HomeMy WebLinkAboutORD 73-DDa _ AN ORDINANCE ENTITLED AN ORDINANCE VACATING AND ABANDONING AN EASEMENT FOR SEWER PURPOSES WITHIN LOT 4, BLOCK 1, OF THE FULLER-KEITH ADDITION TO THE CITY OF BEAUMONT, SAID EASEMENT BEGINNING IN THE WEST LINE OF SAID LOT 4, ALSO BEING THE EAST LINE OF MAGNOLIA AVENUE, AND EXTENDING EASTERLY TO THE EAST LINE OF SAID LOT 41 SAME BEING THE WEST LINE OF A 30-FOOT ALLEY. WHEREAS, a brick storm sewer and a sanitary sewer line were formerly located within Lot 4, Block 1 of the Fuller -Keith Addition to The City of Beaumont, Jefferson County, Texas, extend- ing from the west line of said Lot 4, also being the east line of Magnolia Avenue, to the east line of said Lot 4, same being the west line of a thirty (30) fo-ot alley; and, WHEREAS, the said sewer lines have now been dismantled and the owner of the said Lot 4 has requested that The City of Beaumont abandon all easement rights that The City of Beaumont had by virtue of the location of such sewer lines within the said Lot 4; and it appears to the City Council that such request should be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the easement for storm sewer and sanitary sewer purposes loca- ted within Lot 4, Block 1 of the Fuller-�-Keith Addition to The City of Beaumont, Jefferson County, Texas, said easement beginning in the west line of said Lot 4, also being the east line of Magnolia Ave- nue, and extending easterly to the east line of said Lot 4. also being the west line of a thirty (30) foot alley, be and the same is hereby vacated and abandoned, and that title to such property shall revert to and become the property of the persons entitled thereto as provided by law; and The City of Beaumont hereby relinquishes any and all right, title and interest it had or might have had in and to such sewer easement. 1961. COMMENT: In compliance with your request of earlier in the week, attached is an ordinance abandoning the easement across the Greyhound property on Magnolia Avenue. (This was requested by Mr. George Ingram.) I understand from Mr. Balmer that the storm sewer and sanitary sewer which were located within the subject property have been sealed or dismantled and they are no longer...used.
