HomeMy WebLinkAboutORD 78-114ORDINANCE NO. 1U / ENTITLED AN ORDINANCE AMENDING SECTION 26-49 OF THE CODE OF -ORDI- NANCES OF THE CITY OF BEAUMONT, TEXAS; PROHIBITING UNAUTHORIZED PARKING IN CERTAIN CITY.PARKING LOTS; PROVIDING FOR VISITOR PARKING; PRO- VIDING FOR PARKING FOR THE MAYOR AND CITY COUNCIL MEMBERS; REGULATING THE MANNER OF PARKING VEHICLES; CREATING' A PRESUMPTION AS TO IDENTITY OF VIO- LATORS; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Chapter 26, Section 26-49 of the Code of Ordinances of the City of Beaumont is hereby amended to read as follows: Section 26-49: Parking.Lots - Municipal Buildings (a) No person shall park a vehicle in the parking lot south of City Hall and fronting on the east side of Main Street between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, unless such vehicle shall have a City of Beaumont parking permit affixed to the rear window thereof or unless such vehicle is parked in an officially designated visitor parking zone. (b) Any person parking a vehicle within such park- ing lot in an officially designated visitor parking zone shall not park such vehicle for a period of time longer than the time period specified on signs which designate visitor parking spaces. (c) No person other than the Mayor or a member of the City Council shall park a vehicle in a space officially designated for the Mayor and City Council members. (d) No person shall park a vehicle in the parking lot immediately south of the Police Building &'-) /1 1C2_1Q_ 19 16� between Pearl Street and Main Street except for vehicles of the Police Department or other bona fide law enforcement.agencies. (e) No person shall park a vehicle in any city parking lot other than within clearly marked parking spaces nor shall any person park a vehicle in an entrance, exit, driveway or aisle, or in any manner which effectively obstructs an entrance, exit, driveway or aisle. (f) In any prosecution charging a violation of this section, proof that the particular vehicle described in the complaint was parked in -.-,vio- lation of this section together with proof that the defendant named inthe complaint was, at the time of such parking, the registered owner of such -vehicle shall constitute in evidence a rebuttable presumption that the registered owner of such vehicle was the person who parked or placed such vehicle in violation of this section. Section 2. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a par- ticular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall in no way affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
