HomeMy WebLinkAboutORD 11-CC6"q � q_Q7 t AN ORDINANCE ENTITLED AN ORDINANCE VACATING AND ABANDONING CERTAIN UTILITY EASEMENTS LOCATED IN THE ALLEY OF BLOCK TWO (2), PEAR ORCHARD ADDITION, AND IN. THAT PORTION OF THREAD NEEDLE STREET -BETWEEN BLOCKS TWO.(2) AND THREE (3) OF PEAR ORCHARD ADDITION TO.THE.CITY OF BEAUMONT, TEXAS. WHEREAS, an application was filed by Stadium Center, Inc. with the Planning and Zoning Commission for the vacating and aban- doning of certain utility easements located in the alley of Block Two (2), Pear Orchard Addition, and in that portion of Threadneedle Street between Blocks Two (2) and Three (3) of said Pear Orchard Addition to The City of Beaumont, Jefferson County, Texas; and, WHEREAS, consideration was given the abandonment of these easements by the Planning and Zoning Commission and approved by said Commission; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the utility easements in the alley of Block Two (2), Pear Or- chard Addition, and in that portion of Threadneedle Street between Blocks Two (2) and Three (3) of said Pear Orchard Addition to The City of Beaumont, Jefferson County, Texas, be, and the same are here- by, vacated and abandoned, and that the title to such property shall revert to and become the property of the persons entitled thereto, as provided by law, and The City of Beaumont hereby relinquishes any and all right, title and interest which it had -or might have had in and to such utility easements. We have checked with all utility departments and none of them have any facilities in the said alley and street and have no objections for vacating and abandoning same. %is request is necessary for the reason said easements interfere with the constructing of improvements and other facilities for a shopping center. There is no vrater line at present in either the alley referred to or the portion of Threadneedle Street referred to. Therefore, we have no objection to the above street and alley being abandoned without any reservations.
