AN ORDINANCE
,ENTITLED. AN ORDINANCE VACATING AND ABANDONING THAT
PORTION OF LANGHAM ROAD. FULLY DESCRIBED HEREIN BY
METES AND BOUNDS, SUBJECT, HOWEVER, TO. THE.DRAINAGE
DITCH EASEMENT WITHIN SAID RIGHT OF WAY.
WHEREAS., in furtherance of the overall plan of straightening
Langham Road at its intersection with College Street, the County of
Jefferson, acting through its Commissionerst Court, accepted the con-
veyance of a new right of way of the southerly portion of Langham
Road lying north of College Street and in return therefor quitclaimed
to Junker Spencer and W. F. Langham, the owners of the entire tract
out of which the two rights of way were taken, that portion,of Langham
Road described herein; and,
WHEREAS, said transaction between the County and the owner of
the real estate took place prior to the time Langham Road was in the
city limits . of The City of Beaumont; .and,
WHEREAS, the new section -of Langham Road is being constructed
by the County and the property owner and same will straighten out
Langham Road at its intersection just north of College Street and will
become a part of the street system of The City of Beaumont; and,
WHEREAS., it appears to the City Council that it is to the best
interest of The City of Beaumont -and benefit to the public that the
new portion of Langham Road be accepted and that the old portion of
Langham Road as described below -be vacated and abandoned; and,
WHEREAS, it appears that a drainage ditch may exist within the
right of way of that portion of Langham Road which is to be abandoned
and which is described herein, and it is the intention. of the City
Council to except from this instrument any portion of a .drainage ditch
as may now exist, and the City Council does not by this ordinance
attempt to vacate and abandon the drainage ditch and any other utilities
within said right of way;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT,
Texas;
That that certain roadway described as follows:
Beginning at a point on the north right-of-way line
of Highway'90 which bears North 89 degrees 48 minutes
East 212.3 feet from .a 3/4" iron pin for the southwest
corner of lot 30 of Westwood Addition;
Thence North 48 degrees 02 minutes -West. 58.5 feet
along the existing west right of way of the Langham
Road to a point for corner;
Thence North 38 degrees 37 minutes West.15.3 feet to
a point for corner in.the proposed East right-of-wayline of Langham Road;
Thence North 20 degrees 48 minutes West 249.8 feet
along said proposedrightrof•.way line to a.point for
corner in the existing east right-of-way line of Lang -
ham Road;
Thence South 38 degrees 3.7 minute.s East 250.8 feet
along said East right-of-way line of Langham Road to
a point for corner;
Thence South 48 degrees 02 minutes East 117.7 feet
toa. point for corner in the north right-of-way line
of Highway 90;
Thence. South 89 degrees 49 minutes West along said
right -of --way line 89.2 feet to the place of beginning
and containing 0.466 acre of land, more or less,. -
be., and the same is hereby, vacated and abandoned, and the title to -
such roadway shall revert'to and become the property of those persons.
entitled thereto as provided.by law; providing that the vacating and
abandoning of said roadway is not i.nt.ended-as.a relinquishment of and
shall in no way affect the right, title and interest of The City of
Beaumont and/or Drainage Ditch No.® 6 in and to.any portion of a drain-
age ditch which may lie within the said right of way as above described;
and.further, any utilities which are now within said right of way are
excepted and preserved to th-e public.
