OF BALLOT; PROVIDING FOR NOTICE OF SAID ELECTION WHEREAS, on the 9th day of July, A. D., 1946, the City Commission of the City of Beaumont passed an ordinance entitled and, "ENTITLED AN ORDINANCE FIXING RENTALS TO BE PAID BY THE WATER VIORKS DEPARTMENT OF THE CITY OF BEAUMONT AS RENTAL FOR THE USE OF THE STREETS, HIGHWAYS, EASEMENTS, ALLEYS, PARKS OR OTHER PUBLIC PLACES WITHIN THE CORPORATE LIMITS OF THE CITY OF BEAUMONT, TEXAS, AND DESIGNATING THE TIME WHEN SUCH PAYMENTS SHALL BE MADE AND OFFICER TO WHOM THE SATE SHALL BE PAID" WHEREAS, on the 16th day of July, A. D. 1946, the City Commission of the City of Beaumont passed an ordinance entitled "AN ORDINANCE FIXING THE RATES TO BE CHARGED BY THE CITY OF BEAUMONT TO PERSONS, FIRMS AND CORPORATIONS USING ITS SM[IVERA x _ T VIES, PUMPS ,AND SYSTEM., OR ANY PORTION THEREOF; DEFINING CERTAIN WORDS AND PHRASES; PROVIDING SCHEDULE OF CHARGES AND METHOD OF DETERMINING CHARGE; PROVIDING SCHED- ULE OF CHARGES FOR USERS LOCATED OUTSIDE CITY LIMITS; PRO- VIDING DUE DATE OF CHARGES, AND WHERE PAYABLE; PROVIDLNG FOR DISCONNECTING SEWERAGE CONNECTION FOR FAILURE TO PAY SEETMAGE CHARGE., AND IMPOSING DISC ONNEC T II\TG AND C ONNEC T- ING CHARGE, ASSESSING SE ATMAGE CHARGE AGADNTST DESIGNATED PART IES ; PROVIDING SAVINGS CLAUSE, AND, REPEAL LtJG ALL OR- DINANCES R- D1NANCES OR PARTS OF ORD INAC ES INCONSISTENT OR IN C ONFL IC T WITH THIS ORDINANCE" and, WTHEREAS, within thirty (30) days from the passage of the said ordi- nances, ten per cen'c {lOj') of the qualified voters voting at the last preceding regular municipal election filed with the city clerk objections to said ordinances; and, WHEREAS, thereafter the Council of the City of Beaumont approved by a majority vote said ordinances; and thereafter, within the time provided by the charter of the City of Beaumont, an additional fifteen per cent (15%) of the qualified voters voting at the last preceding regular munici- pal election filed with the city clerk a petition requesting that said ordinances be submitted to a vote of the electors of the City of Beauliont I for their approval or rejection; and, WHEREAS, it is the opinion of the City Commission of the City of Beau- mont that the petitioners have complied with the provisions of the charter of the City of Beaumont and that, therefore, the Commission should provide for submitting the questions to the electors at a special election within the time specified by the charter of the City of Beaumont, which said char- ter provision provides that an election shall be held not more than six (6) months or less than thirty (30) days after the receipt by the Commission of the clerk's certificate on the petitions filed with him; and, WELREAS, the charter of the City of Beaumont further provides that if the ordinances, or one of them, be not approved by a majority of those vot- ing thereon, they, or it, shall be deemed repealed, otherwise it shall re- main in force and effect. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COWIISSION OF THE CITY OF BEAUMONT:, 1. That an election be held in the City of Beaumont on the 5th day of November, A. D., 1946, at which election there shall be submitted to the qualified voters of the City of Beaumont the following propositions: PROPOSITION NO. 1 Shall the ordinance passed by the City Commission of the City of Beaumont on the 9th day of July, 1946 fixing a rental to be paid by the Water Works Department of the City of Beaumont for the use of the streets of said city be approved? PROPOSITION NO. 2 Shall the ordinance passed by the City Commission of the City of Beaumont on the 16th day of July, 1946 fixing rates to be charged by the City of Beaumont to persons using its sewerage lines be ap- proved? 2. That said election shall be held in the City of Beaumont at the follow- ing places, to -wit: In the First Ward at: French High School Building Junker School Building Gladys Street Fire Station Averill School Building Dick Dowling Junior High School Building Central Fire Station Edwards School Building St. Anne's School Building -2- In the Second Ward at: Beaumont High School Building (Senior) Fletcher School Building City Hall In the Third Ward at: Jefferson County Courthouse David Crockett Junior High School Building Sabine Pass Fire Station Magnolia School Building South Park Elementary School Building Giles School Building - Hebert School Building 5084 Highland Avenue Ogden School Building That all voters residing in County Voting Precinct No. l .shall vote at the Frencki High School Building; that all voters residing in County Voting Precinct No. 2 shall vote at the Junket School Building; that. all voters re- siding in County Voting Precinct No. 3 shall vote at the Gladys Street Fire Station; that all voters residing in County Voting Precinct No. 4 shall vote at the Averill'.School Building; that all voters residing in County Voting Precinct No. 5 shall vote at the Beaumont High School Building (Senior_); that all voters residing in County Voting Precinct No. 6 shall vote at the Dick Dowling Junior High School Building; that all voters residing in County Vot- ing Precinct No. 7 shall vote at the Central Fire Station; that all voters residing in County Voting Precinct No. 8 shall vote at the City Hall; that all voters residing in County Voting Precinct No. 9, and all that portion of County Voting Precinct No. 50 lying within the boundaries of the City of Beaumont as extended by the election held in the City of Beaumont on the 4th of June, 1946, shall vote at the Fletcher School Building; that all voters residing in County Voting Precinct No. 10 shall vote at the Jefferson County Courthouse; that all voters residing in County Voting Precinct No. 11 shall vote at the David Crockett Junior High School Building; that all voters re- siding in County Voting Precinct No. 12, and all that portion of County Voting Precinct No. 43 lying within the boundaries of the City of Beaumont as extended by the election held in the City of Beaumont on the 4th of June., 1946, shall vote at the Ogden School Building; that all voters residing in County Voting Precinct No. 13 shall vote at the Sabine Pass Fire Station; that all voters residing in County Voting Precinct No. 14 shall vote at the Magnolia School Building; that all voters residing in County Voting Pre- cinct No. 15 shall vote at the South Park Elementary School Building; that all voters residing in County Voting Precinct No. 16 shall vote at the Giles School Building; that all voters residing in County Voting Precinct -3- ((A -A, 11- 9-3 9-3094 No. 17 shall vote at the Hebert School Building; that all voters residing in County Voting Precinct Ido, 18, and all that portion of County Voting Pre- cinct No. 19 lying within the boundaries of the City of Beaumont as extended by the election held . in the City of Beaumont on the 4th of June, 1946, shall vote at the Edwards ,School Building; that all voters residing in that por- tion of County Voting Precinct No. 42 lying within the boundaries of the City of Beaumont as extended by the election held in the City of Beaumont on the 4th of June, 1946 shall vote at 5084 Highland Avenue ; and that all voters residing in that portion of County Voting Precinct No. 47 lying within the boundaries of the City of Beaumont as extended by the election held in •the City of Beaumont on the 4th of June, 1946, shall vote at St. Annets School Building. 3. The following named persons are appointed presiding judges for their respective voting boxes in said wards with the authority to select their own clerks : At the French Nigh School Building, Mrs. N. David 4. - That at said election, said issues shall be submitted separately, and there shall be printed on the ballots to be used in said election the fol- lowing: PROPOSITION NO. 1 ENTITLED AN ORDINANCE FIXING RENTALS TO BE PAID BY THE WATER WORKS DEPARTMENT OF THE CITY OF BEAUMONT AS RENTAL FOR .THE USE OF THE STREETS, HIGHWAYS, EASEMENTS, ALLEYS, PARKS OR OTHER PUBLIC PLACES WITHIN THE CORPORATE LIMITS OF THE CITY OF BEAUMONT, TEXAS, AND DESIGNATING THE TIME VEEN SUCH PAYMENTS SHALL BE MADE AND OFFICER TO WHOM THE SAPS SHALL BE PAID For the ordinance Against the ordinance PROPOSITION NO. 2 AN ORDINANCE FIXING THE RATES TO BE CHARGED BY THE CITY OF BEAUMONT TO PERSONS, FIRMS AND CORPORATIONS USING ITS SEINERAGE LINES, PUMPS AND SYSTEM, OR ANY PORTION THEREOF; DEFINING CERTAIN WORDS AND PHRASES; PROVIDING SCHEDULE OF CHARGES AND METHOD OF DETERMINING CHARGE; PROVIDING SCHEDULE OF CHARGES FOR USERS LOCATED OUTSIDE CITY LIMITS; PROVIDING DUE DATE OF CHARGES, AND WHERE PAYABLE; PRO- VIDING FOR DISCONNECTING SEWERAGE CONNECTION FOR FAILURE TO PAY SEWERAGE CHARGE, AND IMPOSING DISCONNECTING AND CONNECTING CHARGE, ASSESSING SEWERAGE CHARGE AGAINST DESIGNATED PARTIES, PROVIDING SAVINGS CLAUSE, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT WITH THIS ORDINANCE For the ordinance Against the ordinance 5. All voters desiring to vote for the approval of the ordinance fixing a rental to be paid by the Water Works Department of the City of Beaumont as rental for the use of the streets of said city as submitted in Proposition No. 1 shall run a line through and across the paragraph on said ballot con- taining the words "Against the ordinance"; and all voters desiring to vote to repeal said ordinance shall run a line through and across the paragraph on said ballot containing the words "For the ordinance". 6. All voters desiring to vote for the approval of the ordinance fixing rates to be charged by the City of Beaumont to persons using its sewerage lines as. submitted in -Proposition No. 2 shall run a line through and across -5- (�4ctl 0 --le the paragraph on said ballot containing the words `Against the ordinancerr, and all voters desiring to vote to repeal said ordinance shall run a line through and across the paragraph on said ballot containing the words "For the ordinance". 70 Should, at said election, a majority of the qualified voters voting at said election vote against one or both of said ordinances, then said ordinances, or each of them, shall be deemed to have been repealed, other- wise it, or they, shall remain in force. 0 That a copy of this ordinance signed by the mayor of the City of Beau - moot and attested by the city clerk.of the City of Beaumont shall serve as a proper and sufficient notice of said election, and the mayor is -hereby directed to cause a copy of this ordinance, signed by himself and attested by the city clerk, to be posted at each of the places herein designated for holding said election at least thirty (30) days prior to the date of holding said election in the manner required by law.
