AND.REP.EALING CONFLICTING ORDINANCES. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: I. That Section 42.-2 of the Code of Ordinances of Beaumont, Texas, is hereby amended to read as follows: - 'Section 42-2. Planning and Zoning Commission —.Creations membership, management of department'of city planning -and zoning. "There is hereby created and established.within and for the city, a department to be known as the department of city planning and zoning which shall, subject to the jurisdiction .of the city council, be :under the control and management of the Beaumont City Planning and Zoning Commission, which..commission shall be composed of nine.(9) members, whose offices are hereby created and established. ."The members of the City Planning and Zoning Commission shall be resident citizens,. owners of real-estate in the city, taxpayers and qualified voters,of_ this city. The members of the City Planning. and Zoning Commission shall be appointed by the city council. Of the nine members appointed, three ,(3) shall be appointedf.or a term of three (3)years beginning on August 1, 1960,.three (3) shall be ap- pointed for a term of two (2) years beginning on -August. 1,.: 19.60, :and three (3) shall beappointed for'a-term of one (1) year beginning on A'agust 1, 1960. Thereafter the term of office of each commissioner shall be for three (3) years, or until a successor is appointed. The city council shall name,.one of the commissioners as chairman and one as vice chairman of the commission. "Vacancies occurring on the .City Punning and Zoning Commis- sion shall be filled by appointment.by the city -council for the ' unexpired term of the commissioner being replaced. "The members of the City Planning and Zoning Commission, in the performance of their duties as such, shall serve without compensation.'i II. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance small be, and the same are hereby, repealed.
