ENTITLED AN ORDINANCE AMENDING THE
BUDGET OF THE CITY OF BEAUMONT FOR
THE FISCAL PERIOD BEGINNING OCTOBER 1,
1977, AND ENDING SEPTEMBER 30, 1978,
BY APPROPRIATING THE SUM OF $85,000
TO ACCOUNT NUMBER 79-415; AUTHORIZING
THE INTERVENTION OF THE CITY OF
BEAUMONT IN PUBLIC UTILITY COMMISSION
DOCKET NUMBER 1528, APPLICATION OF
GULF STATES UTILITIES COMPANY FOR A
GENERAL RATE INCREASE; AUTHORIZING
EMPLOYMENT AND PAYMENT OF CONSULTANTS
AND RATE CASE EXPENSES; AND ASSESSING
ALL COSTS INCURRED TO GULF STATES
UTILITIES COMPANY.
WHEREAS, on December 30, 1977, Gulf States Utilities
Company filed an application for a general rate increase with
the Public Utility Commission of Texas and with the City of
Beaumont; and,
WHEREAS, the City Council is of the opinion that the
City of Beaumont should intervene in the case pending before
the Public Utility Commission of Texas; and,
WHEREAS, Gulf States Utilities Company has committed
to reimburse the City for its rate case expenses incurred
pursuant to the Public Utility Regulatory Act;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
1.
That the budget of the City of Beaumont for the
fiscal period beginning October 1, 1977, and ending Septem-
ber 30, 1978, is hereby amended by appropriating the sum of
$79,000 of $85,000 to Account Number 79-415, said appropriation
to be taken from Account Number 79-601, representing expected
reimbursement from Gulf States Utilities Company.
2.
That the City Attorney be, and he is hereby,authorized
and directed to intervene on behalf of the City of Beaumont
in Docket Number 1528 before the Public Utility Commission of
0
Texas, an application for general rate increase by Gulf States
Utilities Company.
3.
That the City Attorney be,_and he is hereby, autho-
rized to retain the firm of Touche Ross & Company to provide
analysis and expert testimony in said case and Don R. Butler
to serve as lead counsel; and that the appropriate city.offi-
cials of the City of Beaumont are hereby authorized to make
payment for said services upon approval of the City Attorney.
4.
That all costs incurred in connection with said case
are hereby assessed against Gulf States Utilities Company
pursuant to the Public Utility Regulatory Act.
