HomeMy WebLinkAboutORD 30-EE-A'�A AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PAR- TICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE.ZONING MAP OF'THE CITY OF BEAU- MONT REFERRED TO IN SECTION 42-9 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 1.045-ACRE TRACT OF LAND OUT OF BLOCK 116 OF GLADYS CITY OIL & GAS MANUFACTURING COMPANY SUBDIVISION, DESCRIBED HEREIN, PRESENTLY ZONED "R-311, TO "C-21t; AND BY CHANGING THE CLASSIFI- CATION OF THE 39.962-ACRE TRACT OF LAND OUT OF THE T. H: LANGHAM SUBDIVISION DESCRIBED HEREIN, PRES- ENTLY ZONED ITR-11t, TO "C-111. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42.-9 thereof, is hereby amended by changing the zoning classification of the following described property presently zoned "R-37., Modified Two. -Family and Multiple Dwelling District, to "C--211, Central Commercial District, to wit: '11.045 Acres, more or less, out of Block No. 116, of the Gladys City Oil, Gas & Manufacturing Com- pany Subdivision in the John A. Veatch -Survey, Jefferson County, Texas, and being described.as follows: Beginning at a point on the West line of Hagner Street, which point is 361.16 feet in a Northwest- erly direction from the intersection of the West line of Hagner Street and the North right -.of. -way line of Loop 251; Thence 177.08 feet South 270 351 East along the West line of Hagner Street to point for -corner; Thence 173.67 feet South 620 �5t West to the North right-of-way line of Loop 251; Thence 243.43 feet North 700 55? West along the North right--of-way line of Loop, 251 to point for corner; Thence 340.75'feet North 620 �51 East to the West line of Hagner .Street, same being the place of beginning; cr and by changing the zoning classification of the following described property presently zoned "R-111, Single -Family Dwelling District, to d 1? 1�1C'1111 ttC-lit, Neighborhood Commercial District, to wit: "A thirty-nine and nine hundred sixty-two thousandths (39.962) acre tract of land out of and being a pant of Lots 5 and 6 of Block C. of the T. H. Langham Sub- division and also being a part of the J. B. Langham, Jr. nineteen and five hundred sixty-four thousandths (19.564) acre tract of land out of Block J of the T. H. Langham Subdivision, all being a part of the H. Williams Survey, Abstract 56, City of Beaumont, Jefferson County, Texas; BEGINNING at a concrete monument marking the South- west corner of Lot 6 of Block-C of the T. H. Langham Subdivision, said beginning corner being located at the point of intersection of the East right. -of -way line of Dowlen Road and the Northwesterly right-of- way line of the Missouri Pacific Railroad; THENCE North sixty-four degrees twenty minutes thirty seconds East (N. 640 201 30" E.) along the South line of Lot 6 of said Block C of the T. H. Langham Subdivision and .being along the Northwest- erly right-of-way line of the Missouri Pacific Railroad and being along the South line of the tract herein described for a distance of one thousand four hundred seventy-five and ninety-two hundredths (1,475.92) feet to a point for corner, being the Southeasterly corner of the tract herein described; THENCE North one degree seventeen minutes West (N. 10 17 t W.) .along the East line of the tra-ct herein described for a distance of one thousand one hundred thirty-five and forty-eight hundredths (1,135.48) feet to a point for corner; THENCE South eighty-eight degrees forty-three min- utes West (S. 88' 43t'W.) along the North line of the tract herein described fora distance of six Hundred thirty and zero hundredths (630.00) feet to a point for corner; THENCE South fifty-four degrees eighteen minutes twenty-three seconds West (S. 540 18? �31T W.) along a Northwesterly line of the tract herein described for a distance of eight hundred twenty-six and forty- six hundredths (826.46) feet to a point for corner; being the Northwest corner of the tract herein de- scribed; said corner being located in the East right- of-way line of.Dowlen Road; THENCE South zero degrees ten minutes thirty seconds West (S. 000 101 30" W.) along the East right -of. -way line of Dowlen Road (a sixty -foot wide right of way) and being along the West line of Lots 5 and 6 of Block C of the T. H. Langham Subdivision and also being along the West line of the tract herein described for a distance of one thousand two hundred seventy- seven and ninety-seven hundredths (1,277.97) feet to the place of beginning,, containing in .area thirty-- nine and nine hundred sixty-two thousandths (39.962) acres of land, more or less;" t. P and the said Official Zoning Map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property herein - above described. shall be subject to all of the applicable regula- tions contained in Chapter..42 of the Code -.of Ordinances of Beaumont, Texas, adopted August 19; 1958-, effective October 19, 1.958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to beseverable and that if the validity of the zoning af- fecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same pen- alties provided for in the said Chapter ¢2 of the Code of Ordinances of Beaumont,.Texas. 1962.
