HomeMy WebLinkAboutORD 77-122ORDINANCE NO. % % - / ,� Z ENTITLED AN ORDINANCE AMENDING CHAPTER 32 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO AMEND --SEWER RATES FOR RESIDEN- TIAL AND COMMERCIAL -INDUSTRIAL CUSTOMERS; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEALZ04T: THAT Chapter 32, Section 32-8 of the Code of Ordinances of the City of Beaumont, Texas, be, and the same is hereby, amended to read as follows: Section 32-8 (a) Residential customers shall be charged the following sewer rates based upon metered water used: there shall be a minimum charge of $1.75 to all residential dwelling units. A charge of $.50 per 1,000 gallons based on metered water as specifically set forth hereinafter shall be assessed. Sewer charges for the months of December, January and .February will be based on actual metered water usage. Sewer charges for the months of March through November will be computed based on the average of the monthly water.usage appearing on the December, January and February bills, or the actual usage for the months of March through November, whichever is less. Where no preceding December, January and February monthly average volume is available from records, the Director of Water Utilities shall establish an average monthly volume based on the average monthly water use of all residential water users in each particular billing cycle for the winter months set out above. `(b) Commercial -industrial customers shall be charged the following sewer rates based on metered water use: there shall be a mini- mum charge of $1.75 to all commercial -industrial customers. The monthly charges to commercial - industrial customers shall be $.50 per 1,000 gallons of total metered water used. Charges to commercial -industrial users in accordance with established rates may be based on the amount of metered return flaw as measured by a meter approved by the Water Utilities Department and furnished and 'installed at the users expense. (c) Failure or refusal by any customer to pay any bill to the Sewer Department, or its auth- orized representatives upon demand, shall.con- stitute a breach of contract, and water and sewer service may, within ten (10) days from notice of such failure, be discontinued to the customer, and, at the discretion of the Director of Water Utilities, such service shall not be renewed until the customer has paid all delin- quent bills,plus the applicable service charge as provided herein. Protest of charges on file with the department shall not in any manner alter or extend the purposes of this subsection. (d) Where a building containing more than one dwelling unit is served by a single meter, or where there is not a separate water meter for each dwelling unit, each unit shall be charged a minimum base charge. -2- That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
