block Four -A (4-A) of the Cartwright Second Addition to The City of Beaumont, Texas, be and the same -is hereby authorized ;to be vacated and abandoned, and that -the title I to such alley shall revert to and become the.propertyof the owners of land in said Block bordering on said alley'as provided by law; provided, however, that the vacating and -abandonment of said alley shall inn6 way affect the right of The City of Beau- mont to place and maintain therein -sewer, gas and water lines, telephone, telegraph or electric lines, wires,, poles and cables, or any.other public utility service. Neither shall the vacating and abandonment of said alley affect the -right. of The -City of Beaumont -to grant a franchise to -any person, firm -or corporation= authorizing the placing and maintaining in said alley of such . sewer, gas or water lines, telephone, telegraph or electric.liries, or other- public __utility service, all of which rights are hereby expressly;.reserved. And the.vacating and abandonment of said alley shall not be construed as -authorizing or permitting any person, party, corporation or legal entity whatsoever to erect, construct, build, move onto or place any building or structures therein, and the.erection, construction, building, moving onto or - placing of any building or'structure therein without express per- mission from the City Council to do so is hereby -;:.prohibited.' COMMENT: Please prepare the necessary papers for closing the alley in Block A, Cartwright 2nd Addition, according to the plat attached. S � V SPECIAL SESSION OF THE CITY PLANNING AND ZONING COMMISSION HELD SEPTEMBER 22, 1948 BE IT REMEMBERED that the City Planning and Zoning Commission of the City of Beaumont, Texas, met in special session on the 22nd day of September, 1948, with the following present; Mr. C. B. Holland - Chairman Miss Florence McCluskey Mr. Russell Phelps Mr. Leonard Stone Mr. K. C.. Withers Absent: Mr. C. E. Holland Mr. P. G. Matthews Others Present: Mr. Lum Edwards Nm. Carl Levy Mr. Otho Plummer, Mayor Mr. Clyde Black, City Engr. A plat of Bel Air Addition was presented to the Commission for preliminary ap- proval by Mr. Clyde Black, City Engineer. A motion was made by Mr. Withers and seconded by Mr. Stone that preliminary approval be given. The motion carried unanimously. A plat of Oak Forest Addition was presented to the Commission by Mr. Black for final approval. Motion was made by Mr. Withers that final approval be given this addition. The motion was seconded by Miss McCluskey and unanimously ap- proved. Mr. Black presented a replat of Pine Cove Addition for approval by the Commission. The replat was given final approval on motion made by Mr. Phelps and seconded by Mr. Stone. The motion carried unanimously. A petition was received requesting that an alley in Block 11, Forrest Addition be closed. Motion was made by Mr. Withers and seconded by Mr. Stone that it be recommended to the City Council that the alley in Block 11 of the Forrest Addition be closed. The motion carried unanimously. .t. A petition was received requesting that an alley in Block 4A, Cartwright Second Addition be closed. Motion was made by Mr. Withers and seconded by Mr. Phelps that it be recommended to the City Council that the alley in Block l,A of the Cartwright Second Addition be closed. The motion carried unanimously. Mr. Black stated that he had a request from the residents on Perricone Street that Perricone Street be changed to Erie Street. Motion was made by Mr. Phelps and seconded by Mr. Withers that the name of Perri - cone Street be changed to Erie Street. The motion carried unanimously. -000- Mr. Lum Edwards appeared before the Commission and requested that a 30' strip of land in the Calder Addition, between Lots 1, 2, 3, and 4 and the railroad right- of-way in back of Tyrrell Hardware Warehouse and the surrounding area, be abandoned for street purposes. After a lengthy discussion, it was the consensus of the Commission that the matter should be turned over to the Transportation Sub -Committee in charge of streets for study and recommendation to the Commission. -000- Mayor Plummer stated that a definite policy should be worked out in approving new additions regarding streets, curbs, and gutters; whereupon, motion was made by Mr. Stone and seconded -by Mr. Withers that the Legal Department be requested for an opinion at the next meeting of the Planning and Zoning Commission. The motion carried unanimously. There being no further business, the meeting was adjourned by -Chairman Holland. C. B.
