OF TWO ALLEYS LOCATED IN BLOCK TWO (2 ) OF THC GLOVER ANDERSON ADDITION TO THE CITY OF BEA MONT, RESERVING HOWEVER, THE RIGHT OF THE CITY OF BEAUMONT - TO CONSTRUCT AND MAINTAIN IN SAID ALLEYS SEWER LINES, WATER LINES AND OTHER UTILITIES AND RESERVING THE RIGHT OF TIE CITY OF BEAUMONT TO GRANT A FRANCHISE RIGHT TO OTHERS TO CONSTRUCT AND MAINTAIN THE UTILITIES HEREIN- BEFORE MENTIONED THROUGH AND ALONG SAID ALLEYS, AND PROHIBITING TIE OBSTRUCTION OF SAME BY ANY BUILDING OR STRUCTURE. WHEREAS, a petition signed by all the property' owners of the lots in Block Two (2) of the Glover Anderson Addition to the City of Beaumont has been presented to the City/Commission of the City of Beaumont, requesting that two (2_)-'a11eYs runnthg through Block Two_ (2) of said addition be vacated and abandone;d.-; and, WHEREAS, said petition has been referred to the City Planning Commission for examination and approval and `the same has been ap- proved by the said Commission; and, W EREAS, said petition >0 : pen duly canvassed and examined by the City -Commission and=hasbe4K:Zound to nave��been signed by all the property owners :iri' said block, and` "it appearing to the City Commission that the request of said property ow ors should be grant- ed and that -an ordinancasshould be enacted vacating and abandoning said alleys, reserving/however, to the City if Beaumont the right to construct and maintain all necessary public utilities in said al- leys or to grant a franchise for the construction and maintenance of such utilities in said alleys; NOW, THEREFORE, BE IT ORDAINE'D BY THE CITY COMMISSION OF THE CITY OF BF AUNT ON T : That the alleys running through Block Two (2) of the Glover Anderson Addition to the City of Beaumont, Texas, be, and the same are hereby authorized to be vacated and abandoned, and that the title to such alleys shall revert to and become the property.of the owners of land in said block bordering on said alleys as provided by law, provided, however, that the vacating and abandonment of said alleys shall in no way affect the right of the City of Beaumont to place and maintain therein sewer, gas or water lines, telephone, telegraph or electric lines, wires, poles and cables, or any other public utility service. Neither shall the vacating and abandon- ment of said alleys affect the right of the City of Beaumont to grant a franchise to any person, firm or corporation authorizing the placing and maintaining in said alleys of such sewer, gas or water lines, telephone, telegraph or electric lines or other public utility service, all of which rights are hereby expressly reserved. And the vacating and abandonment of said alleys shall not be con- strued as authorizing or permitting any person, party, corporation or legal entity whatsoever to erect, construct, build, move on to or place any building or structure -therein, and the erection, con- struction, building, moving on to or placing of any building or structure therein without express permission from the City Commission to do so is hereby prohibited. GEWLaM : We, the undersigned, being the sole owners of all the following pr ope rty : (1) All lots (1 to 8 inclusive) in Block 2 of` the Glover Anderson Addition to the City of Beaumont, Texas, owned by Arthur Dooley & Son, Inc,, - (2) Right of way abutting an alley between Butlin and Brockman Streets on the West line of Block 2 (Lots 5 and 6) of the Glover Anderson Addition, owned by Texas and New Orleans Railroad Company, hereby respectively petition that the following alleys located in and abutting Block 2 of the Glover Anderson Addition be closed in the manner as pennitted by the Statutes of the State of Texas: (1)That certain alley in Block 2 of the Glover Anderson Addition to the City of Beaumont, running East and West between Otey Street and Texas and New Orleans Railroad Company's right of way._ (2) That certain alley running North .and South between Butlin and Brockman Streets lying between Texas and New Orleans Railroad Company's right of way and Lots 5 and 6, of Block 2 of the Glover Anderson Additi on, to the City of Beaumont. That such alley become the absolute property of the owners of the land in said block and abutting on such alley, it being understood,__however, that the closing of this alley shall in no way affect the rights of the City as to placing and maintaining therein of any sewer or water lines, or tele- phone, telegraph, or electric lines, wires, poles or cables or any other service or utility of the City, or the right of the City to grant frau® chises to persons or corporations to place and maintain therein any such sewer or water line, or telephone, telegraph., or electric lines, wires, poles, or cables, or any other service or utility of the City.
