ON AND AFTER MARCH 31, 1.960. WHEREAS, Gulf States Utilities Company on 1960, has requested authority to cancel its Rate Schedule 321-T, Auxiliary or Standby Service to any business within the City of Beaumont, there being no customers served under such schedule. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That Gulf States Utilities Company is hereby authorized to cancel as of March 31, 1960 in Beaumont, Texas., its Rate Schedule 321.-T, Auxiliary or Standby Service. No customers are served under such schedule in the City of Beaumont. Section 2. That nothing in this ordinance contained shall be construed in any manner now or hereafter limiting or modifying the right and power of the City Council under the law to regulate the rates charged by Gulf States Utilities Company for its services within the City of Beaumont. .PASSED by the City -Council this the A. APPLICABILITY This schedule is applicable under the regular terms and conditions of :the Company and the conditions specified in Section IX to Service of Customers who have equipment operated by means other than the Company's service for the same purposes as equipment operated by the Company's service, when all service is taken through a single meter. II. RATE First 200 kwhr used per month @ 5.850 per kwhr Next 400 kwhr used per month @ 4.700 per kwhr ''Next 3,300 kwhr used per month @ 3.500 per kwhr *Additional kwhr used per month @ 2.900 per kwhr *However, all kilowatthours used per month in excess of 200 kilowatthours per kilowatt of -load, or 1,000 kilo- watthours, whichever is greater, but only such excess kilowatthours, shall be billed at 1.700 per kwhr. III. FUEL ADJUSTMENT The charge per kilowatthour in any month is increased or decreased at the rate of 0.0130 per kwhr per 10 corresponding variation in the average cost of fuel above 14.50 per million BTU or below 13.50 per million BTU during the preceding month. The resulting adjustment per kwhr will be rounded off to the nearest whole multiple of 0.0010. The average cost of fuel will be determined on the basis of units :generating electric energy only, excluding the special generating facilities to furnish the requirements of the steam products customers. IV. DETERMINATION OF LOAD For customers with connected loads of 5 kilowatts or less, billing under Section II will be based on connected load. The load will be the total of the nameplate ratings of all motors or other current consuming devices connected. For customers with connected loads in excess of 5 kilowatts, billing under Section II will be based on measured load. The load will be the greatest average number of kilowatts used during any thirty (30) minute interval of the current month. V. PHASE AND VOLTAGE OF SERVICE Service will be rendered at the Company's standard phase and voltage available at the point of service. VI. METERING If both single-phase and three-phase service are taken, Customer's wiring must terminate at a common metering point in order that service will be measured by a single meter or metering equipment. VII. MINIMUM CHARGE $3.10 per month per kilowatt of installed load, but not less than $3.10 per month. This minimum charge will apply to all Customers billed under this schedule whether billing under Section II is based on connected or measured load. VIII. TAX ADJUSTMENT . The monthly bill will be adjusted for any new or increased taxes on revenue, load and/or energy or which other- wise can be directly allocated to the service hereunder, levied on or after January 1, 1958. IX. CONDITIONS OF SERVICE Customers having generating equipment shall arrange their wiring by means of double -throw switches or other suitable devices so that their equipment cannot create a hazard on the Company's lines by energizing the same. The Cus- tomer assumes all responsibility for injuries or damage resulting from the energizing of the Company's lines by Customer's equipment, and it is a condition of the Company's service under this Schedule to -which the Customer agrees by acceptance of service hereunder, that the Customer will protect and save the Company harmless and indemnified from -injury or damage to persons or property occasioned by the energizing of the Company's lines by Customer's equipment. In the event that Customers decrease or increase the size of their installed loads, they shall advise the Com- pany immediately in writing of such change in order that the Company may adjust its minimum charge accordingly.
