ENTITLED AN ORDINANCE REPEALING.AN ORDINANCE PASSED.
BY THE CITY COUNCIL OF THE. CITY OF BEAUMONT ON THE
13TH DAY OF DECEMBER, 1960, AND ENTITLED: "AN .ORDI-
NANCE AUTHORIZING THE PROPER OFFICIALS OF THE CTTY OF
BEAUMONT TO EXECUTE AN EASEMENT TO MISSOURI PACIFIC
RAILROAD.COMPANY TO CONSTRUCT, MAINTAIN AND OPERATE A
RAILROAD UPON A TRACT OF LAND OUT OF THE NOAH TEVIS
SURVEY ADJOINING LOT 7 IN BLOCK 15 OF THE VAN WORMER
SECOND ADDITION TO THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, AS DESCRIBED HEREIN," AND ENACTING IN
LIEU THEREOF AN ORDINANCE AUTHORIZING THE PROPER OFFI-
CIALS OF THE CITY OF BEAUMONT TO EXECUTE AN EASEMENT
TO MISSOURI PACIFIC RAILROAD COMPANY TO CONSTRUCT,
MAINTAIN AND OPERATE A RAILROAD UPON A TRACT OF LAND
OUT OF THE NOAH TEVIS SURVEY AS DESCRIBED HEREIN.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
1.
That the ordinance passed by the City Council of The City of
Beaumont on the 13th day of December, 1960, and entitled:

CITY OF BEAUMONT TO.EXECUTE AN EASEMENT TO MIS50URI
PACIFIC RAILROAD COMPANY TO CONSTRUCT, MAINTAIN AND
OPERATE A RAILROAD UPON A TRACT OF LAND OUT OF THE NOAH
TEVIS SURVEY ADJOINING LOT 7 IN BLOCK 15 OF THE VAN
WORMER SECOND ADDITION TO THE CITY OF BEAUMONT, JEFFER-
SON COUNTY, TEXAS, AS DESCRIBED HEREIN"
be, and the same is hereby, repealed.
2.
That the Mayor be, and he is hereby, authorized to execute and
deliver for and on behalf of The City of Beaumont to Missouri Pacific
Railroad Company, an easement to construct, maintain, or operate.a
railroad and all accessories, including Western Union polo lines, and
all signals and signal lines upon the following described land situa-
ted in The City of Beaumont, Jefferson County, Texas, to wit:
The City of Beaumontt-s right, title and interest in the
property which is now held, possessed and used as rail. -
road right of way by the Texas and New Orleans Railroad
Company, and which property is subject to an easement
now held by Texas and New Orleans Railroad Company, such
property hereby quitclaimed being adjoining and adjacent
to the following described property:
A tract of land out of the Noah Tevis Survey adjoining
Lot No. 7 in Block No. 15 of the Van Wormer Second Addi-
tion to The City of Beaumont, Jefferson County, Texas,
as follows:
Beginning at the southeast corner of Lot No. Seven
(7) in Block No. Fifteen (15) of the Van Wormer Second
Addition to The City of Beaumont, Jefferson County,
Texas;
Thence south along the west line of Thirteenth Street
extended 69 feet, more or less., to the north right -of"
way line of the T&NO Railroad Company;
Thence in a westerly direction along the north right.-
-of. -way line of the T&NO Railroad Company a distance. of
141.1 feet, more or less, to stake for corner;
Thence north and parallel to Thirteenth Street extended
$6.7 feet, more or less, to the southwest corner of Lot
No. Seven ( 7 ) in, Block No:, Fifteen (15 ) of the Van Wormer
Second Addition;
Thence east along the south line of Lot No. Seven (7)
in Block No. Fifteen (15) of the Van Wormer Second Addi-
tion 140 feet, more or less, to the place of beginning;
and the City Clerk is hereby authorized to attest to said instrument
and to affix the seal of The City of Beaumont thereto.
