AN ORDINANCE
ENTITLED AN ORDINANCE VACATING AND ABANDONING A
5-FOOT WIDE UTILITY EASEMENT OVER A PORTION OF LOTS
130 ,AND 131, FULLY DESCRIBED HEREIN, IN COLLEGE
ACRES ADDITION TO THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY OF BEAUMONT$ TEXAS:
That the following described 5—foot wide utility easement, to wit:
That certain five (5) foot wide utility easement
granted to the City of Beaumont by Ben J. Rogers in
instrument dated November 25, 1957, and recorded in
Volume 1094, Page 174 of the Deed Records of Jeffer-
son County, Texas, and being two and five tenths (2.5)
feet each side of the following described centerline:
Begin at a point in the south line of Stagg Drive
and on the north line of Lot 131 of College Acres
Addition to the City of Beaumont, Jefferson County,
Texas, at a point forty -»three (43.) feet east of the
Northwest corner of said Lot 131 of College Acres
Addition;
Thence South and parallel with the west line of said
Lot 131 a distance of two hundred ten (210) feet;
Thence East and parallel with the north line of said
Lot 131 to the east line of Lot 131 which is also the
west line of Lot 130 of College Acres Addition to the
City of Beaumont, Jefferson County, Texas;
Thence continuing East and parallel to the north.line
of said Lot 130 to the east line of said Lot 130;
in The City of Beaumont, Jefferson County, Texas, be, and the same is
hereby, vacated and abandoned, and that title to such property shall
revert to and become the property of the persons entitled thereto as
provided by law; and The City of Beaumont hereby relinquishes any
and all right, title and interest it had or might have had in and to
such utility easement.

RE: Release of Utility Easement
Gentlemen:
May 16, 1961
Enclosed please find a copy of a utility easement (marked Exhibit
"A" for your identification) over a portion of lots 130 and 131 College
Acres Addition, City of Beaumont, Jefferson County, Texas.
The owners of the property request the City of Beaumont, Texas to
release and abandon this easement. The reason for this request is that
no facilities have been installed within the limits of the easement as
outlined by Exhibit "All and all the utility lines originally planned for
this easement have been installed in a new easement as shown on Exhibit
ttBtt attached hereto.
Pirther, the easement as set out in Exhibit "B" has been dedicated
to and accepted by the City of Beaumont for the purposes originally
planned for Exhibit ttA".
I have enclosed a drawing marked Exhibit "C" which shows both ease-
ments in question and their relation to one another. The area in red
and marked Exhibit "Alt is the easement we wish to abandon.

that they have no objection to the abandonment of said easement. Also

this matter that you had previously sent this office.
This matter is now in order for presentation to the Planning
Commission for their recommendation.

We have examined, in the field, the five foot utility easement on
Lots 131 and 130 of the College Acres Addition to the City of Beaumont.
We do not have any distribution facilities in this easement nor do we
contemplate placing any there in the future as we have obtained other
easements in a different locality which will enable us to serve future
customers on the above -mentioned lots.
Therefore, we have no objection to this easement being abandoned.
