"2r-(5 2 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEMMNT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAUM3NT, TEXAS, BY CHANGING A 9.09 ACRE TRACT OUT OF THE COLLEGE ACRES ADDITION IN THE DAVID BROWN LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "C-2" TO "I-111; PROVIDING FOR SEVER- ABILITY AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1_ THAT Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in h particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in'Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned "C-2", Central Commercial, to "I-1", Light Industrial, to wit: That certain tract or parcel of land out of the David Brown League, Jef- ferson County, Texas, and also out of College Acres Addition to the City of Beaumont, Jefferson County, Texas, according to map or plat thereof of record in the office of the County Clerk of Jefferson County, Texas, more particularly described as follows: BEGIN at a steel rod in the South line of Lot 139 of College Acres Addition, which beginning point is located South 89 degrees, 59.5 minutes East a distance of 33 feet from the common corner of Lots 98, 99 , 139 and 140 of College Acres Addition; THENCE North 89 degrees 59.5 minutes West along the South line of Lots 139, 140 and 141 of College Acres Addition a distance of 238 feet to a concrete monument marking the com- mon corner of Lots 96, 97, 141 and 142 of College Acres Addition; THENCE South 0 degrees, 0.5 minutes West along the East line of Lot 96 a distance of 268 feet to a monument in the North right-of-way of U. S. Highway 90; THENCE North 85 degrees, 24.5 minutes West along the North line of U. S. Highway 90 a distance of 112.2 feet to a concrete monument marking the intersection of the North right-of-way line of U. S. Highway 90 and the East line of a 40 foot street; THENCE North 15 degrees, 38 minutes West along the East right-of-way line of said 40 foot street a dis- tance of 624.68 feet to a concrete monument and continuing along the East right-of-way line of said street which at this point is 60 feet in width, North 15 degrees, 33 minutes West a distance of 321.92 feet to a concrete monument marking the Southwest corner of a tract of land heretofore conveyed by Theodore W. Berenson.to the Borden Company by deed dated November 19, 1957, re- corded in Volume 1090, Page 50, Deed Records, of Jefferson County, Texas; THENCE.South 89 degrees, 59.5 minutes East along the South line of the afore- said tract of land conveyed to the Borden Company 655.59 feet; THENCE South 0 degrees, 10.5 minutes West a distance of 125 feet; THENCE South 89 degrees 59.5 minutes East a distance of 125 feet to the West right-of-way line of Interstate Highway Number 10; THENCE South 0 degrees, 10.5 minutes West a distance of 214.74 feet to a monument marking the centerline of the former Stagg Drive; THENCE in a Westerly direction along the centerline of the former Stagg Drive 175.5 feet to a marker; THENCE South 0 degrees, 0.5 minutes West, 30 feet to a point in the North line of Lot 139, which point is lo- cated 38 feet East'of the Northwest corner of Lot 139; THENCE continuing South 0 degrees, 0.5 minutes West a distance of 282.50 feet to the place of beginning, and the official Zoning Map of the City of Beaumont is hereby amended to reflect such changes. Section 2_ That in all other respects the use of the property -2- hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the ,Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, as amended. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zona -ng affecting any portion of the property described hereinafter shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That if any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
