HomeMy WebLinkAboutORD 56-CCi AN ORDINANCE AN ORDINANCE AUTHORIZING THE VACATING AND ABANDON- ING OF.ALL ALLEYS IN BLOCK 141 OF.PINECREST ADDI- TION TO THE CITY OF BEAUMONT, TEXAS. WHEREAS, a petition signed by the owner of all of Block 141 of Pinecrest Addition to The City of Beaumont, has been pre- sented to the City Council of The City of Beaumont, requesting that all alleys in said Block 141 be vacated and abandoned; and, WHEREAS, it appears to the City Council that it is to the best interest of The City of Beaumont and benefit to the public that said alleys in Block 141 of Pinecrest Addition be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAU- MONT, TEXAS: That all alleys in Block 141 of Pinecrest,Addition to The City of Beaumont be, and the same are hereby, authorized to be vacated and abandoned, and that title to said vacated and abandoned alleys shall revert to and become the property of the party entitled there- to, as provided by law. 1959. BEAUMONT T E X A S We have checked in the field the ten foot alley running north. and south in Block #141 of Pinecrest Addition and also the twenty foot alley running east and west in the.same block and the same addition. At the north,end of the ten foot alley adjacent to Hayes Lane, we have a terminal pole on which our conductors dead- end coming out of the alley on the north side of Hayes Lane and on this terminal pole, we have a down guy to keep the pole from falling into Hayes Lane. We have examined a replat of Block #141, Pinecrest Addition, made by George. J. Schaumburg dated September.11, 1959 which would keep this present ten foot alley open for a distance of sixty-four feet from' the south property line of Hayes Lane to a new fifteen foot utility easement running east and west. Unless some similar replat was obtained or adopted by the City Planning & Zoning Commission, we do not see how we could allow the present ten foot al1.ey from Hayes Lane to Utica Street to be closed. As to the twenty foot alley or utility easement running east and west from Bethlehem Street to the above mentioned ten foot alley being closed, we do not offer any objection whatsoever and meets with the approval of this company. Martin City Erigineer City of Beaumont Beaumont, Texas This refers to your letter of September 16, concerning the petition of the owners of Block 1413 Pinecrest"Addition, in which they request that the easements be abandoned. At the present time, we area using a portion of the easement at the rear of Lots 4, 5, 6 and 7 for an anchor to sup- port our facilities extending north of Hays Street in the matching ease- ments in this direction. It had been our plan to use this easement to serve Lots 4, 5, 6 and 7 when houses were constructed on them. However, it is our understanding that the of-mers now plan to replat this block so that a 68 foot lot will face on Cleveland and a similar width lot will face on Bethlehem, and six, 50 foot lots will face on Utica Street. If this is the intention, we will wish to retain the existing easement for a distance equal to the width of the lot facing on Cleve- land and will also need a five foot new easement of the same length off the back of the 68 foot lot facing on Bethlehem Street. In addition, we will require an additional 30 feet for anchor purposes. This will result in the retention of 98 feet of the present existing easement. It is assumed that the normal 15 foot easement will be provided at the rear of the lots to be replatted to face on Utica. That your petitioner desires that said alleyways be closed by an ordinance enacted by the duly authorized officers of the City of Beaumont so that petitioner could make more beneficial use of said land. 3. That said block is unimproved and that said ordinance would not act 'to the detriment of any other persons, natural or artificial. NOW, THEREFORE, your petitioner, French Improvement Company, requests that this petition be presented to the City Council of the City of Beaumont, Texas, and that said City Council<cenact and pass an ordinance closing all of the alleys in the said Block 141 of the Pinecrest Addition to - the City of Beaumont, Jefferson County, Texas.
