HomeMy WebLinkAboutORD 24-TAN ORDINANCE ENTITLED AN ORDINANCE SELLING TO MAGNOLIA PETROLEUM COMPANY _4.261 ACRES, MORE_ OR, LESS, OF LAND OUT OF 94.5 ACRES OF LAND IN THE DAVID BROWN SURVEY, JEF- FERSON COUNTY., TEXAS, KNOWN AS IHE CASWELL TRACT. AND AUTHORIZING.THE MAYOR AND.THE CITY CLERK TO DEED SUCH LAND TO_THE.MAGNOLIA PETROLEUM. COMPANY, A COR- PORATION. WHEREAS, The City of Beaumont is the owner of a tract of land in the David Brown Survey, Jefferson County, Texas, acquired by general warranty deed from the Trustees of the Caswell Trust, dated the 19th day of September, 1936, recorded in Volume 423, page 227, of,the Deed Records of Jefferson County, Texas, containing ap- proximately 94.5 acres of land and known as the Caswell Tract, reference to said deed is made for a more particular description; and, WHEREAS, by ordinance dated the 7th day of January, 1947, duly passed by the City Council of The City.of Beaumont, said tract has been formally abandoned as a docks and as a site for improve- ments and equipping for such use; and, WHEREAS, the hereinafter described tract of 4.261 acres is a part of said 94.5 -acre tract sometimes known as the Caswell Tract; and, WHEREAS, the Magnolia Petroleum Company, a corporation, has offered to purchase the hereinafter described property for the sum of Ten Thousand Six Hundred Fifty -Two Doll&rs and Fifty Cents ($101,652.50), which is in accord with the appraised value as found by the Beaumont Real Estate Board; and, WHEREAS, the City Council of the City of Beaumont is of the opinion that the said sum is a full, fairand reasonable value of said property-, and, WHEREAS, the City Council is of the opinion that it is to the best interest of The City of Beaumont that the hereinafter described tract of land be sold to Magnolia Petroleum Company for the sum of Ten Thousand Six Hundred Fifty -Two Dollars and Fifty Cents ($101,652.50); and, WHEREAS, the City Council has reached an agreement with the said Magnolia Petroleum Company, a corporation, for the sale and conveyance of the hereinafter described tract to such corporation upon the terms and conditions set forth in adeed conveying said property to said corporation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT the hereinafter described property be sold to Magnolia Petro- leum Company for the sum of Ten Thousand Six Hundred and Fifty-two Dollars and Fifty Cents ($10,652.50), and thatthe Mayor and City Clerk be and they are hereby authorized to execute to Magnolia Petro- leum Company, a corporation, a general warranty deed for the land described and on the conditions and provisions herein specified, to wit: "KNOW ALL MEN BY THESE PRESENTS: THAT The.City of Beaumont, acting herein by and through its Mayor and City Clerk, hereunto duly authorized, of the County of Jefferson, State -of Texas, for and in consideration of the sum of Ten Thousand Six Hundred Fifty -Two Dol- lars and Fifty.Cents ($10,652.50) cash to it in hand paid by Magnolia Petroleum Company, a private corpor- ation, have GRANTED, SOLD and CONVEYED, and by these presents do GRANT,.SELL.-.and CONVEY unto the said Mag- nolia Petroleum Company, a private corporation having an office at Beaumont, Texas, all thatcertain tract or'parcel of land situated in the County of Jefferson State of Texas, a part of the David Brown Survey and a part of.thatcertain tract conveyed by the Trustees of the Caswell Tract to The City of Beaumont by deed dated September 19, 1936, recorded in Volume 423, page 227, Deed Records of Jefferson County, Texas, which deed is here referred to for a more particular descrip- tion, and being more specifically described as follows, to wit: "tBeginning at the southeast corner of the Ori- ginal Caswell Tract, said point being marked by a two (2) inch. pipe; - 2 - �.
