HomeMy WebLinkAboutORD 6-EE/ 1-- 1� __ () ,; AN.ORDINANCE ENTITLED AN .ORDINANCE AMENDING SECTION 38-3 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, TO PROVIDE FOR THE.REGULATION OF THE PARKING, USE AND. OCCUPANCY OF TRAILER COACHES; PROVIDING A PENALTY; PROVIDING FOR SE.VERABILITY, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE. IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That Section 38-:3 of the Code of Ordinances of Beaumont, Texas, be, and the same is hereby, amended to read as follows: "Section 38.-3. Parking outside of trailer parks pro- hibited. (a) It shall be unlawful for any person to park any trailer coach on any street, alley, highway, side- walk or other public place in the city for a longer period than three (3) hours. (b) No trailer coach shall be parked, used or occupied -on any tract of ground within the city limits of Beaumont except in a duly licensed trailer park; provided, however: (1) that any trailer coach now parked upon a tract of ground outside of a duly licensed trailer park may be continued t-o be used and occupied upon such tract of ground so long as the permit from the building inspector, as provided for in subsection (c) of this section, is in force and effect, permitting such use and occupancy; and (2) that the building inspector may permit the parking, use and occupancy of a trail-er coach outside of a duly licensed trailer park for a period of time not exceeding ten (10) days, when such coach is occupied by persons employed in the operation of a temporary recre- ational, amusement, or civic activity. Such temporary parking, use and occupancy of a trailer coach shall be permitted only when the coach is parked on the same premises on which the activity is located and only when adequate sanitary facilities are available upon the premises for the use of the occupants of the trailer coach. (c) A permit shall be required for all trailers now parked outside trailer parks; said permit shall be ob- tained from the building inspector prior to December 31,, 1961; the application for a permit shall be accompanied -- by the payment of a fee of $7.50, which shall cover a period of . three ( 3 ) months from and after the granting of the permit. A fee of $7.50 in advance for each three.(3) months period or part thereof shall be payable thereafter. Application for the permit shall contain a statement of the nature and location ofthe sanitary fa:cilities; a statement that all wart-e water from the trailer coach shall be emptied in the proper sewer fixtures; and the written consent to the location of such trailer coach from any other occupants of the premises upon which such trailer coach is parked. Such permit shall terminate and be- come void and of no effect upon failure of the .trailer coach occupant to pay the fees hereinabove provided for, or upon damage to such trailer coach by.fire, explosion, or any act of God to the extent of 25% of the market value of such trailer coach, or upon the.moving of such trailer coach off of the tractof ground upon which it was located at the time permit was granted. The permit herein provided for is not transferable, and in the event the present occupant moves.from the trailer coach, the permit shall terminate and no permit shall be issued on the trailer coach for a new occupant; once a permit terminates and becomes void, the building inspector shall not issue a new permit on the same trailer coach for oc- cupancy outside .a duly licensed trailer park." 2. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 3. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or -circumstances. should for any,. -reason be held to be invalid, such invalidity shall in no wise affect the remaining Iportions of this ordinance, and to such end various portion's. and provisions of this ordinance are declared to be severable. 4. That all ordinances and parts of ordinances in conflict herewith ar-e hereby repealed. PASSED by the City Council this 2 day of A. D. 1961. Murphy, City Attorney Subject: Date: October 26, 1961 COMMENT: Attached is an ordinance amending our present Trailer _-_ - - Ordinance., -prohibiting the parking of any trailer -coach outside a trailer park, and requiring those now situated outside trail. er parks to obtain a permit, and fixes a monthly fee of $2.50. This is the ordinance we discussed with the City Council some time ago and they thought a change should be made that would permit the occupancy of trailer coaches by carnival work- ers, etc., at the Fair. Since that time we have changed the ordinance to provide that the building inspector may permit the parking of a trailer coach outside a park for a period of time not to exceed ten days, when such coach is occupied by persons who are employed in a temporary recreational, amusement , or civic activity. Inasmuch as we have considerable trouble with trailer coaches in the city, it is urgent that this ordinance be passed at our next meeting.
