N ENTITLED AN ORDINANCE ORDERING A GENERAL MUNICIPAL ELECTION; ORDERING THE GENERAL MUNICIPAL ELEC`T'ION TO BE HELD IN THE CITY OF BEATMONT, TEXAS, ON THE 1ST DAY OF APRIL, 1978, AS PROVIDED BY THE CHAR'I'ER OF THE CITY OF BEALMONT, AND THE STATUTES OF THE STATE OF TEXAS, FOR THE PURPOSE OF ELECTING A MAYOR AND FOUR COUNCILMEN; NAMING THE PRE- CINCTS AT WHICH ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; APPOINTING A CANVASSING BOARD FOR ABSENTEE VOTING; APPOINTING A MANAGER AND JUDGE OF THE CENTRAL COUNTING STATIONS; PRO- VIDING A MANNER OF HOLDING SAID ELECTION; PROVIDING FOR NOTICE THEREOF; PROVIDING FOR A JOINT ELECTION WITH THE BEAUMONT INDEPEN- DENT SCHOOL DISTRICT A,TD THE -SOUTH PARK INDEPENDENT SCHOOL DISTRICT; AND PROVIDING FOR SEVERABILITY. WHEREAS, under the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, a regular general municipal election is required to be held in the City of Beaumont on April 1st, 1978. The election shall be for Mayor, Councilman for Ward One, Councilman for Ward Two, Councilman for Ward Three, and Councilman for Ward Four; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Rpr+i nn 1 _ That in accordance with the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, there shall be in the City of Beaumont on April lst, 1978, the regular municipal election for said City for the purpose of electing a Mayor, a Councilman for Ward One, a Councilman for Ward Two, a Council- man for Ward Three, and a Councilman for Ward Four for said City. Sar, -F i nn 9 _ That legally qualified voters residing within the corporate limits of the City of Beaumont shall be entitled to a vote at said election. 1, .:.t. .:' ..:.1 3 That said election shall be held in the City of -Beaumont at the places as listed in Exhibit "1" attached hereto and made a part hereof for all purposes and the persons whose names appear in Exhibit "2" attached hereto and made a part hereof for all purposes are appointed presiding judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks. (See Exhibits "1" and "2") The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five (5) clerks shall be appointed for any precinct, who shall be selected from different political parties when practicable. Section 4. That said election shall be held under, and the qualifications of those voting thereat, shall be controlled by the provisions of the State Laws governing elections. n--4-: __ That notice of said election shall be given by publishing said notice as set out herein in a newspaper of general circulation in this City and County one time, not more than twenty-five (25) days or less than ten (10) days before said election. Said Notice shall be in the following form: "NOTICE OF THE GENERAL MUNICIPAL ELECTION IN THE CITY OF BEAUMON`I' FOR THE PURPOSE OF ELECTING A MAYOR AND FOUR COUNCILMEN." "Notice is hereby given that the General Municipal Election as provided by the Charter of the City of Beaumont and the Statutes of the State :of Texas will be held in the City of Beaumont, Texas, on the 1st day of April, 1978, from 7:00 A.M. to 7:00 P.M., for the purpose of electing a Mayor and four Councilmen." Said Notice shall also be posted in each election precinct as set out herein in Exhibit "1" at least twenty (20) days before said election. -2- Said Notice shall also be filed with the County Clerk and another copy shall be posted on a bulletin board in the office of the County Clerk at least twenty (20) days before the election. The form of ballot which shall be used in said General Municipal Election shall be.substantially as follows: GENERAL ELECTION CITY OF BEAUMONT JEFFERSON COUNTY, TEXAS APRIL 1, 1978 FOR MAYOR (Vote for one) FOR COUNCILMAN WARD I (Vote for one) FOR COUNCILMAN, WARD II (Vote `for one). FOR COUNCILMAN, TAMRD III (Vote for one) FOR COUNCILMAN, WARD IV I (Vote for one) Section 7. In accordance with the provisions of the laws of the State Of Texas, Myrtle Corgey is hereby appointed Presiding Judge of the Central Counting Station, Tom Lawrence is hereby appointed Manager of said Central Counting Station and Raymond McInnis is hereby appointed Computer Coordinator. Section 8. (A) That in accordance with the provisions of the laws of the State of Texas, an electronic voting system shall be used for I voting on the day of election and also for the casting of absentee I votes by personal appearance at this election. -3- i (B) In accordance with Article 5.05, V.A.T.S. Election Code, Myrtle Corgey is hereby appointed clerk for Absentee Voting. The Clerk for Absentee Voting shall keep her. -offices at said locations open during such hours on each day for absentee voting which is not a Saturday,' a Sunday or an official State holiday. The City Clerk's Office, P. O. Box 3827, City Hall, Beaumont, Texas, shall be the Clerk's mailing address to which ballot applications and ballots voted by mail may be sent. (C) Absentee votes by mail shall be counted by a special canvassing board consisting�of a Presiding Judge and two Clerks. E. i A. Adams is hereby appointed Presiding Judge of the special canvassing board and he shall appoint the two clerks. (D) In order to prevent the casting of more than'one absentee ballot, Absentee Judges are directed to retain the voter registration certificate of each absentee voter and to return the same by mail inmiediately following the election to the address designated by such voter. This election shall be held jointly with the Trustee Election to be held by the Beaumont Independent School District, in the election precincts set forth in Exhibit "A" attached hereto and made a part hereof for all purposes, in accordance with the following terms of agreement between Beaumont Independent School District and the City I of Beaumont: (A) The expenses of the election within joint precincts shall be divided with the City of Beaumont paying that part of said expenses represented by a ratio of the number of voters voting in the Municipal Election to the total number of voters voting in both the School District and the Municipal Election in said joint precincts. (B) A single ballot form shall be used which shall contain the Mayor and Council positions to be voted upon as well as the offices and propositions required by the School District. -4- 19 3 (C) The above named election officers shall conduct both elections in said election precincts. (D) Records for both elections shall be combined. (E) One set of ballot boxes and stub boxes for both elections shall be used. (F) Election returns shall be made on joint forms but the City Council of the City of Beaumont shall canvass the returns of the General Municipal Election. (G) The City Clerk of the City of Beaumont is designated custodian of all records and of the voted ballots. This election shall be.held jointly with the Trustee Election to be held by the South Park Independent School District, in the election precincts set forth in Exhibit "B" attached hereto and made a part hereof for all purposes, in accordance with the following terms of agreement between the South Park Independent School District and the City of Beaumont: (A) The expenses of the election within joint precincts shall be divided with the City of Beaumont paying that part of said expenses represented by a ratio of the number of voters voting in the Municipal Election to the total number of voters voting in both the School District and the Municipal Election in said joint precincts. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, onto a particular set of circumstances, should for any reason be held i invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. Hendrix President Mrs. Celia Coleman ; Vice President Mrs. Shirley-�Tillerv___ Murry J. Frank ; Secretary Dale Elmore Tobe Duhon, Jr. James Potter and the following absent: constituting a quorum, and among other proceedings had by said Board of Trustees was the following Order, to -wit: WHEREAS, the term of office of Mrs. Celia Coleman -and Murry J. Frank, members of the Board of Trustees of this School District, will expire on the first Saturday in April, 1978, said first Saturday being April 1, 1978;.and, WHEREAS, on said date of April 1, 1978, a Trustee election will be held in said School District; and, WHEREAS, it is necessary for this Board to pass an order establishing the procedure for filing for and conducting said Trustee election; THEREFORE, BE IT ORDERED BY THE BOARD OF TRUSTEES OF THE BEAUMONT INDEPENDENT SCHOOL DISTRICT OF JEFFERSON COUNTY, TEXAS: 1. That an election shall be held in said School District on April 1, 1978, for the purpose of: Electing to the Board of Trustees of said School District two (2) Trustees for a term of three (3) years (as provided in the Educa- tion Code and :the Election Code of this State) in obedience to this order passed by the Board of Trustees of said District on the 14th day of February, 1978. 2. (A) That all requests by candidates to have their names placed upon the ballot for the above election shall be in writing and signed by the candidate, and shall be filed with the Secretary of the Board of Trustees at the Superintendent's office not later than thirty (30) days prior to the date of said election. (B) All candidates shall file with said application the loyalty affidavit required by Article 6.02, V.A.T.S. Election Code. (C) The Secretary of the Board of Trustees shall post on the bulletin board in the building where the Board of Trustees meets the names of all candidates that have filed their application in accordance with the terms and provisions of this Order, and said Secretary shall otherwise comply with the terms and provisions of Article 13.32, V.A.T.S. Election Code. 3. That the election precincts set forth on the attached Exhibit "2" are hereby established for said election. A person legally qualified to vote at said election shall vote in the election precinct in which such person resides. The Jefferson County Voting Precincts referred to in Exhibit "2" are those heretofore established by the Commissioners Court of Jefferson County, Texas. 4. (A) That the polling places set forth on the attached Exhibit ''3" are designated for said election, and the said election shall be held at said places, and the persons named on the attached Exhibit "3" are appointed Presiding Judges and Alternate Presiding Judges for their respective voting boxes. (B) The polls at the said designated polling places shall be open on election day from 7:00 o'clock a.m. to 7:00•o'clock P.M. (C) The Presiding Judge for each election precinct shall appoint two clerks, and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for any precinct. If the regularly appointed Presiding Judge conducts the election, he shall appoint the Alternate Presiding Judge as one of the clerks to serve at such election. 5. (A) The electronic voting system adopted by the Commissioners Court of Jefferson County, Texas, for use in elections in Jefferson County, Texas, shall be used for voting 1,7- S 5 ERRT 66 r� 99 8�1� X71,77R Q6 9fl EXH in all of the Election Precincts.on the day of this election and for absentee voting by personal appearance at this election. (B) In accordance with Article 5.05, V.A.T.S. Election Code, Myrtle Corgey is hereby appointed clerk for Absentee Voting, The place for absentee voting shall be the City Clerk's Office, .City Hall, Beaumont, Texas, and the hours for absentee voting shall be from 8:00 o'clock a.m. to 5:00 o'clock p.m. on Monday through Friday. The Clerk for Absentee Voting shall keep her offices at said location open during such hours on each day for absentee voting which isnot a Saturday, a Sunday or an official State holiday. The manner of holding said election and the qualifications of those voting thereat shall begoverned by the Election Code of. this State. 7. This election shall be held jointly with the General Municipal Election to be held by The City of Beaumont, Texas, in the above set forth election precincts in accordance with the following terms of agreement between Beaumont Independent School District and The City of_Beaumont, Texas: (A) The expenses of the election within said precincts shall be divided with the School District paying that part of said expenses represented by a ratio of the number of voters voting in the School District election to the.total number.of,voters voting in both the School District and City elections in said precincts. (B) A single ballot form shall be used which shall contain the School District Trustee offices to be voted upon as well as the offices and propositions required by the City. (C) The above named election officers shall conduct both elections in said election precincts. ..(D) Records for both elections shall be combined. .(E) One set of ballot boxes and stub boxes for both elections shall be used. (F) Election returns shall be made on joint forms but the Board of Trustees of Beaumont Independent School District shall canvass the returns for the School District election. !; SRT A 9� (G) The City Clerk of The City of Beaumont is designated. custodian of all the records and of the voted ballots. (A) The President cf the Board of Trustees is hereby authorized and instructed.to post or cause to have posted this Election Order and Notice at three public places where notices are customarily posted in this school district, and said posting shall be made at'least.20 days before the date of said election. (B) The President shall also cause Notice set forth on the attached Exhibit -111" time in a newspaper of general circulation in school district is located. (A) Further, the Board of Trustees finds that, in accor- dance with the order of the Board of Trustees, the Secretary posted written notice of the date, place and subject of this meeting on the bulletin board at the main entrance of the Beaumont Independent School District School Administration Building, 820 Neches Street, Beaumont, Jefferson County, Texas, a place convenient to the public, and said notice having been posted, remained posted continuously for at least seventy-two (72) hours preceding the date of this meeting. (B) Further, the Board of Trustees finds that this district is located in Jefferson County, Texas, and that written notice of the date, place and subject matter of this meeting was furnished to the County Clerk of Jefferson County, Texas, that said notice was posted by the said County Clerk on the bulletin board on the first floor of the Jefferson County Courthouse,. Beaumont, Texas, a place convenient to the public in the County Courthouse, at least seventy-two (72) hours preceding the date of this meeting and was not removed until after adjournment of this meeting. The returns of said posting shall be attached to the minutes of this meeting and shall be a part thereof for all intents and purposes. - The above order being read, it was moved and seconded that the same do pass. TAKE NOTICE that an election shall be held in Beaumont Independent School District on April 1, 1978, for the purpose of electing to the Board of Trustees of said School District two (2) Trustees for a term of three (3) years. 2.
