HomeMy WebLinkAboutORD 3-EEAN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT,, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICT AS INDICATED UP- ON THE ZONING MAP OF THE CITY OF BEAUMONT REFERRED TO IN SECTION 42--9 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING.THE CLASSIFICATION OF LOTS 1 THROUGH 6 IN BLOCKS 32, 39, 40, 49, 50 AND 56, AND ALL OF BLOCKS 33 THROUGH 38, 41 THROUGH .48, 51 THROUGH 55, AND SCRAP BLOCKS A, B, AND C OF THE NORTHAADDITION; AND LOT 13., BLOCK 25, AND LOT 10, BLOCK 26 OF THE McFADDIN HEIGHTS ADDITION, TO THE CITY OF BEAUMONT,.AS DESCRIBED HEREIN, PRESENTLY ZONED TtR.-3tt, TO 'tR-211; AND BY CHANG- ING THE CLASSIFICATION OF 2.,292- ACRES OUT OF BLOCK 116 OF THE GLADYS CITY OIL, GAS & MANUFACTURING COMPANY SUB- DIVISION IN THE JOHN.A. VEATCH SURVEY IN THE CITY OF BEAUMONT, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-31t� TO 1tC-21t. BE IT ORDAINED BY.THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of'the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the zoning map of The City of Beaumont referred to in ,Section 42-- 9 thereof, is hereby amended by changing the zoning classification of the following described property presently zoned 11R--31t, Modified Two -- Family and Multiple Dwelling District, to 1TR_2t1, Two. -Family and Multi- ple Dwelling District, to wit: Lots 1 through 6, Block 32, all of Block 33, all of Block 34, all of Block 35, all of Block 36, .all of Block 37, all of Block 38, Lots 1 through 6 of Block 39, Lots 1 through 6, Block 40, all of Block 41, all of Block 42, all of Block 43, all of Block 44, all of Block 45, all of Block 46, all of Block 47, all of Block 48, Lots 1 through 6 of Block 49, Lots 1 through 6 of Block 50, all of Block 51, all of Block 52, all of Block 53, all.of Block 54, all of Block 55, Lots 1 through 6 of 'Block 56, Scrap Block A, Scrap Block B, and Scrap Block C, of the North Addi- tion; and Lot 13 of Block 25, and Lot 10 of Block 26 of the McFaddin Heights Addition to The City of Beau- mont; and by changing the zoning classification of the following described property presently zoned "R--371, Modified Two. -Family and Multiple Dwelling District, to "C-211, Central Commercial District, to wit: All that certain tract of 2.5987 acres out of Block No. One Hundred Sixteen (116) of the Gladys City Oil, Gas & Manufacturing Company Subdivision in the John A. Veatch Survey, and being Tract Three (3) of said r Block 116 awarded to Mrs. Oscarine Graham, wife of S. H. Graham by Decree of Partition issued by the District Court of Jefferson County, Texas, in Cause No. 3.7617, styled Rosina P. Davis, et al, vs. D. S. Brackett, et al, recorded in Vol. 16, page 632 of the Minutes of the 60th District Court of .Jefferson County, Texas, to which reference is hereby made for all purposes, SAVE AND EXCEPT therefrom the Tract of 0.3067 acres conveyed by Emmett D. Graham, Independ- ent Executor and Trustee, to the City of Beaumont by Deed dated November 13, 1956, recorded in Vol. 1047, page 168 of the Deed Records of Jefferson County, Texas, and the remaining portion of 2.292 acres con- veyed hereby being described'by metes and bounds as follows: BEGINNING at a point on the West line of said Block 116, located 63.77 f eet.South 27 deg. 35 min. East from the Northwest corner of said Block 116, same also being the Northwest corner of Tract 3 of said Block 116; Thence North 62 deg. 25 min. East along the North line of said Tract 3, 499.52 feet to the Northeast corner of said Tract 3, same being in the East line of said Block 116 and in the West line of Hagner Street; Thence South 27 deg. 35 min. East along the East line of Block 116, and the West line of Hagner Street, 227.53 feet to a point for corner; same being the Southeast corner of Tract 3; Thence South 62 deg. 25 min. West along the South line of Tract 3, 340.75 feet to a point for corner in the North .right"of-way line of Loop 251, same being the most Northerly line called for in the above mentioned deed to the City of Beaumont; Thence North 70 deg. 55 min. West along the North right-of-way line of Loop 251, 231.36 feet to a point for corner in the West line of said Tract 3; Thence North 27 deg. 35 min. West along the West line of said Tract 3, 59.26 feet to the place of beginning, containing 2.292 acres of land; and the said official.zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property herein - above described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted,August 19, 1958, effective October 19, 1958, as amended. -2- r 1. .4 Section 3. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affect- ing any portion .of the property described herei.nabove shall be de- clared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the..same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
