WHEREAS, The City of Beaumont is the owner of the following -property, -constituting the City- Abattoir; Ten (10) acres out of the -James* W. Bullock Survey, beginning , at -.'an -iron stake,. which is the East line-of**a survey now owned by Thos. H-. Langham at "-its intersection with the east boundary - line..of the, night. of way. of the Gulf. Interstate Railway Company;'thence with said eastern boundary line ---South 1325.66 feet to - corner;- thence North -48 -degree-s � West 885;7- f eet .to corner in the Eastern boundary line of the Gulf cc Interstate Railway Company right of way .North 42 degrees East 983,65 feet to the place of.beginning., Lots 16 and, 1'7 'in 'Block 5, and Lot 18 in Block 6 . of the, West Oakland Addition; - Together. with. -all buildings,- structures,- mach- ; finery and equipment located. thereon; and, WHEREAS, in compliance with the provisions .of the Charter -of The -City of Beaumont, .the City Council authorized the City Clerk to .advertise for bids for the said of said property; and, WHEREAS, in compliance with- the notice .to bidders, the bids were publicly opened on May 18, 1948, and the City Council 'was of -the opinion that the bid' of Frank J. Zummo ( doing business as Zummo -Meat C ompany) in . the -sum of $78, 000.00 cash was the best bid and the one that should be accepted; and, WHEREAS, in further compliance with the terms of the Charter of The City of Beaumont and in accordance with the notice to bidders, the City Council on the 25th day of May, 1948, passed an ordinance calling for a special election to be held on the 15th day of June, 1948, for the purpose of sub- mitting to the voters of The City of Beaumont the question of whether or not The City of Beaumont should sell the Abattoir Property to Frank J. Zummo (doing business as Zummo Neat Company) for the said sum of $78,000.00 cash; and, WHEREAS, at said special election held on the 15th day of June, 1948, the majority of the qualified voters at said election approved the sale of the Abattoir Property to Frank J. Zummo (doing business as Zummo Meat Company) for the sum of $78,000.00 cash; and, WHEREAS, all of the terms of the sale have been complied with by the said Frank J. Zummo, and the City Council is of the opinion that it is to the best interest of The City to complete said sale; NOW, THEREFORE, BE IT .ORDAINED BY THE CITY OF BEAUMONT: That the Abattoir Property be sold to Frank J, Zummo (doing busi- ness as Zummo Meat Company) for the sum of $78,000.00 cash, said property being described as follows; Ten (10) acres out of the James W. Bullock Survey, beginning at an iron stake, which is the East line 'of a survey now owned by Thos. H. Gentlemen: I hereby submit my bid to purchase the Beaumont City .Abattoir to include all land, buildings, stazuctures, machinery, and equipment located on ten (10) acres more or less out of the James W. Bullock Survey, and also three (3) lots as adverti-sed for sale on May 10, 1948 by the said City of Beaumont, Texas. My offer for the above mentioned properties is 078 000.00 cash, represented by my earnest money in the amount of J7800.00, which represents ten (10%) per cent of said bid as set forth in requirments of Notice to Bidders.
