HomeMy WebLinkAboutORD 78-390 ORDINANCE N0. 7er-(3 9 • ENTITLED AN ORDINANCE CANVASSING THE I=TMS OF THE REGULAR CITY ELECTION WHICH WAS HELD ON THE 1ST DAY OF APRIL, 1978, AND ORDERING A RUN-OFF ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 15TH DAY OF APRIL, 1978, TO DETERMINE WHO SHALL BE MAYOR; NAMING THE PLACES WHERE SAID ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; PROVIDING FOR THE FORM OF NOTICE THEREOF; PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; DE- CLARING THE NUMBER OF VOTES CAST; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. WHEREAS, 'the City Council of the City of Beaumont, in session duly called the regular City election to be held on the 1st day of April, 1978, and the election returns of the votes cast in said election were canvassed for the following officials: For the officer for -the office of Mayor; For the officer for the office of Councilman for the 1st Ward: For the officer for the office of Councilman for the 2nd Ward; For the officer for the office of Councilman for the 3rd Ward; For the officer for the office of Councilman for the 4th Ward: WHEREAS, after duly canvassing said returns, the City Council found that the votes cast at said election for the several candidates for said offices were as follows: For Mayor: Ken Ritter . . . . . . 5,788 Marion H. Leroy Evans . . . . 10,297 Total votes cast . . . . . . 16,148 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the results of said regular City election be, and the same are hereby, declared to have been as herein set out, and the following named persons were elected to the following offices: For Councilman for the lst Ward: Tom Combs, Jr. For Councilman for the 2nd Ward: Vi McGinnis For. Councilman for the 3rd Ward: Calvin Williams For Councilman for the 4th Ward: J.Leroy Evans The City Council of the City of Beaumont further finds that notice of said election was duly and properly given as required by law and provided in the ordinance calling for said election, and that said election was duly and regularly held and returns thereof were duly and regularly made by the proper officials of said election and in all things according to law. Section 2. That in accordance with the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the 15th day of April, 1978, a run-off election for the purpose of electing an officer for the office of Mayor. That legally qualified voters residing within the corporate limits within the City of Beaumont shall be entitled to a vote at said election. -2- That said election shall be held in the City of Beaumont at the following places and the following named persons appointed presiding judges and alternates for their respective voting boxes, with the authority to select and appoint their awn clerks, to -wit: (See Exhibit "A") The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems neces- sary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for any precinct, who shall be selected from different political parties when practicable. Section 5. That said election shall be held under, and the qualifications of those voting thereat shall be controlled by, the provisions of the State laws governing elections. The form of ballot which shall be used in said run-off election shall be substantially as follows: GENERAL ELECTION CITY OF BEAUMONT JEFFERSON COUNTY, TEXAS APRIL 15, 1978 FOR MAYOR (Vote for One) 0--J-4— In accordance with the provisions of the laws of the State of Texas, Myrtle Corney is hereby appointed Presiding Judge of the Central Counting Station, Tom. Lawrence is hereby appointed Manager of said Central Counting Station, and Raymond McInnis is hereby ap- pointed Computer Coordinator. 0,...4-; .Y,., o In accordance with the provisions of the laws of the State of Texas, an electronic voting system shall be used for voting on the day of election and also for the casting of absentee votes by personal appearance at the City Clerk's office. In accordance with the pro- visions of the laws of the State of Texas, absentee votes by mail shall be counted by a special canvassing board, which shall be composed of E. A. Adams. -3- c;Prt- i nn 9 _ That if any section, subsection, sentence, clause or phrase of this ordinance or the application of saw to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. Section 10. That all ordinances and parts of ordinances in conflict herewith are hereby repealed.
