HomeMy WebLinkAboutORD 78-1067 f�J INORDINANCE NO. 000 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAU43NT, TEXAS, BY CHANGING THREE (3) TRACTS OF LAND TOTALLING 1.69 ACRES OUT OF THE FRENCH HEIS ADDITION IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "R-1" TO "LR -1;" PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUNDNT: Section 1. THAT Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned "R-1," Single Family Dwelling, to "LR --1," Local Retail District, to wit: BEING 0.40 acres out of the northwest corner of Lot 70 of French Heights Subdivision in the A. Williams Survey, Jefferson County, Texas, and being more fully described as follows: BEGINNING at a brass plug set in a concrete monument marking the Northwest corner of Lot 70 of French Heights, said corner being in the south line of French Road; THENCE N. 63° - 30'E., at 50 feet passing a stake marking the northeast corner of a parcel of land conveyed to Eugene Jeanis by Lewis Jeanis by deed recorded in Vol. 724, Page 132 of the Deed Records of Jefferson County, Texas, and continuing an additional 50 feet to the northeast corner of the second tract conveyed to Eugene Jeanis by Lewis Jeanis as recorded in Volume 757, Page 367 of the said Deed Records; THENCE S. 340 - 50' E. 200 feet to a stake marking the southeast corner of the second tract conveyed to Eugene Jeanis; THENCE S. 67° - 47' W., 40 feet along the south line of the second tract conveyed to Eugene Jeanis to a stake marking the southwest corner of said tract and also being the southeast corner of the first tract conveyed to Eugene Jeanis; THENCE S. 660 - 49' W., 40 feet to a stake in the west line of Lot 70 of French Heights; • THENCE N. 40° - 43' W.., 200 feet along the west line of Lot 70 of said French Heights Subdivison to the POINT OF BEGINNING and containing 0.40 acres df land: BEING a 0.760 acre tract of land being out of Lot 70 of French Heights Subdivision, in the A. Williams Survey, Beaumont, Jefferson County, Texas, and being more fully described as follows: BEGINNING at a stake in the south line of French Road, said stake being located N. 63° - 30' E., 100 feet from a concrete monument with a brass plug, marking the northwest corner of Lot 70 of French Heights; THENCE N. 63° - 30' E.-, 60 feet along the south line of French Road to a 5/8 inch iron rod set to mark the northeast corner of the tract of land being described; THENCE S. 29- -.30' E., 200 feet to a 5/8 inch iron rod set to mark an interior angle point; THENCE N. 67° -.47' E., at 48 feet crossing the east line of Lot 70 of French Heights and at 61.7 feet reaching a 5/8 inch iron rod set for cornet in the east line of a parcel of land in Lot 71, said parcel of land having been conveyed to Lewis Jeanis by Floyd E. rack by Deed recorded in Vol. 941, Page 99 of the Deed Records of Jef- ferson County, Texas; THENCE S. 7° - 48' E., 89.4 feet along said east line of said parcel in Lot 71 to a point in the north line of Lot 80 of French Heights; THENCE S. 89° - 27' W., 20 feet along the north line of Lot 80 to the northwest corner of Lot 80, said corner being in the east line of Lot 70; THENCE S. 0° - 33' E., 79.9 feet along the east line of Lot 70 to an iron rod set to mark the northeast corner of the parcel of land conveyed by Lewis Jeanis to Gerald Ray Williamson, as re- corded in Vol. 938, Page 363 of the Deed Records of Jefferson County, Texas; THENCE S. 500 - 48" - 30" W., 61 feet along the north line of said parcel to a 1/2"iron rod set in the west line of Lot 70 to mark the northwest corner of the parcel conveyed to Williamson; MENCE N. 400 - 43'-W., 177.95 feet along the west line of Lot 70 to a stake marking the south- west corner of the first parcel of land conveyed to Eugene Jeanis; THENCE N. 660 - 49' E., 40 feet along the south line of said parcel to a stake marking the south- west corner of second tract conveyed to Eugene Jeanis; THENCE N. 67° - 47' E., 40 feet to the southeast corner of the second tract; THENCE N. 34° - 50' W., 200 feet to the POINT OF BEGINNING, and being 0.760 acres. -2- That certain parcel of land situated at the northeasterly corner of Lot Number Seventy (70) and the. northwesterly corner of Lot Number Seventy -One (71) described as follows: BEGINNING at the northeasterly corner of Tract II above described; THENCE along and with the north line of Lot 70 of French Heights Addition north 630 - 30' E., 136 feet to the northeast corner of Lot 70; THENCE continuing 20 feet to a point for corner in the north line of Lot 71; THENCE south 0° - 33' E., crossing the common line between Lots 70 and 71 to a point in the easterly line of Lot 70, and in the northerly line of Tract II above described; THENCE south 671 - 47' W., 61.7 feet to a point, an interior northeast corner of Tract II; THENCE north 29° - 30' W., 198.5 feet along and with the easterly -line of,Tract II to the point of beginning containing 0.53 acres of land. and the official Zoning Map of the City of Beaumont is hereby amended to reflect.such changes. Sei-+ion 2 _ That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations.contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, as amended. Section 3_ That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinafter shall be declared to - be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4.
