HomeMy WebLinkAboutORD 2-RAN ORDINANCE AN ORDINANCE BY THE CITY C0MMISSION OF THE CITY OF BEAUMONT, TEXAS, AUTHORIZING THE ISSUANCE OF "CITY OF BEAUMONT IMPROVE- MENT REFUNDING BONDS, SERIES OF 1946," $525,000.00, FOR THE PURPOSE OF CANCELLING REFUNDING AND IN LIEU OF A LIKE AMOUNT OF VALID AND SUBSISTING BONDED INDEBTEDNESS OF SAID CITY; PRE- SCRIBING THE FOMI OF THE BONDS AND THE FORM OF INTEREST COU- PONS; PROVIDING FOR THE LEVY, ASSESSMENT AND COLLECTION OF AN ANIqUAL TAX ON EACH ONE HII1gDRED DOLLARS' VALUATION OF ALL TAX- ABLE PROPERTY SITUATED IA11THIN THE TERRITORIAL LIMITS OF THE CITY TO PAY THE PRINCIPAL AND INTEREST ON SAID BONDS AT MA- TURITY; ENACTING PROVISIONS INCIDENT AND REI.A.TING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN - VIERGIl\TCY. WHEREAS, the City of Beaumont, Texas, has heretofore legally issued its bonds known as ItCITY OF BEA*0MONT SEV7ERAGE SYSTEM IMPROVEAM BONDS, SERIES D," dated August 1, 1946, Numbers 1 to 250, inclusive, in the denomination of $1,000.00 each, aggregating $250,000.00, bearing interest at the rate of 2-1/0o per annum, and maturing on August lst, $3,000.00 in each of the years 1947 to 1956, inclusive; $5,000.00 in each of the years 1957 to 1966, inclusive; $7,000.00 in each of the years 1967 to 1976, inclusive; and $10,000.00 in each of the years 1977 to 1986, inclusive; all of which bonds are now outstanding and unpaid; and, WHEREAS, the City of Beaumont, Texas, has heretofore legally issued its bonds knoynm as "CITY OF BEAUMONT FIRE STATION IMPROVE! STT BONDS, SEPSES C," dated August 1, 1946, Numbers 1 to 75, inclusive, in the denomination of $1,000.00 each, aggregating $75,000.00, bearing interest at the rate of 2-1/4% per annum, and maturing on August lst, $1,000.00 in each of the years 1947 to 1961, inclusive; $2,000.00 in each of the years 1962 to 1976, inclusive; and $3,000.00 in each of the years 1977 to 1986, inclusive; all of which bonds are now outstanding and unpaid; and, WEEREAS, the City of Beaumont, Texas, has heretofore legally issued its bonds known as "CITY OF BEAUMONT STREET AND HIGHWAY L)APPROV1+'HENT BONDS, SERIES F," dated August 1, 196, Numbers 1 to 200, inclusive, in the denomi- nation of $1,000.00 each, aggregating $200,000.00 bearing interest at the rate of 2-1/4% per annum, and maturing on August lst, $2,000.00 in each of the years 1947 to 1956, inclusive; $4,000.00 in each of the years 1957 to 1966, inclusive; /"Ld 0 C04 $6,000:00 in each of the years 1967 to 1976, inclusive; and $8,000.00 in each of the years 1977 to 1986, inclusive; all of xThich bonds are noir out- standing and unpaid; and, WHEREAS, the City Commission of the City of Beaumont, Texas, deems it advisable and to the best interest of said City to cancel and refund the above described outstanding issues of bonds by the issuance of one series of refunding bonds in the aggregate principal amount of $525,000.00; noirr--- BE IT ORDAINED BY THE CITY COMN-C1 SSION,OF THE CITY OF BRAUMONT: 1. That for the purpose of cancelling and refunding said $525,000.00 of outstanding bonds hereinabove described, there shall be issued the bonds of the City of Beaumont, Texas, to be known as "CITY OF BEAUgONT IMPROVEi+,+NT REF(LJNDING BONDS, SERIES OF 1946," in the principal sum of Five Hundred Twenty Five Thousand ($525,000.00) Dollars, II. IV. That each of said bonds shall be signed by the Mayor and counter- signed by the City Clerk, and the corporate seal of the City of Beaumont, Texas, shall be impressed upon each of them. That the facsimile signatures of the Mayor and the City Clerk may be lithographed., printed or engraved upon the coupons attached to said bonds and shall have the same effect as if they had been signed by said officers. IT IS EB'L'- CERTIFIED, RECITED AND REPRESENTED that all acts, con- ditions and things necessary to be done precedent to and in the issuance of this bond, and the series of which it is one, in order to make them legal, valid and binding obligations of said City, have been done, have happened and have been performed in regular and due form, time and manner as required by law; that the faith and credit and resources of said City are hereby irrevocably pledged for the prompt payment of the principal of and interest on these bonds at maturity; that due provision has been made for levying and collecting Y ?. It is further ordained that while said bonds, or any of them, are outstanding and unpaid, there shall be annually levied and assessed and col- lected in due time, form and manner a tax upon all taxable property in the City of Beaumont, Texas, sufficient to pay the current interest on said bonds and to create a sinking fund sufficient to pay each installment of the principal as the same becomes due; and to pay the interest on said bonds for the first year and to create a sinking fund with which to pay the principal as the same becomes due, there is hereby levied for the year 1946 a tax of six (6) cents and five (5) mills on each $100 valuation of taxable property in said City and the same shall be assessed and collected and applied to the purpose .named; and while said bonds, or any of them, are outstanding and unpaid, a. tax for each year at a rate from year to year as will be ample and sufficient to provide funds to pay the current interest on said bonds and to provide the necessary sinking fund, to pay the principal, full allowance being made for delinquencies and costs of collection, shall be, and is hereby levied for each year, respectively, while said bonds or any of them, are outstanding All, 6 A4 and unpaid, and said tax shall each year be assessed and collected and applied to the payment of the interest on and principal of said bonds. All moneys in the sinking fund, and all taxes heretofore levied or in process of collection for the benefit of the bonds being refunded by said refunding bonds, shall be and the same are hereby appropriated and transferred to the benefit of the said refunding bonds.. XI. IT IS FURTEER ORDAIBTED that the Mayor shall take and have charge of all necessary records and the bonds herein authorized -pending their investigation by the Attorney General. After the record and the bonds shall have been approved by the Attorney General, the bonds shall be left in the care and custody of the Comptroller of Public Accounts, and the State Comptroller is hereby authorized to accept from A. W. Snyder & Company, or their duly authorized agent, in installments or otherwise, the obligations herein refunded, and, after cancellation thereof, to register a like amount of the bonds herein authorized and deliver same to A. W. Snyder & Company, or their agent. XII. The importance of this measure, and its intent'a.nd purpose being declared to be for the immediate preservation of the public business and property of the City of Beaumont, Texas, and it being to the financial interest of the city to promptly cancel the outstanding bonds herein refund- ed by the issuance and delivery of the refunding bonds authorized by this ordinance constitutes an emergency and an imperative public necessity that the rule requiring ordinances to be read at more than one meeting of the City Commission be suspended, and said rule is hereby suspended, and this ordinance take effect and be in full force immediately from and after its passage and it is so ordained.
