Fort Smith Railway Company, its successors or assigns, the right and privilege to construct, lay and maintain a side or switch track of standard gauge, over and upon a portion of Washington Street in the City of Beaumont -Rand to operate its trains and cars thereon for a period of Ten (10) years, said side track or switch track of standard gage to be laid along, over and upon Washington Street, between Jefferson Street and Park Street, breaking out of the main track of the Texarkana and. Fort Smith Railway Company on the northwesterly side of said main.track in Washington Street, between Trinity Street and Jefferson Street; thence extending northeasterly in Washington Street parallel to and fourteen (14) feet distant northwesterly from, measured at right angles to said main track, and over and across Trinity Street and Neches Street; thence curving to the left to an intersection with the southeasterly line of Lot Number Three Hundred and Bighty?4tyn (382) in block Fifty-five (55) of the original town of Beaumont, as per solid yellowy lines on attached blue. print, which is made a part of this ordinance; prescribing the con- ditions to be fulfilled before said ordinance shall go into effect, and the time limit for the construction of said track; y � V ON T I-ilS THE O; J. The Texarkana & Fort Smith Railway Company is hereby granted the right and. privilege to lay and maintain at its own expense, a switch or spur track of standard gauge, over , along, ` across and upon Washington Street in the City of Beaumont, and to operate its trains and cars thereon, for -'a period of Ten. (10 ) years, said switch or spur track being specifically described as follows: A standard gauge railroad track breaking; out of the main track of the Texarkana & Fort Smith Railway Company on the northwesterly side of said ' main track in Washington Street between Trinity Street and Jefferson Street; said track thence extending northeasterly in Washington Street parallel to and fourteen t14) feet distant northwesterly from, meas2red at right angles to said main track, on, over and across Trinity Street and Neches Street; thence curving to. the left to'an intersection with the southeasterly line of l;ot Number Three Hund.red and Eighty-two ( 382 ) in Block Number Fifty --five (55) of the original town of Beaumont, said track being represented by. solid yellow line on attached blue. pr int whidh is made a part hereof. SECTION II. The switch or spur track constructed, laid and maintained under this ordinance, shall be s, used only as an industrial track, it being understood that the construction of said track is only 'for the purpose of.reaching commercial 'and industrial. The foregoing rights and pr ivilgges are granted upon the expressed. condition that the said grantee, its successors or assigns, shall comply with all the .laws and regulations of the City .of Beaumont, and shall, within thirty (30 ) days after the final passage of this ordinance, file_ with the City Secretary of the City of Beaumont, its written acceptance of this ordinance, and deposit with the City Secretary the sum of Twenty' -five (25,00) Dollars, to cover the expense of publication of this ordinance, as required by the. City Charter, provided, that in the event the cost of publication exceeds that sum,said grantee agrees and obligates. itself to pay said City any amount .in excess thereof,: and provided`, 'also' that the City shall return to the.Grantee, any amount which may remain out of the said twenty-five ($25.00) Dollars f irst deposited after defraying the expense of sal d publication, SECT ION IV. Unless the grantee, its successors , or assigns, in the event .it accepts this ordinance, shall construct, lay and have completed the track herein stipulated, within one hundred and twenty (120) days after the final passage, acceptance and publication of this ordinance, the same shall be null, and. void. and of no force and effect, OVOMTnTT Tr _ This ordinance ia passed subject to the provisions of the Charter of the City of Beaumont, and all laws now in force or that may hereafter be enacted.
