HomeMy WebLinkAboutORD 23-RAN ORDINANCE AN ORDINANCE ACCEPTING OFFER OF CHARLOTTE DAVIS CALLAHAN TO PURCHASE CERTAIN PROPERTY AND AUTHORIZING PROPER CITY OFFICERS TO EXECUTE AND DELIVER QUITCLAIM DEED TO PURCHASER OF SAME: PREAMBLE WHEREAS, on the 6th day of June, 1939, in Cause No. 26176, in -the District Court of Jefferson County, Texas, the City of Beaumont, as Plaintiff, recovered judgment against Maude C. Davis Brewer and Glias Brewer, defendants,for the sum of Two Thousand One Hundred Thirty-eight and 95/100 Dollars ($2,138.95), together With foreclosure of its tax lien for the years -1925, 1926, 1930, 1931, 1932, 19331 19341 19351 1936 and 1937, upon the following described property, to -wit: Being known on the records of the Tax Assessor and Collector of the City of Beaumont as Tract Three (3), Plat S, of the 52-N Tevis Survey in the City of Beaumont, and more particularly described as f ollows: Beginning on the West line of the F. A. Land one- eighth acre tract 18 feet North of its Southwest corner; thence North 134 feet to corner; thence East 120 feet to corner; thecne South 134 feet to corner; thence West 120 feet to place of beginning, being the same tract of land conveyed by deed dated May 1st, 1920, from Ida H. Shepard to Maude C. Davis, recorded in Volume 193 page 200 of the Deed Records of Jefferson County,,Texas; and WHEREAS, in said judgment in the above entitled and numbered cause, the State of Texas and County of Jefferson, as Intervenors, recovered judgment against the above named defendants for the sum of One Thousand Eighteen and 45/100 Dollars ($19018.45), together with foreclosure of their tax liens for the years 1925, 19269 19299 19308 19311 1932, 1933, 1934, 1935, 1936 and 1937 upon the above described property, to -wit: and WHEREAS, &W-of,'September, 1939, an Order of Sale was issued on said judgment, directing the Sheriff of Jefferson County, Texas, to levy upon the above described property and to sell the same at public auction in satisfaction of said judgments; and WHEREAS, pursuant to said Order of Sale, 411. tN. Richardson, Sheriff of Jefferson County, Texas, did on the 7th day of November, 1939, being the first Tuesday of said month, sell the above described property at public auction at the Court House door of Jefferson County, Texas, at which sale said property was struck off to the City of Beaumont, for itself and as Trustee for the State of Texas- ana County of Jefferson; and WHEREAS, on. the 7th day of November, 1939, 141. Vl. Richardson, Sheriff as aforesaid, executed a Sheriff's Deed, conveying to the City of Beaumont; for itself and as Trustee for the State of Texas and County of Jefferson, all the estate, right, title, and interest which the said Maude C. Davis Brewer and Glias Brewer,defendants, had on the 6th day of June, 1939, or at any time afterwards, in and to the above described property, which deed was duly filed for record in the, office of the County Cleric on the 9th day of March, 1940, and recorded in Volume 454 page 271 of the Deed Records of Jefferson County, Texas; and WHEREAS, Ch arlotte Davis Callahan has offered to purchase all of the right, title,interest, claim, estate and demand of the City of Beaumont and the State of Texas and County of Jefferson in the above described property for the sum of Three Thousand, Six Hundred T hirty-five and 20/100 Dollars ($3,635.20); and WHEREAS; in compliance with Article 7345-b, Section 9, Revised Civil Statutes of the State of Texas, the City of Beaumont has procured the written consent of rIT. T. Blackmon, Tax Assessor -Collector of Jef- - ferson County, Texas, and of E. S. Pritchard, Special- Tax Collector of Jefferson County, Texas, to the sale of the abovedescribed property for said amount; and AtHEREAS, the City Commission is of the opinion that such s al e is for the best interest of the City of Beaumont and should be consummated. Now, therefore, be it Ordained by the City Commission of the City, of Beaumont: That the aforesaid offer to purchase the above described property is hereby accepted, and the Mayor and City Clerk are hereby authorized to execute and d eliver on behalf of the City of Beaumont, for itself and as Trustee for the State of Texas and County of Jefferson,, a quitclaim deed conveying unto Charlotte Davis Callahan, as her separate property and estate, all of the right, title, interest, claim, estate and demand of the City of Beaumont and of the State of Texas and County of Jefferson in the aboverdiscribed property derived by reason of said Sheriff's Deed;,:,.
