HomeMy WebLinkAboutORD 21-EEAN ORDINANCE ENTITLED AN ORDINANCE VACATING AND ABANDONING PORTIONS OF SEVENTEENTH STREET BETWEEN CALDER AVENUE AND NORTH STREET AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING THAT SUCH ABANDON- MENT SHALL IN NO WAY AFFECT CERTAIN EASEMENTS FOR GENERAL UTILITY PURPOSES, DATED MARCH-.13, 1962, AS SET FORTH HEREIN. WHEREAS, a petition signed by the owners of the property abutting that portion of Seventeenth Street lying between Calder Avenue .and NorthsStreet, in the City of Beaumont, Jefferson County, Texas, more particularly, described herein, has been presented to the City Council of The City of`:Beaumont, requesting that portions .of Seventeenth Street be vacated and abandoned; and., WHEREAS, said petition has-been referred to the Planning and Zoning Commission of The City of Beaumont for examination and approval.,, and the same -.has been -approved by said Commission; and.,-- WHEREAC,it appears to the City Council that it is to the best interest of.The . City 'of Beaumont and benefit to the public that the.hereinafter described portions of Seventeenth Street be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the following described portions -of Seventeenth Street in The City of Beaumont, Texas, be, and the same are hereby, vacated and abandoned, and that title to said portionsoof.said vacated and abandoned street shall revert to and become the property of the persons entitled thereto, as provided by law, said portions being described as follows: NO. 1. Being that certain sixty (60) foot wide strip of land known as Seventeenth Street lying between Lot 24, Block 10, and Loi;13, Block 115 all in the -Jarrett Addition to The City of Beau wont, Jefferson County, Texas, said portion ex,. tending from the north line of Calder Avenue north one hundred forty (140) feet to the south line of a.twenty (20) foot wide alley running east and west through said Blocks 10 and 11. 4- NO. 2. Being that certain sixty (60) foot wide strip of land known as Seventeenth Street lying between L-ot 13, Block 6, and Lot 24, Block 7, all in the Jarrett Addition to The City of Beaumont, Jefferson County, Texas, said portion extending from the north line of McFaddin Avenue north one hundred forty (140) feet to the south line of a twenty (20) foot wide alley running east and west through said Blocks 6 and 7. NO. 3. Being that certain sixty (60) foot wide strip of land known as Seventeenth Street lying between Lot 12, Block 6, and Lot 1, Block 7, all in the Jarrett Addition to The City of Beaumont, Jefferson County, Texas, said portion extending from the south line of North Street south one hundred forty (140) feet to the north line of a twenty (20) foot wide alley running east and west through said Blocks 6 and 7. NO. 4. Being that certain sixty (60) foot wide strip of land known as Seventeenth Street lying between Lot 1, Block 10, and Lot 12, Block 11, all in the Jarrett Addition to The City of Beaumont, Jefferson County, Texas, said portion extending from the south line of McFaddin Avenue south one hundred forty (140) feet to the north line of a twenty (20) foot wide alley running east and west through said Blocks 10 and 11. Provided, however, that the vacating and abandoning of said portions of said street shall not be construed as abandoning and shall in no way affect the easements f-or general utility pur- poses granted on March 13, 1962 by Brudge Kyle, Scott D. Clark and wife, Lucille Clark, Gilbert L. Walker and wife, Eugenia S. Walker, and Lefco, Inc., a corporation, to The City of Beaumont across property in the Jarrett Addition to The City of Beaumont, Jefferson County, Texas; the rights granted in said easements for general utility purposes being expressly reserved.
